New home foundation issue

I purchased a new home 8 months ago

When the builder poured the 10" full concrete foundation they made the two opening for basement windows in the back wall huge. They then installed windows half the size of the opening and made up the differences with wood framing.

When final grading was done they actually brought the grade so high in the back of the yard that the dirt actually covers the wood framing by at least 10 ".

This is a code violation which I have brought to attention of the township and the builder. The builder agrees to fix it but we differ on the repair.

The builder just wants to replace the bottom part of the window framing with block and back fill.

I am requesting that they form and pour the area below the window and mechanically attach it to the old foundation with rods drilled into the old foundation. I am also requesting an engineer approve this plan since there is load and force pushing againsnt the repair. The builder only wants to use their on staff architect .

Am I correct what am fighting for in the way it should be repaired ?
