Gawking Neighbors & Easement

We moved into our home 7 years ago at what we thought was a dead end. When signing the papers, it turns out that we share an easement with two homes behind ours. However, they created another easement of their own, and never used ours . . . Until recently. They haven't paid for or taken the initiative to maintain our easement for at least 8 or 9 years according to the other neighbors who rightfully share the easement. The only clause in the deed paperwork is that all neighbors must pay to maintain the easement, regardless if it is being used. So my question is, what I can we do to have this easement removed from the neighbors who are using the easement simply to gawk? Any advice?

Yes, speak to an RE lawyer. Information you'll get here will only be guesses, which could lead to who knows what if they're incorrect, and it also depends on where you live.

I agree with Lucy. I'd get to a lawyer ASAP and find out how to legally remove the easement. I wouldn't make my intentions public to these people, either. They may start maintaining the area and that would just complicate the issue...

The weirdest thing - someone, maybe even the owners, mowed and trimmed the yard yesterday. I think it was someone else though because there were two of them out there with weed-eaters, and supposedly the homeowners don't have a weed-eater. They even did the six foot Johnson grass around the driveway, and all around the house AND they did the backyard. I don't think the backyard has been trimmed in the years they have lived here. But another family moved in with them a month or so ago (3 families there now), so maybe they had a weed-eater and did it. franksmom, I'd guess the lines are about 16 feet above ground. I've got a vitex planted under it now but it will get too tall if it grows like my other one. The photinias get much too tall, and they get that disease now that I don't want to deal with later. Knockout roses are a good idea. Right height and they'd be pretty too. I'd like to find something native, but right now fast and thick takes priority. Gretchen, neither we or the neighbors would hire anyone to do their yard without their permission. Someone would have to talk to them, but that's another reason I don't want to do it, and I'm not sure who would.(Talk to them, that is) These neighbors have burned their bridges with most of the other neighbors. The neighbor who called me, man Neighbor 1, might be able to talk to them. Though from what he said, his only interaction with them has been to tell them he was going to call the police if they didn't keep their aggressive dog out of their (Neighbor 1) backyard, turn down their music at midnight, etc. The male neighbor on the other side of them is a peacemaker, and he might be able to talk to them, but he lost it one summer when the parents left the kids in the house all summer with no food and no money. I don't know if he is speaking to the parents now or not. But hey, it's mowed and trimmed now, so I guess now is the time for any of us to put ours on the market I guess. Too bad we're not ready. The more I think about it the more I do not want to deal with an easement, just too many possibilies for issues. The only way we would purchase the property would be if we could also purchase a strip of land from the neighbors. There actually is another easement as well on the other side of the neighbor's property, for a bridle trail. I wonder if it would be possible to utilize that in a potential negotiation, as we don't have an interest using the easement. Between the access easement and the bridle trail easement, the neighbor is quite limited in fencing option I would think. Maybe for a few thousand dollars and relinquishment of the trail easement (if that's possible) the neighbor might be interested. I have no idea how be would price a small stip of land that is already encumbered by an easement. Chipsa: I agree, if we can purchase a portion of their lot for a *reasonable* amount then I would be inclined to do so, but if not then I think we will pass on the property. I don't even know if the neighbors are open to selling. And that's just one issue we still have all the other unknows to contend with- well, septic approval, "wetlands", etc. This land buying business is turning into a real headache. It's been a little while, so I wanted to post an update. They just finished the first town home that's positioned like my home to be, and they did something totally different with the air conditioners than they're doing on the other side. They built the fence around them, so that cuts off some of the yard, but they extended the back fence out farther to make up for it, albeit with a narrower strip of land. That works fine for me, since the A/C for next door can be serviced without anyone coming into my yard. It's an odd arrangement, so I'm posting a photo to clarify. Most of the time, having a drainage easement run through your yard does not mean that you can't fence portions of it. You just can't impede the flow of water, just as your back neighbor's chain link fence doesn't (because it is above ditch centerline and runs in line with flow of water.) A fence of yours abutting it would be approximately the same. It is where a fence crosses the ditch -- such as might happen at the corners of your yard -- that a healthy gap below the fence must be maintained so water can flow below it, unimpeded. But being realistic about this, privacy fencing is barely going to make a dent in your privacy needs on account of the elevations involved. If it was I, I would assess fencing based on security needs and achieve screening via another method, primarily tall shrubs. Wouldn't those that achieve 12' to 15' height do the job? If so, that's all you need. Of course, in selecting shrubs you'd need to take into account the light conditions so that they prosper. Sometimes, in cases like this, a plant is selected that survives sun or shade and will work throughout the entire area, simplifying the hedge. Sometimes, groups of different plants -- each appropriate for the given light condition -- are used for a more varied effect. You'll weigh what you do against your overall back yard design objectives. Sometimes people have the idea that shrubs will grow painfully slow and take forever to do the job. I think in most cases, it's opposite. But a huge amount of how fast they grow depends on the care they receive during the establishment phase (first two--three years.) If they get plenty of supplemental water and fertilizer on a regular schedule, they will likely grow quickly, making your privacy concerns soon disappear. Curious, what are you doing that the neighbors feel the need to "Gawk"?

You can hire someone to survey your property, if you are thinking of selling you might have to do that anyway. The $7-$10.00 options is go to the county and get a plat map of your property. What it says is what you own and where the easement is.

An easement is property owned by the city/county/state to get to sewers or other utilities. The neighbors cant just make up a new easement. I am sure your neighbors know that.

An easement is not property owned by them it is just an area they can utilize and install utilities. Easements can be any footage off of a property line or permanent marker or so many feet either side of a property line. You still pay taxes on that area if it is your property and it is your sole responsibility to maintain per city or HOA rules. It gives your local cable company the ability to trench in a new line through that area and not have to get permission, or to go back and perform maintenance/repairs.

I would go to the courthouse and get the low down on the property lines and eaesments.

1) What does the easement allow them to use it for? Typically if not for utilities, the easement is for access of some sort to their house. They can't just set up a tent or a basketball court on your land because they have an easement to drive across it.

2) To remove it you would have to revise all your deeds to extinguish the easement. In addition to the legal fees, you would probably need to pay them something, because an easement has value even if they aren't currently using it. The fact that they don't use it means you may be able to buy it from them for cheap, however. ($1000 for nothing? sure!)
