Apt Building owner tried to kick us out.

An relative of mine bought an house and moved away, so i moved in, i used to live just across the apt she lived in, bascially right next next, so anyway i did some renovations, painting, flooring ect and so on, my mom met with the owner shopping and told him that i had moved to another apt and that piece of sh*t started screaming and crying out saying 'why the f*ck didn't you tell me before' and other things, so he said alright i'll meet you in court and we'll settle this. So we tried to settle this without all the work, my dad asked a old friend of his that used to be an triad boss or something to help(he also knew the apt owner) to try to settle things and so i can live here, and it worked, the next day he told my dad that i can live here BUT know instead of paying the super cash every month for living here, i must pay him with a CHECK, so here im wondering what is he up to asking me to pay with a check instead of pure cash, is he trying to set up a scheme to kick me out?

Any help would be great, oh few other notes the super tried to help us aswell, and as for the apt building owner, hes just an slave/a p*ssy all he does is do what the wife says that guy is a disgrace to all men, the wife act like a billionaire and an steriotype.

I don't get why you're so angry.

You can't just up and move into a unit and start doing all kinds of renovations to it and then tell the owner 'oh, by the way, I moved in and remodeled...'.

Maybe he wanted more rent for the unit you took over. Maybe he had the place already leased out to someone else and by you moving in he had to cancel the other lease (which could cause him a lot of grief and land him in court). Maybe he had plans to do improvements or repairs while it was vacant. Who knows, there could be all kinds of reasons why he's upset, but the bottom line is you need to remember that this property is owned by someone else and it's their right to do with the vacated unit as they please. You had no right (nor was it legal) to simply swap units unannounced and without agreement.

LLs/owners have leases with occupants. Binding contracts with conditions including assigning a specific tenant to a specific unit. Breaking the conditions of a lease can and often does land parties in court. So you broke your contract (by moving out of your unit without notice) and basically encroached on a different unit by simply taking over without advance agreement. Just because you know someone who moves out of a place doesn't mean it's up for grabs and you can take over. It simply does not work that way.

As far as not taking cash, nothing wrong with that. It's a way to track payments made and have it recorded through a bank. Highly doubtful there is some scheme.

But would recommend you be on your best behavior now. Don't make any further alterations to his property without his express consent. Do pay on time. And lay low. The guy did you a huge favor by letting you stay, legally he could feasibly have evicted you from the premises altogether.

Sorry if this comes across as harsh, but you really crossed a line that you should not have.

My sister's name was on the lease and well remain there as long as i'm living here or until she tells the owner she is moving, and that well not be anytime soon, so there isn't any other person the landlord had in mind to move in, also there are many apts in my building that has no one living it, atleast 2-6, counting the one few months ago when a old lady died due to some kind of desease and had her dog ate her face off because of hunger. The building is run down , theres druggies smoking/doping up at the stair roof, the neighborhood is full of gangs, i highly doubt anyone signed a lease for the apt, and we only changed the floor tiles and panted because if you had seen it you would throw up, the bathroom wall were contaminated and looked like roaches has been sh*tting in it for years.

As for the more money rent thing, they already added more money last month for EVERY apt that has people living there.

