Concrete problem and I am more than unhappy!

Since my contractors did not do concete work, I obtained the same person who did my foundation, porches, and garage floor and they are okay...BUT my driveway is a mess! I left the house for a couple days while they poured and when I got home, it is cracked terribly!!!

I documented, photographed, obtained the invoice from the cement company, obtained opinions from 4 other cement contractors and even talked to an attorney. The guy who did the drive has never even come
down to discuss this with me....only "hot" text messages. I know I will
probably end up in court, but I think he thinks I am just an old woman who will just pay the bill.....wrong!

The delivery invoice said that he called for 25# of water to be added to 16 yards...which the cement supervisor said was "excessive" and it churned in the truck for 57 minutes before delivery.

It seems to be the "opinions" of others that either he did not compress the base or the mud got too hot and he added too much water.

The Attorney suggested that I write a "Letter of Demand" stating what and when I want done. Kicker....this guy is the grandson of my sister-in-law!

Just venting....any other thoughts or suggestions to help me? THANKS!

Very sorry to hear of your situation. Best course of action is to stay calm and cool (as possible) and follow your attorney's advice. Write the letter and send it registered mail, return receipt requested.

What do you want done? From the sound of it, removal is about all I'd trust him to do. I'd not pay him and have someone else do the new drive.

Bummer, but you're pursuing the problem in a calm, rational manner, and I'm sure you'll have resolution in the end. Just don't do what they want: Don't give up.

""the wife was feeding the worms everyday."" How much? How many worms do you have in your WF? I very seldom put fresh worm food in my worm bin. Even melon rind will sit around for a couple of days before putting it into the bin. ""to get the soil moisture"" What kind of soil are we talking about and how much of it? Or did you just mean the worm bedding and whatever poop there are. Den, you could put your hand in to get a feel whether or not it is too dry. My bins are all wetter than a "wrung out sponge" but not dripping wet. I think the worms like it better as long as the VC and bedding are not compacted. That is when they don't get enough air. When dry, worms die. ""should they only be feed food every few weeks?"" Since your system is fairly new, I suggest not to spread the food out when feeding. Put it in one section; as a start you might want to pick the centre, maybe, so there is access from all around. Next feeding, pick a corner and the next feeding next to it and so on. IMO, this is easier to check. You can feed again if that pile is gone or almost gone. I usually feed my bins 2x/week and I feed them rotting stuff.

Look, cottage industries do not fall under zoning codes. People are allowed to "work from home". Do you think that website designers and software deveopers need to work in a commercial area? What about phone answerers? Seamstresses? Tax preparers? An architecht who does drawings at home? What about all the prople who sell on eBay for a living? I have a friend whose job it is to shop for potatoe chips and cookies and then take them home and count the contents and weigh them and count broken pieces and type up a report and send it in to the company as a quality control report. Is she going to get kicked out of her home for doing this?!?!?! Geeesh. Of course not. Another friend writes for magazines from home. If everybody had to get an office or studio to do these things, cities would be ghost towns. Zoning is to regulate traffic and congestion into an area. You can't run a buniness out of your home that brings in either pedestrian traffic or vehicular traffic. Or causes a nuisance with noise or odors or anything else that residents may complain about. I have a neighbor who is running an illegal day care center out of her home. Cars are coming and going all day long with pick-ups and deliveries of children and babies. There are screamming children running around in the yard all the time and a row of strollers with babies lined up outside on days when the weather is nice. Now that is a business that is breaking zoning laws. My parents next-door neighbor is running some sort of business that involves a gigantic semi driving into the alley and unloading crates of who-knows-what a few times a week. That is breaking the zoning laws. Some neighbors finally complained and reported it, as the loooong semi would block access to everyone's garage and the driver would just tell people to "hold on" and wait while they unloaded the truck sometimes making people late for work or just making people idle their cars waiting or having to back up out of the alley to let the truck out. That is breaking zoning codes. What is the diiference between a hobby and a business? Huh? If someone paints watercolors as a hobby it is OK, but if they take them to a gallery and sell them then no? If you sew your DD a dress it is OK, but if you sew five of them and sell them on eBay, then all heck will break loose with the LL and the zoning codes? If a guy records himself and get paid for it......? Going after this guy by trying to use zoning laws won't go anywhere. This is a tenent/landlord issue. The guy is just a jerk expecting everyone to tiptoe around him. I like Talley's sample letter to sent to management. It could just be CC&P and printed out and mailed to them.

