Landlord is refusing to accept rent, what do I do now?

Hi to all out there, here is the situation, I moved into the place about 4 months ago shortly after moving in they sold the place and transferred my contract to new landlord. I used to send my rent payments with tracking and confirmation, now the new landlord will not accept them and refuses the payment. Payments are sent out and are not late, but will be unless she accepts trackable mail which she does not want to do. She only wants payments sent regular mail, and said that if not received on time late fees will accrue no matter what - whether it is the USPS fault or whatever, also will not accept emails and hangs up on phone calls. Any ideas on what to do, I am trying to protect myself by being able to track my payments and knowing for certain they are on time. Any ideas or help greatly appreciated.

Is your landlord located somewhere that you could make your rent payment in person? If so, I would do that and ask for a receipt when you make your payment. Otherwise, try to impress on your landlord that you send your rent certified so that you have a receipt of sorts showing you paid your rent. Ask if there is a specific reason that she will only accept regular mail and not tracked mail. Maybe she's not able to be around to sign for the envelope and it's become a hassle for her. Who knows....What about the possibility of a direct payment using banking online? No more sending mail for you, no more having to run it to the bank for her. And you'd have a record of it through your bank statement.

Just some thoughts.

Here is some more information on what is happening.

This landlord lives in another state, and also refuses to have direct deposit done to bank account, they run there business out of there home which is on a rural route when I asked the post office-(small town). I have tried sending where it has tracking but nothing to sign and she still will not accept. This is a wacko I am dealing with to put it mildly. I get the feeling they want me to break the lease so that they can keep the deposits and make so I have to pay an extra months rent. Like the place but the new landlord is wacked.

I compost everything, including yard waste and kitchen scraps and still somehow never have enough compost to go around and at least 1 of my compost piles always seems to have room. Some things are reduced in size by the lawn mower running over it as denninmi described and then composted. Most of the autumn leaves never make it to the compost pile; they get run over multiple times and then raked back into the lawn or used to mulch flower beds. I can process all my stuff that needs composting from all my gardens as well as periodic additions of manure in a space that's a little under 3 1/2' x 12' and can be up to 4' high (except for really large branches which go into the woods) and I actively garden what's probably more than an acre of beds, mixed borders along with a large veggie garden. Can you widen your compost area behind the garage? My mum lives in a suburb where you can put sticks and other yard refuse out for recycling, either bundled in less than 4' lengths or in brown yard refuse bags. (I do most of her gardening.) In my small rural town, there is an area of the town transfer station where yard refuse is collected and composted for those who don't compost.

Do they only process rent checks on weekdays? Does it state that somewhere in your lease? That's the only thing I can come up with. If you paid after hours on the 30th (a Friday) and it was not retrieved until office opens next business day, that would make it Monday the 2nd that it was stamped as received. I would take to them about it, but don't toss the bathroom issue in their face (keep it separate). Would avoid the "I dated my check the 30th" reasoning with them as well. I promise they see that all the time, checks dated on or before the 1st but not delivered by tenant until several days into the month. (Not saying you did this, but guarantee others do it on a regular basis.) Anyway, if you're a good tenant, pay on time, just approach them calmly and say that you put your check in the box on the 30th, two days before it was due (since there were 31 days in Jan.) A different take: what if your check had been dated the first (which is perfectly logical). You delivered it during business hours on Friday the 30th. They still would not have been able to deposit it until the 1st at the soonest, because of how it was dated. Since the 1st fell on a Sunday they wouldn't have been able to deposit it until next banking day anyway, which would have been Monday the 2nd. Looking at it from that scenario, you would technically be penalized for not paying rent early, and I don't see how they can uphold something like that. Bottom line (and just my .02), if they're being that nitpicky with a weekend involved and receiving it on the 2nd, perhaps you should pay in person in the future and ask for a receipt. As far as the bathroom goes, I don't understand why you're so angry? (I do understand when tenants get angry over repairs not done, but I don't understand when they get upset when repairs are being done.) Did mgmt actually leave the mess, or the contractor they hired? If it was a contractor, by all means let mgmt know that there are slivers of metal being left in the bathroom. (I have a few favorite contractors I use, but nearly all hire young kids as clean-up crews, and they don't always do a good job.) Lastly, please show a little patience. If your ceiling caved in because of a plumbing leak they had to clear away all the debris both upstairs and in your unit to access the plumbing to find the leak. Then repair/replace the pipes. Then perhaps replace flooring upstairs. Replace your ceiling with drywall. Then tape/mud the drywall, let let that dry. Then prime, let that dry. Then paint a couple coats (and if done properly 4 hours dry time in between). It just doesn't happen in a day. Five days is not that bad considering all the work. I know it's a big inconvenience, but leaks and malfunctions do occur in structures. No one wants it to happen (it's as big a headache for mgmt as it is for you and your upstairs neighbor), and at least it's being repaired.

