Issue with Garage (HVAC)-A little long

We are only a few weeks from closing, final paint is done and there are a few odds and ends to tie up before our new construction is finished.

Last week my husband went to the house and noticed that the HVAC "tubing" (2 silver colored-about 2 feet in circumference (4 feet wide, 2 feet deep) had been snaked through the back wall of the garage to the upstairs. Our garage is 22x20, which would be tight to fit two cars on their own. We have 2 8' bays and it would obstruct the car in the left bay in that I would have to physically exit the garage and go through the other bay in order to access the stairs that go into our mudroom. There is another small issue in regard to the stairway that was built because the other car (a Camry) would not be able to fit in due to that having a large platform. So we have a two car garage and can't fit either car in without an issue.

After the P&S was signed, we extended the garage from 20x20 to 22x20 because we knew it was a tight fit, so at the time the builder knew it was an issue and suggeste this size. We never saw the HVAC on any drawings for the house.

The stairs are an easy fix but the builder says that the HVAC tubing can not be moved, but would call his HVAC guy. Its been since last Wednesday and we have not heard a peep. We have tried communicating about other things associated with the house, but with no response. usually we hear right abck from him or within 24 hours.

Any ideas? We are emotionally and financially (over $15K in overages paid in cash already)invested in this house, but don't believe we should have to pay for something like this to be fixed/changed or figure out how to live with it in order to close.
