seeking advice for a friend

Hi:

A friend of mine, an elderly lady, purchased a newly built home from a builder that is in a new subdivision. When she purchased the house from him she asked if there were any homeowner associations in that subdivision and he told her no. Needless to say he didn't know what he was talking about and she found out there is. She found out after 2 years of dues were past due. She also learned that they put a lien on her house for non payment, tacking on the lien fee also.

Should she consult with an attorney and go after the builder for this oversight?

Was it her responsibility to find out about the association before she bought the property? She went to the builders site and nothing was mentioned about the association for this subdivision. She is only one of maybe 10 property owners in the subdivision. They are also requiring a certain level of landscaping that she can not afford or complete herself. Anyone with advice? She's in Hattiesburg, MS. Thanks