If you live in Iowa, here is your state's landlord/tenant code. Actually, they spell things out rather nicely. Not a lot of rambling legalese. 562A.10 of your code addresses no written lease. Basically if you took possession, he took your $, 'without reservation' on either party's part it gives your verbal agreement the same weight as if it had been written. I read through your post twice. Quite a bit jumped out at me. If you pursue it, it might be wise to anticipate some things coming up. Not taking sides, just pointing out observations based on what you said. You're putting heavy emphasis on how the money was handled and saying he doesn't have it based on what a neighbor said. Neighbor is a source of information to you but in the end it's just a neighbor talking and not worth anything more than that. Where the money at is the last duck in the row. First it has to be established you're entitled to any/all of SD back. About the damage. Crumbling ceilings and holes in walls are hard to miss on an initial viewing. You can argue you lived in a dump that was never repaired, but you rented the place in that condition. And you've got to be realistic. Even in the nicest of places walls get dings, that's a nothing issue. Holes would be different. Big difference between hairline crack in ceiling (settling will do that in an old house) to plaster chunks falling down. If it was really bad, unless it was the last place possible for you to rent to get a roof over your head, why did you opt to take it? And if a LL promises to fix something major, it should always be gotten in writing before moving in. I'm not condoning a LL let his place fall apart and be a hazard, nor is it legal. But tenants have options. So taking a unit in that condition, being long-suffering, then trying to use that as leverage later to get SD back doesn't make sense. The faucet deal was not handled well by him, but it was fixed so isn't relevant now. The harassing entry situation. Don't see it. That leak certainly constitutes an emergency entry - no notice required by law. (That type of leak is major tho, not minor.) You said you were in the shower and your daughter was sleeping when you heard loud banging and he rushed in. Is there a chance neither of you heard him knocking at a normal level before that? At that point all he knew was water was going where it shouldn't, needed to be stopped at the source, and he has no idea if anyone is home, not home, ignoring him, didn't hear him, sound asleep. He is allowed to protect the integrity of the structure, hopefully swiftly. (Had you attempted to delay his entry purposely that could really backfire.) As far as ranting, maybe he could have been more diplomatic, but LLs are human, too. You've just purchased a house yourself. What frame of mind would you be in to discover a leak like that a week after your purchase? The landlord is never home either he is an over the road trucker so he is rarely around. This winter, the property was not adequately maintained. The sidewalks were dangerously icy and snow covered. Never once were we told that we needed to take care of any of the snow shoveling. Uh, might be wise to leave that one alone. Did you ask if your rent payment included snow removal service? If only other building occupant is away all the time for work, & your rent didn't specifically include the cost of providing a service like that, it can be reasonable concluded without being told that if it snows, you might have to grab a shovel and toss down some de-icer and clear a path for yourselves and car. I also found some vague things about since we never received keys to the actual dwelling, he technically never surrendered the dwelling to us. But he did surrender possession of the premises to you. You lived there. And as far as a key goes, you're absolutely entitled to one from the start. Why would you live there the entire time without the ability to lock your door? You had the option of requesting (preferably in writing) and if he still failed to comply immediately, call a locksmith, have a new lock installed, keep your keys, give LL a copy key and the bill. It's at a date now where you don't have legal possession or access to the place anymore. You say the place is spotless. But yet you've not cleaned the carpet yet - it's still on your to-do list (tho your tenancy is done). But then you say you shouldn't have to pay for cleaning of the place on move out when you weren't shown the same courtesy when you moved in. I'm confused - spotless or it needs to be cleaned? I didn't read through the laws on it, but if your state law says you need to give 30 days notice, it means 30 days. Your letter only gives 28. If it only requires "a month" you're OK. Also, if he's got 30 days to respond from date of your notice, that gives him till 3/2 because Feb only had 28 days. So maybe it's en route to you now via postal service. Guess next couple days will tell.