Thank you all for your support it means the world to me. I've always been the type to beat myself up for not knowing how to do the things just right. It would not be so bad if dad's mind wasn't clear as a bell right now. His abuse of his medicine is a real concern for me. I got a call from him today saying he needs his antibiotic for his sinus, well he'll only take one or two and he says it cures his sinus. You and I know this isn't so and even if it does help it's short term, taking the antibiotics like that can cause harm but no one can get this through to my dad. I have had so many problems with doctors in my past that I don't trust them easily. It was me that saved my husband from a possible stroke, his blood pressure was high and I could tell when it was up but with the sleep apne he had to take showed how bad it was. They could not get it down all night so I marched into our dr.'s and told them about this and they looked back at his chart and seen that it was high everytime he went in for a check up. Now why don't they pay more attention to this? This is why I fear looking for yet another doctor. I have no luck with them. Only once did I have a wonderful doctor and within a year my insurance changed and he didn't take it :( He was the one that listen to me about my weight and took test finding that my thyroid was bad. I went through years with a sore throat and my throat closing up at night in my sleep, waking up unable to breath for 10 or so seconds but felt longer and didn't know if I'd get my breath. If it's wasn't for y'all I don't know if I'd be able to be strong for my dad. I never knew it could be so hard. I look at pictures of my grandparents, dads parents and talk to them and wishing they were here. They had a hard life and I can just image that they went through just what I am now. They took care of my great grandmother for 17 years then told my grandmothers brother it was time for him to care for his mother and give them a break. Great grandmother was called little granny and I never seen pictures of her but heard great stories about her, I found a picture of her the other day and I'm so happy to finally seen her, she past away a few years before I was born. I don't know anything about prices in NJ, but in Michigan I spend between $85-130 week on groceries for a family of 4, but my budget isn't as tight as theirs is right now. I buy lots of expensive things such as cereals, granola bars, extra lean beef . . . I do shop sales and use coupons for cereal and granola bars, but if I were in a money crisis, I could certainly make due with less pre-packaged junk food and focus on nutrition vs. convenience. BTW, I was talking with a friend from out of state who in the same conversation told me about her husband losing his job and her new $32 haircut that she wasn't happy with! Some people just don't get it! When she visited this summer, she wanted to stop at the convenience store for a soda when she had some at the house and we were only 2 minutes from home! Silly and wasteful habits!

Phoggie,

I hate to hear your having any issues. I know you were so pleased with other parts of your recent build. I'm curious if he put any rebar into the driveway? I recently poured a floor in my shop and struggled with that decision. In the end, I put #5 rod on a 2' grid. I thought why risk it. I may end up with some cracking in the future but the rod will help hold it all in place.

Again, sorry for your troubles. I hope you find some way out of this without having your relationship with your sister-in-law suffering.

I would suggest that perhaps your attorney write the letter.

A few well written words from a good attorney will likely have more impact than a letter written by you.

I'm sorry this has taken a little joy out of your new home experience.

Sorry to hear this is happening.

As an attorney, let me say that none of us can second guess your lawyer's advice, although it is a bit surprising he wants you to write a demand letter. I suppose the advantage is that if your letter did the trick, you wouldn't have to pay attorney fees. I'm assuming your state does not allow you to recover attorney fees in a case like this? Might be a good question for your lawyer.

Another thought: if this is going to wind up in litigation, your comments on this thread and anywhere else on social media will likely be discoverable, that is, the other side could request copies and potentially use them against you in court. I tell my clients to maintain "radio silence" with the world regarding their cases except with me. You may think nothing you are saying makes a difference, but we have had cases seriously compromised by social media our client never thought would be a problem.

Good luck in getting this matter resolved.

If this says 25 gallons of water added to 16 cubic yards of concrete I do not think that anyone can say that is excessive without knowing the consistency of the mix as delivered. In other words only if the delivered mix was already at or close to maximum water content than it would be excessive.

You would assume that the delivered mix was very precise but in my experience that is not true.

That being said concrete placers tend to over water it so that it is easier to spread.

I suppose it could also be a possibility that someone drove on it before it was fully cured.

Anyway you should not expect excessive cracks in a new driveway and so something was obviously wrong.

Angie's List, the Better Business Bureau, The State Attorney General's Office...all will take your complaint. Let him know that if he does NOT either make this right or reimburse you...you will be filing with all these agencies. This will lower his business rating and he will lose business. Maybe that will make him reconsider...
