Bill --Tile shower question--leaky shower redone still leaking

Tile contractor built our tile shower. Our shower leaked into the basement after using the shower for a couple of months.

The tile contractor then tore out the shower floor (down to the wood) and the lower part of the walls of the shower. The membrane had holes in it and the weep holes were plugged. He redid the shower and turned it into his insurance company (State Farm) to the tune of 6K.

Within a couple of months it was leaking again. We stopped using the shower and tried to contact him--He would not return my husbands calls.

I finally got him yesterday on the phone and he agreed to come out and look at the shower next week (we'll see if he follows through).

Is his insurance obligated to fix my shower again and if so am I obligated to let this incompetent man do the work?

What do you think I should do? Any advice will be appreciated.

I am ready to hire someone else and pay for the whole job out of my pocket--AGAIN if I have to, but wanted to resort to that last.