If this is the first time your landlord has been a landlord, she may not know or completely understand the laws and rules and regulations of being a landlord. You may have to do a bit of educating. First, check your state laws (google "yourstate tenant landlord law"). Find out if landlords need to give notice before they enter a rental unit for inspection or repairs. Most states require at least 24 hours of notice. Most states also allow the landlord to enter without notice if there is an emergency, like broken pipes or a fire or something similar. Second, talk to the landlord. Tell her nicely that you need (not want, *need*) 24 hours notice before she comes over, even if it is to work outside. This is your home, you need to be able to plan family celebrations and lazy days off and the like. Tell her that the Easter Sunday work party on the lawn was inconvenient, because you were having family over. If she had called and asked first, you could have told her not to come that particular day. Second, explain that there are residents who are allergic to dogs, so her dog can't come inside the house, as it will cause allergic reactions. And she is free to leave the dog in your backyard, if she is willing to pick up its messes. Since you don't own a dog, you don't feel you should have to deal with that. Don't do the "ask her nicely" bit about not bringing the dog inside. Tell her flat out that bringing the dog inside could make people sick and she can't do it. If you think you would have a hard time telling her not to come over without notice and not to bring the dog inside, perhaps your DH should be the one to contact the landlord. It sounds to me as if she's a pretty good landlord, but a new one. Someone who hasn't quite figured out that while she owns the house, it is someone else's home, and that she needs to respect that she can't just come over and do things whenever the heck she wants to.

Maybe tell them about sites like clearnow.com, I'd ever offer to pay the $12/month fee that they charge.

Doesn't seem to make sense, I know for me it's a HUGE problem to receive mail that is tracked becuase the one day I get something the FedEx guy is on vacation and then it goes back to the main center, and if I'm out of town for 2 days and didn't know I got mail then it can get sent back to the sender....Ahhh the joys of city living. Anyway - seems like she would be home so that's quite odd.

I had an absolutely INSANE landlord once. Like my stove broke and she said, well there is an A/C in the kitchen maybe that's why you can't boil water. So figure out some way to send the checks really early and post date them would be anohter option. Just make it clear that you don't want to ever be considered late.

THAT is wacko. How can she not accept them? They arrive in her mailbox, but she won't open them?

The only other thing I would suggest is Pebbles' last idea: send them early but post-date them (then of course she'll complain about the post-dating, and the concept that she has to wait to deposit them).

Just send a check regular mail like everyone else. When a check gets cashed you have your proof of payment.

I think what your landlord is having to deal with is wacko. You call, and email and have no reason to not trust them but you only send your rent a certain way.

Your way won't work if the landlord has a day job, or your delivery comes when they ran to the corner for a gallon of milk. Or are not home for some reason.

This person works out of there home also and has told the post office that she will not accept any tracking or confirmation mail, and yes I do send my payments out ahead of time, as for the trust issue with them I do have grounds for that - I have caught them not telling the truth and the state of oregon and washington are opening an investigation into there practices with the letters I have received from them. I have offered to make direct deposit to there account and they do not want to do that either.

