Footers full of water and silt...

The first dirt was moved on May 3, 2007 and it has rained nearly every day since. The builder finally had the footers dug and rebar put in place last Monday and guess what? It rained that night!! We basically have a mud pit surrounded by a moat. My DH wants the rebar all pulled out and the silt dug out or the whole thing started over. When he says start over he means fill in the footers and tamp the soil down, redig the footers...the whole nine yards. He says we if don't have all this done then we would have massive footers and it would cost a fortune to fill the ditches with concrete. I can see his point, but I am just wanting other opinions by people that have been in this same situation. What did you do? What is most cost effective, and more importantly what method will give us the best footings. We are in an area with very hard clay soil and houses tend to shift and crack especially with extremely dry summers. Below is a picture of the footers and rebar before the rain.
