So the saga continues...

I will be brief.

Frank and John (our listing agent) had words Thurseday afternoon. It was over the phone andI was not there but the jist of it was the 2 men yelled and talked over each other. To ne it was childish and not at all productive.

Every issue that Frank raised, John would talk over Frank and so nothing was resolved.

Friday evening the new agent Ed stopped by, took a look around, told us a few minor things that have to be addressed, said to lower the asking price to 85.9 and instead of offering a sellers agent bonus, offer a one year home warranty.

He listened, really listened to our whole story from 2 years ago when we first decided it was time to move and began working towards our goal right up to our target home lowering the asking price. He heard what we were saying.

He also said we are well within our rights to ask to be released from our contract with John and Century21.

Said go ahead and call him to ask for the release in writing and then Ed can re list our property.

He finally said to go ahead and make a first refusal offer on the target house. I was shocked!!

Its similar to a contingency only we slow down the process by offering a low number only to be sure to have it countered...basically it buys us time.

So the following day Frank calls John and it did not go well at all. Not only is he refusing to release us...he is demanding that we give HIM 30 days notice of cancellation!!

Again some not so nice words were exchanged.

Later on Sat night, with a very cool head I e mailed John a very nice e mail basically playing good cop to Franks Bad cop.

Told him I held no hard feelings and that we all know the house is not going to sell in 3 weeks anyway so please just release us by Monday (today) at noon. (I gave him a time limit LOL)

I went on to say I was shocked at his decision...I thought he was my friend yadda yadda yadda.

So now the ball is in his court. If I do not hear from him today by noon Frank is going over his head to the Broker.

We also have the number to a rep on the Philadelphia board of realtors who is also over John head and finally we retained legal representation....oh and Frank has aslo left 2 messages with consumer reporters on 2 local channels.

John is mad and trying to undermine our success.

While we wait our home will be unavailable for showings (YEAH...no cleaning today!!)

Hopefully after a few nights to sleep on it John will release us. Then tomorrow we can list with the new guy and maybe by Wed get the offer over to Shanen.

BTW....you know what happened 20 years ago on this date????

WE were at settlement on THIS house!!!

So maybe we can get some good real estate kharma going for us finally!!!

Cheers!

Susie

ps....we took Amy to see the house yesterday and a wee small tear fell from her eyes she loved it so much!!
