Comments (62)I am sorry about your neighbor. You are not alone. These people wrote their comments and me are in the same boat, which we all have problems with our neighbors. My neighbor Todd and I had peace and no problem for 16 years until his girlfriend warned me that Todd started to angry and mad about everything. I don't know what point at this problem. He started welding sandblast business outside on his driveway. The sandblast spread out anywhere, went in the air, went over the fence to land my property where egetable garden is. It killed them. Also, I washed sandblast off my tomato...my mouth tasted and burned. I tried to talk to him about situation with welding sandblast but he was very aggressive (mean, angry and yell). I was so scared and walked away. i called the police and code enforcement. Two officers showed up and saw his active of welding sandblast. They allowed him to use. No violation ticket. He continued to do welding sandblast. He ignored state codes and has no business permit. He threw the grapes at my driveway and property. I called the police. They do nothing. No violation tickets for littering. He posted five notes on my door and my car. He banged my door and stayed for 15 minutes. I called 911. Police showed up and cancelled 911. I proof his five notes. No violation tickets for criminal trespass. I bought new wood fence to stand next to the chain fence to block his view. But still problem is he walked out on sidewalk in front of my house and yelled or sweared at me several times. He put his solar lamps on my property without permission. I took them and threw them away., He was angry and called the police. I got violation ticket for theft and trespass. Police don't care. Sad. He bought solar lamps and put them on my property. They still are there. I cannot take them. I filed out for restraining order but judge turned it down. Not enough proof. I was stuck. I installed security camera and caught him several times. I called the police. Officer, Lt officer, detective officer and chief showed up at my house. I showed them a few videos. They talked to my neighbor Todd. They told me that Todd had problems about his girlfriend s health, finance and problems from friends, family and his work so he has emotions and carried to blow out or throw on me. It is his own responsibility, not me. That is what I'm not involved. It looks like he has problems and beat up own big bag to blame to other person. That is me, I'm innocent. He knows I cannot hear and I cannot read lip. He doesn't care. No respect. He swears at me from his property and sidewalk. He removed my solar lamps, Halloween stuff and ladder on my property. No violation ticket for trespassing. I wanted to move out but problem with my finance. I cannot afford to pay a new place to live. I don't know where I turn to have someone to help. Comments (28)I used to live in Santa Monica and work at Wilshire and the 405 and traveled along San Vincente Blvd to get to work (circa OJ/Nicole era, passed by Mezzaluna many times not knowing it was there). The length of San Vincente Blvd between Brentwood and the coast in Santa Monica has Coral trees planted in the center median. These are old, mature trees, been there for years. As Hoovb mentions, the trees do not fare well in high winds. Have seen several of these trees crack, split or have limbs come down in high winds. Comments (20)missingtheobvious is correct. In New York, the supreme court is the court of general jurisdiction that hears cases. It is the opposite of most states and the opposite of the federal court system. I have a law degree but don't practice law and am not well versed in estate law. THIS IS NOT LEGAL ADVICE. However, as far as I know, she can't come after you personally. She can only make a claim on the estate. I believe if the estate is probated already and sufficient time has passed without her making a claim on the estate, she is out of luck. See e.g. http://codes.lp.findlaw.com/nycode/SCP/18 § 1802. Effect of failure to present claim If any claim is not presented on or before the day fixed in the notice published pursuant to the preceding section or if no notice is so published, within 7 months from the date of issue of letters, the fiduciary shall not be chargeable for any assets or moneys that he may have paid in good faith in satisfaction of any lawful claims or of any legacies or distributions to the legatees or distributees of the decedent before such claim was presented. Such 7 month period shall begin on the date letters were first issued to any fiduciary, including a temporary administrator or a preliminary executor, and shall not be interrupted by any subsequent issue of letters, except that the time during which there is no fiduciary in office shall not be counted as part of such period. and § 1803: Every claim against the estate of a decedent other than claims for expenses of administration and claims of the United States or the state of New York must be in writing, contain a statement of the facts upon which it is based and the amount thereof. Comments (17)No, DD doesn't complain to me about her roommate, only once she said, "You can't believe anything she says."...She knows that I hate how she's being taking advantage of, but she does talk to her Dad about it sometimes, because he can listen without criticizing. Maybe I shouldn't of said, "legally"...wouldn't want the law involved...thought maybe there was a way to get the roommate to want to move out. Apparently, the two get along fine with each other. But their social life is opposites. 'Freeloader' likes to go out and party as if she doesn't have any responsibilties...DD doesn't allow any alcohol in her house, and she has her own circle of friends. Stargazer, if the roommate was a druggy, it might be easier to get her out, like you wrote about your former son in law's father did...not many druggies would go to the police complaining(?)...but, she isn't. Her attitude seems to be that DD would have to pay the rent anyway... so why not let her live there free! DD has always wanted to rent that house... she loves it, no kids... but pets are allowed...But... it's very expensive...with a huge yard and a nearby lake to enjoy...When it came up for rent again...the roommate promised to pay half...But, instead, took out personal loans, likely spent on her friends and whatever she pleased...Then bought a new car...and tells DD that she doesn't have any money... Actually not contributing a penny to DD. What is so aggraving to me is...DD will likely lose her 'dream home'...She has a lot of furniture...All the freeloader has are her clothes and a cellphone. If she would only leave (When what freezes over??)...DD has another friend that would move in with her, who has a good paying job, and seems very reliable. We could help her with paying the rent...but that means also helping the freeloader live free-rent... who had once lived with her sister in a small, cramped house. Her boyfriend is a freeloader too...He doesn't own a car, lives with his aunt for now , and she taxi's him everywhere and buys him cigarettes, etcs., DD has never asked us for a penny, or for any help...but I try to help in some ways that won't benefit the freeloader...I buy her cat's food and cat litter when I buy for ours...Sometimes, I insist on paying her cellphone bill because she bought me a cellphone too...and is paying for it...She thought I needed one...Occasionally, DH takes her truck and gets the oil changed for her and fills the gas tank. But it's still a struggle and she doesn't complain to us...But, DH recently told me that DD had to drop her Internet and Cable TV.
