Getting out of apartment lease if i never moved in or showed up.

I wanted to know if there was a way out of my contract with campus crest since i never moved in the apartment. I didnt know i had signed a legal contract, I was told this was just a contract to see if my guarrantor and i qualified for the aplication. We signed the paper work, and faxed it to them. After i qualified i asked the manager what would i have to do to get a rental aplication. She told me that she could just use the paperwork i sent her. Now im in colections because i never showed up. The aplication addendum says i cant be heald liable until i pay the move in fee. by the way, i live in arizona and i was supposed to move to colorado.

When you sign an "application" regarding rentals, it usually does mean you've agreed to a contract, especially if you are then told that you qualify financially (in other words the qualifying is like a formality sealing the deal). If you really were misled (and it's your first time renting) re what it was about, you might have a shot at breaking the lease, but the fact you didn't move in doesn't matter - why should they care if you're there or not as long as they get their money every month? But the move-in fee business is also interesting, and I think you really really need to talk to a lawyer about the whole thing rather than depending on friends or (especially) strangers on the internet who may tell you with great confidence that they have the answer, but may be out to lunch. But don't wait any longer - your credit rating is already compromised.

If it went to collections you are too late. Your credit is dinged and you have to now deal with the degenerate collection agents who don't care about your story and have heard every excuse in the book.

Even going to a lawyer is going to cost you a lot of money, you are better off just paying off your debt and seeing this whole thing as a learning experience: READ BEFORE YOU SIGN!

just because you're not *in* your home doesn't mean it isn't still your home. It has your stuff; it's waiting there for you when you get back, no one is moving your stuff around, etc. But if your dad has lots of room, and is the kind of dad that would not try to change you, or expect you to become HIS buddy/roommate more than you wanted to, then it could be worth trying to one. One nice thing: you don't have to commit to Dad until you figure out whether you can find someone to sublet. Or a new non-sweetheart-type person to be a roommate (if your place has room for it)

Unfortunatly you signd a lease. They could hold you to it no matter what. You could try to fight it in courth BUT at that point its the judgment of a third party who knows the law... and whats leagel and right are two different things. I would tell them they are not giving you the quiet enjoyment you deserve, and they are allowing other tenants to break apt rules, (if they have any) Let them know if they do not allow a transfer you will be forced to seek legal advice. Most likely they will just let you move to avoid more problems. Ask the manager for his/ her home number so you can contact them when the problem occurs. That way they could hear/ see first hand how bad it is.

I think you might need a lawyer. If you can't afford one, your area might have a Legal Aid that will help you. Or at the very least, google "yourstate tenant landlord laws." The reasons for breaking a lease are different in every state, so you need to find out what the laws are where you live. When you had all the electrical problems, that was the time to contact the authorities--there are laws about providing things like electricity and heat and, in some states, air conditioning. But now that things are fixed, it would be harder to get the proper agencies involved. Did they give you anything in writing about no children overhead? That's something you could use to break the lease. Starting now, and until you get out of there, document everything that happens. All the noise from upstairs--and the result of that noise. "Oct. 18, 5 pm. Child jumping on floor upstairs. Unable to hear TV at normal volume. Oct. 19, music playing upstairs. Unable to have conversation without yelling to be heard over the music." Also document any problems with the apartment, like the electricity and water and heat, etc. If you leave the apartment without breaking the lease, you will still have to pay rent there. But the landlord can't just sit around collecting your rent. They have to make efforts to rent the apartment. So if you do end up leaving without breaking the rent, keep checking to make sure that they are advertising your unit and showing it to potential tenants.

Oh, honey. Can't we fix up your SS and my SD and throw them to the curb??? I feel for you, but at least your husband is on your side. I have tried everything in my case and my DH is just burying his head in the sand. W/ us, I was taken advantage of so badly by his son, who lived w/ us for a couple of years at the end of H.S. and for breaks from college. Then, these SDs started crashing in on us during college, always w/ a crowd. Now, this older SD moved in for "3-4" months. It'll be 6 mo. in the end of the month and I'm just sick of it as it's very disruptive to my 3, almost 5, and 7 y.o. boys. Anyway, your situation stinks. Your SS CHOSE to be an adult when it was convenient for him to be an adult, but when it's easier for him to play the "poor son", he reverts back to being a child. I feel for this poor baby he fathered. I actually commend him for wanting to step up and be a father, but he needs to first recognize himself AS AN ADULT! My parents have had issues w/ my brother. My dad is calm all the time, but once just lost it and asked my mother how she'd have felt if he were in his 40's and still totally relying on his parents for food, money, etc. I would simply tell him that you're proud of the hands on father he is trying to be, but that the first step is for his child to respect him. Does he want the child to see him as an overgrown teen? (I have huge issues w/ so many of today's adult men who still view themselves as 16 y.o. boys!) Of course he should be able to see his baby whenever possible, but you and his father don't need to go through that stage again. Say you'd love to extend to them a standing invitation for Sunday dinner - tell him to come over early, let you both play w/ the baby, eat, then he can GO HOME! It's time. He's made adult decisions so it's time to be an adult. And, I'm w/ you - the technicality of being in school is a joke. An Application to rent is a pre-qualifying measure, a screening tool. That's the phase where references and credit are typically checked and verified, etc. Some places charge an Application fee, others don't.

A Lease is an entirely different document. That's the legally binding contract that spells out the terms and conditions for renting a specific location for a specific period of time in exchange for a specified amount of money.

If the apartment complex charged an Application fee and you agreed to pay that fee then you could be held responsible for it. (Honestly, tho, sending an App Fee to collections seems like a lot of trouble to go through, because collection agencies charge for their services. But some places are sticklers about things like that.) If it's a nominal amount (e.g. $50) it would cost more to get a lawyer to fight it than to just pay it. If that's the case, talk to the collection agency a.s.a.p. Just because something has gone to a collection agency does not mean it's hit your credit report (yet). If you make arrangements to pay, and take care of it, then you have an opportunity to keep it off your credit report. If you don't pay, odds are good it will land on your credit report. (You can check and see the status of your credit for free by going to annualcreditreport.com. No gimmicks, it's a site endorsed by the federal government. Federal law allows consumers one free credit report per year from each of the 3 credit bureaus.)

If, however, they are trying to charge you rent, but you never signed an actual Lease, that's definitely worth seeking legal advice.

Were you ever given keys to your apartment? Did they assign you an apartment number? How long did they wait before they rented it to someone else? They can't charge you for the months they re-let it and others moved in.
