Pet deposit

My lease states that there is a nonrefundable pet fee of $200 per cat. It goes on to state that the resident "shall pay the nonrefundable pet fee and any additional security deposits."

However, nowhere in the document does it give a monetary amount for that "additional security deposit" or for monthly pet rent.

I went to the leasing office prepared to pay $200 but was told I have to pay $400, of which $200 is nonrefundable. I must also pay $10 a month for cat rent.

I feel that I should only pay the $200 nonrefundable pet fee because that is the amount the lease stated. Thoughts?

I would check if these extra, non-refundable charges are even legal in your state/city. Is there a tenant-help organization in your area you could call to find out? Although if you refuse to pay, the landlord can just refuse to rent to you :(

That actually sounds reasonable. I have lived in many apartments in the past and typically you pay a normal security deposit which averaged $100 - $150 in my area when I was renting. On top of that you pay a pet deposit which I have seen to be $300 -$400 of which about 1/2 is non-refundable. I have also seen the "pet rent" addition. I'm going to assume you haven't moved in yet. They only problem I see with your situation is that they apparently didn't list out all the charges you were responsible for but usually these are all disclosed in any advertisements or listings so they may have felt you were already aware. Everytime I rented though they would give me the floor plans with rent and deposits written in. Bottom line is your going to have to pay it no matter where you rent. I would talk to the apartment manager and see if he or she is willing to work out a payment arrangement for the pet deposit. If they want to rent to the apartment to you bad enough chances are they have the leighway to work with you.

Archie3, whose name is on the lease? Yours, his, or both of you? If it is just yours the answer is easy. Most likely both of you are on the lease and if you report the situation, the LL will take the path of lease resistance, and make you both leave. They will not get into a roommate dispute. That is unless you have lived there a loooong time and established an excellent raport with the LL and they are willing to renegotiate the lease for you in order to keep you and get the RM out. You would then need to come up with a suitable replacement, unless you can pay the entire amount yourself, and since you say you are moving in May that is going to be tough to pull off. Can you stick it out until your planned move out date in May? Do you have a back-up plan in case the LL throws you both out? You are in the right and your RM is wrong. Can you get a group of friends over to causally sit down and bring this up for discussion with him. If might be better to have a group of "mediators" around when discussing the situtation rather than you two going back and forth on the matter, getting nowhere. Peer pressure might work. You sound young and mention your parents having your dog. Are you able to discuss things with your parents? I do realize that not every one has parents who are "there for them" to help but is sounds like you have a good line of commincation going with your parents. They may give you some good advice. Do they know your roommate? Would your RM listen to them? Do you or your parents know your RM's parents and they could be let aware of the situation and intervene on your behalf? His parents may not want him owning a pitbull. Another way to attack the problem, is to look into the legality of owning a pit bull. You say your RM is finding dogs online, and thus he may be buying a dog that is illegal to be sold or owned in your community. Twelve states prohibit breed specific restrictions and bans and many many local comminities ban pit bulls and other breeds of dogs. They are banned in my community. Check it out. For instance, while most dog laws are local, Ohio has a 1987 state law requiring owners to confine purebred pit bulls as "vicious dogs" and buy at least $100,000 in liability insurance. You may be able to just call the Humane Society and have the dog picked up. Think ahead though. Just say you "found" the dog (in your apartment. LOL). Your RM may get a fine and retaliate against you if you mention the internet sale. If the breed turns out to be illegal in you comminity, point out to the RM that it is illegal to have the dog and the law is on your side. That should get him to chill out about it. He won't want to get himself in trouble.