How does the LEASE state you should send the rent?

If you get the "delivery attempted" and get the envelope back ... just keep it, unopened. Send them ONE letter regular mail and tell them that you will be sending all rents by a method that allows you to know it has been received.

PS: If the recipient is not home, those confirmations are a PITA because you have to go to the post office to get them.

There is nothing to stop your landlord from holding onto your mail, and intentionally waiting to depost the check late, to 'prove' you were late making payment. You will not be able to prove you were timely, if she wants to be dishonest.

Although you are in the right, I learned the hard way it is very bad to have an out of state landlord. When I consulted an attorney he told me I would have to sue in the state of her residence. I have noticed a lot of modern apartment complexes have out of state offices. Deep down I wonder if they just rent a room with a phone over the state line to get the legal advantage.

Your landlord can give you a lot of trouble if she gets the urge. That makes you dependent on her whims. I would consider if it is worth it. It is very hard to wage war with a nutcase

Your landlord sounds...off. Refusing to sign for a letter is silly.

Having a receipt that she signed for a registered letter does not prove that she received your check, though. It proves that she received something from you but it could have been anything that would fit in an envelope or even an empty envelope.

Just a quick note on the post dated checks....I seem to recall something about post dating personal checks being not acceptable. I don't think a bank is required to honor a post dated personal check but it's something I would check with your bank about. I know businesses do it with pay checks and such but when I worked as a teller I seem to recall that it didn't apply to personal accounts. So in that case, you could be sending your rent like a month ahead of time and your landlord could cash them whenever they wanted. If that's true, you would be better off sending a money order which proves the date of purchase and seeing if there is some sort of option at the post office to simply get a receipt that you MAILED the check on a certain day. If there wasn't anything to sign for but you had a way to prove that you mailed it....seems like that would be about the only option at this point if they aren't willing to work out a direct deposit sort of thing.

I used to give the manager post dated cheques. He would give me receipts for them, provng I had given to them. But he was a trust worthy guy, your sounds a bit odd

Sounds like the landlord wants to get rid of you. Hate it when that happens. If she refuses the checks, be sure to keep the documentation and place the money in a special bank account (refer to the laws of your state). Inform her you are doing this. When (if) she takes you to court, you will have proof that you have attempted payment then placed it in a separate account.

The OP lives in Washington state, which has fewer protections for tenants than most other states. If a tenant is late with the rent by one day, the tenant can be evicted. This would explain why he is so concerned about getting proof that the rent check has been received.

There are at least two ways you can track a piece of mail that do not require the recipient to sign for the mail. The letter or whatever just lands in the mailbox. These both give the sender proof that the mail has been delivered. Your landlord is refusing to accept this type of mail? This just seems weird. It would actually be more trouble to refuse this mail--in addition to the fact that they won't get their rent money.

You should check your lease carefully to see what the lease says about late payments and broken leases and evictions. And start planning on moving the moment your lease is up.

I've recently had a very difficult experience with the United States Postal Service. When it came time to renegotiate a lease with them (after 14 yrs), I found them impossible to deal with. They do not negotiate. They dictate. My experience with them as tenants has been very unpleasant. When the lease came up for renegotiating, they passed the buck, they lied outright, they were high handed bullies and cowards in my opinion. They did all this while claiming they were mandated by Congress. When I contacted the only Congressman I knew (Howard Coble), his response was a letter to USPS asking them to investigate the local USPS. He did not question or challenge their abuse of "congressional mandate." Is there anyone who speaks for the rights of landlords who rent to USPS?

Is there anyone who speaks for the rights of landlords who rent to USPS? Since this forum is geared more toward tenants, I'd suggest a site geared toward landlords with a discussion forum, preferably dealing with commercial real estate. There has to be some out there than can offer suggestions.