How housebroken is the dog? Does she regularly have accidents? A dog who pees in the house more than once or twice a year is not a good fit with an apartment with wall to wall carpeting. If you think you will really need the rug shampoo unit, maybe you need to find a different apartment. About the dog noise--currently I live above a dog and below another dog. Their running around really doesn't bother me. They are dogs; they run around. The occasional bark doesn't bother me. Their owners, who slam doors and drop heavy objects on the floor, they bother me a lot, because they are humans and can control these actions, but they chose not to. I wouldn't pre-warn people, because that sounds like you are going to warn them that your dog makes noise, but you aren't going to do anything about it. Instead, as you meet your neighbors, tell them that you have a dog and to please let you know if the dog is ever too loud. I suspect that your building will have a fair number of dogs and people who have dogs should be more willing to accept the occasional noise of another dog. I know nothing about video games, but can you use headphones when you play them? If not, you should be prepared to keep the sound very, very low after 10 or 11 at night. Listen carefully to how much you can hear from the other units. If you can hear every sneeze and whisper, you will know that your neighbors can hear your video games. When you play them at hours that other may be sleeping, you will need to find a way to play them as quietly as possible. Tell your neighbors, "Hey, I play a lot of video games. Please let me know if the noise is ever a problem." And be prepared with a solution if they mention the noise. For your early morning/late evening comings and goings, I wouldn't say anything. Just be as quiet as you can--close doors softly, speak softly to your dog, have her on a leash, try to figure out how to keep her from barking as you leave the building. You have every right to enter and leave the building when you choose. Telling the neighbors about this might give them the idea that they have some say over your time schedule--and really, they can't. So just be as considerate as possible. If someone does complain, ask them what can be done to solve it. It might mean taking a different route to the front door of the building, for example, so that you don't pass their apartment. But someone walking down the common hallway at an odd hour is just a fact of apartment life.

The post was confusing. I gather there were three of you who each paid one third of the SD. Two of you owned pets and both of you each paid out an extra pet deposit. Now, the owner is sending a bill for the damages not covered by the pet deposit and the security deposit. So the owner has kept the pet deposit that two of you paid, since you had pets, and kept the security deposit that you each paid one third of. The owner is now trying to collect more money to cover perceived damages. Where I live a landlord must give an itemized list/receipt of all the damage and the cost of each. Did you receive such a thing? Is all the damage due to pets. Or is it also things done by the humans, like cigarette burns? Is the pet damage just one big thing like having to get new carpeting, or is it a bunch of little things like windowsills chewed, screens clawed, hair not cleaned up, urine odor? No matter what, this is not going to end well, and I think everyone involved, meaning the landlord and each roommate, is going to feel they did not get a fair shake at the outcome. If you can get a list of damages Maybe, just maybe, each roommate will chip in for what they are responsible for. Did "Bill" break the window??? Did "Bob" set fire in the oven?? Was it "Mike's" cat that peed all over? Was it "Bill's" girlfriend who smoked the cigarettes? Does no one remember who it was who let the bathtub overflow? Where I live a landlord can collect for damages *in full* from ANY single one of the roommates that signed the lease. In other words, he could come after you for the full amount. It may be different where you are. If you end up with a judgment for the entire amount owed, you then have to go after your roommates in civil court. What you ask in your post is not a legal question, but rather a moral one. I think how it is divvied up would make a difference on what the damage is. If it was all pet damage then the two roommates with the pets should pay the entire amount. If the damage is something like a broken plate glass window because of a rowdy party, then the pet owners should not have to lose the pet deposit to pay for it on top of paying the balance and pay an inequitable amount. If the damage is a combination of pet and human mischief find out the total bill and divide by three.

Don't landlords have rights to make sure that a house stays warm in cold weather?. Yep. And that is precisely what yours did, yes? It's all a moot point anyway, but I did want to illustrate that we don't have magic wands that we wave and everything is fixed instantly. Everyone who loses power/heat/water feels their situation is urgent, but the truth of it is we all have to wait in line and sometimes do without for a bit, even landlords in our own homes. Blizzards, power failures, ice storms, mechanical failure, poor installs. Stuff happens. You need to pay very close attention to the words in your quote above, each one counts in a situation like this. It doesn't say a landlord "must", but rather "should" provide an initial condition of premises report. If that's not done, then they must show by 'clear and convincing evidence' the damage done. That's not a big hurdle. He could easily supply that via the original receipt for the carpeting purchase order, along with the dated estimate which would show the room dimensions and square yardage calculations, and if he's like me, many date/time stamped photos taken before new tenants move in. Yes, I checked Washington state renters' rights and nonrefundable fees are allowed.
ttugrad95, my problem is I've already signed the lease (actually a renewal - I moved in last April) so I feel like I have no leverage on the pet situation.
Thanks for all your input. If I'm lucky they'll at least waive the monthly pet rent.

if they've changed the terms of the lease, you may have leverage. even if it's only to say you want out.

Well, actually it says the $200 fee plus any additional security deposits - which would be that other $200. I think the only argument that you could make would be that the lease doesn't say anything about an additional monthly fee.

Truthfully, those fees are completely in line with what i've paid over the years for my two cats - and i've often had to pay double that since i have 2. I'd be happy the landlord was letting you have both animals and pay up. Many landlords are moving towards banning pets altogether.

I was unable to get my $10/month pet rent waived. But between Saturday and Wednesday the $400 fee+deposit went down to $300 (half refundable, half nonrefundable). So that is some consolation.
Does the idea of pet rent strike anyone as odd? What I'm renting is a space. If I brought in a roommate or adopted a child I wouldn't be required to pay extra. What resources does a cat or dog use that a person would not?

I'm with you on the pet rent, sleepless. They'll say it's because pets may do more damage to the apartment than humans, but I say that's crap. That's why we paid a deposit, so that any damage done, by us, our guests, or our pets, would be covered. We pay it because we have to, and we were lucky that they didn't double our pet rent (which is $30/month) when we got a second cat, but they did charge us another non-refundable fee. It's extortion in my opinion....if you don't inform them that you have a pet and pay the fees, they can evict you, and if you inform them then you have to pay extra that they say is to cover extra damages that would already be covered by your deposit. Total crap!!!

I had to pay 250.00 fee non-refundable. Plus 30.00 a month for a dog in our old apartment. It was though in our lease which should be in yours as well.

We will be moving to an apt. soon due to a job transfer. We'll be there for several months while our house is built. We have to pay a non-refundable pet deposit of $600 (we have four cats) in addition to our regular deposit. We don't have to pay any pet rent each month, though.

WOW! Pet rent? I have never heard of that around here or a pet deposit either. Me thinks that's crazy to have to pay! Especially since my cats are cleaner then my husband is sometimes! Hahahahaha!

We charge a pet deposit and extra monthly fee for pets. Some, certainly not all, pets cause an amazing amount of damage. The regular deposit isn't enough to cover replacing vinyl and carpet, replacing subfloor, repairing sheetrock, repairing kitchen and bathroom cabinets, etc that can be damaged. It is easier to collect a larger deposit up front to cover the potential additional damage. If the landlord doesn't get it upfront, then they are pretty much left taking the former tenant to small claims court where they might get a judgement but may never receive payment. Cat urine and dog urine can be pretty strong and require some major repairs to completely elminiate the smell.

As far as a monthly pet rent, dogs and outdoor cats can be pretty hard on landscaping. The front porch becomes the "fire hydrant" and can get pretty raunchy smelling if several dogs mark it multiple times a day - not exactly a welcoming smell to come home to. If you are in an apartment complex with several animal owners and one doesn't clean up after their animal (dogs and cats), then how does the landlord figure out who to charge for the extra clean up?

I've seen instances where indoor cats have been left alone for days on end. Oh someone may come in to feed them and give them water, but not scoop the litter box. Did you know that many cats won't use a dirty litter box? When that happens, the carpet turns into a litter box.

Once again, the good pet owners end up paying more because the inconsiderate pet owners don't clean up after and take care of their pets.

By the way, I am a dog owner and have been a cat owner as well. You can't say that I am anti-pet. I've had to deal with the damage that can result from a pet that isn't properly taken care of or is bored.

I had to pay a $250 non-refundable and a $250 refundable deposit for my Golden Retreiver. No additional pet rent, though, so that was good.

Pet rent is not uncommon. My lease also states that if you get a roomate they have to fill out a application and pay an additional $25 per person per month.