Form your description, this sounds like an "in-law" apartment, either a renovation or addition to a house to create an apartment, usually for a relative. The owner sounds as if he has bought the house and is counting on the income from the apartment. Nothing wrong with that, but a first-home owner and landlord could cause some problems. I would check out how he plans to handle even minor repairs, such as what happens if your toilet gets clogged. Is the landlord going to fix it or will he call the appropriate repair person? Will he call at midnight if it's a problem or make you wait until the next day? As for the utilities, it depends on a lot of factors if 1/3 is fair. I'm assuming that you will have your own phone line and internet connections. How many people will be living in the rest of the house? Just the owner? A family? Kids? Will you be sharing their cable TV connection, even if it is more expensive or less comprehensive than you would want? Can you get your own hook-up or dish? How big is the house? If the house is 5 times bigger than the apartment, then I don't think 1/3 is fair for the heat/air conditioning. 1/6 would be more like it. Same with electricty--if there are a lot more people living in the house, the bill should be divided proportionately. If you are very conservative with utilities and the owner and his family are not, you will end up subsidising their utility use. I would not want someone else in control of all the utilities. This is one are where I can save money by using less. So I keep my apartment fairly cool in the winter and wear sweaters. I don't turn on a lot of lights. I would not want to be paying for someone else's use of these things. The other thing to be concerned about with an in-law apartment is the owner's access to the apartment. Some of them have a door from the house directly into the apartment. I would want to have a bolt on my side of that door to prevent the owner from entering without my permission. I would also probably put a big, heavy piece of furniture in front of it. Check the laws of your state carefully. Things such as when, how often and how much notice a landlord must give before entering an apartment vary from state to state. You should know your rights before you sign the lease. You may have to do some educating of your landllord on a few things. My last landlord didn't know that Connectict has laws on how long a landlord can allow an apartment to go without heat. I had to point out to him that we had been heatless for three days, and according to state law, I could call the police and have him arrested. He wasn't happy with me, but the heat was fixed in three hours. A first time landlord may not be aware of all his responsibilites. As for the bedroom floor, you can ask about the carpet/hardwood issue. If there is hardwood under the carpet, the landlord might be willing to remove the carpet. I'm not so sure about installing hardwood, however, as that is much more expensive.

Ok here is the deal folks...I have been on both sides of this debate, as a tenant and as a landlord. I am a former General Contractor, so I have had experience with resident homeowners and renting Landlords. Unfortunately, we can not use a label to define a generalization for 'landlords' or 'tenants' based solely on those labels; just as we can not do that with a person's race. There are ethical landlords and tenants, and there are pieces of &%$@s from both. My current landlord is a scum bag. He thinks it is the responsibility of every tenant to maintain the "rentability" of his investment, charging former leasees an outlandish $25/hour to caulk nail holes, while paying the worker $9/hour cash. I know because I used to help him and am good friends with the manager. There is such a thing as "normal wear and tear". OK, here are the rules: A landlord may not charge a tenant for normal wear and tear. Small nail holes used to hang pictures? Normal. Ordinary paint discoloration? Normal. Minor scuffs on floors and carpets? Normal. However, that does not mean you can leave the apartment in complete disgust, when you move out. AND it doesn't mean you are obligated to have the apartment professionally cleaned, unless noted in the lease agreement. (If such a clause does exist, go online to see if it is even legal in your state to require that. If it is even legal, there are probably tenant provisions, with regard to obligations.) A "clean" house is subjective to the person looking at it. Some people are freaks about cleanliness. Others are fine if the main elements of the house are clean, leaving dust to settle as it may. And yet others think that if there is a path to walk from one room to the other, they are ready for company. So unless otherwise noted in a clause in the lease, bringing a rental property up to the same exact condition, as it was in when a tenant moved in is the responsibility of the LANDLORD, or investing owner, of the unit being used as a business, money making, profit earning property. Otherwise, each tenant that performs the necessary measures to bring a unit up to "move in" status, would then be entitled to a stake or share in any future profits gained by the maintenance of the property, beyond normal wear and tear. And remember that No Clause or section of a lease agreement or any other contract can be written in a way that is breaks any local, state, or federal laws. So if you think something doesn't smell right, spend an hour researching it on Google, taking the time to check the sources. Is it a forum like this that may have facts mentioned but is not a reliable source for legal facts? Or is it your state's .gov site that gives the actual statutes written into law...maybe even the local housing authority...or a lawyer that has offered free online material in eFormat to gain potential clients? There are certain risks involved in lending, renting, granting temporary usage or access to one's own possessions or properties. If what a landlord is charging for rent is not enough to maintain the unit, that does not entitle him/her to use any portion of the Security Deposit to maintain a 'perfect' status of rentability for future tenants. The landlord should rent the unit for more, to cover those costs of what every business has, as part of its functionality: OVERHEAD! We all know the difference between blatant damage, intentional or not, and normal living. And we all know that some tenants are just scum bags and should probably be confined to disposable housing of some sort, if such a thing existed. But no matter how many times a landlord has been burnt by one of those tenants, he/she still can't take it out on the next tenant by insisting on unreasonable maintenance on a property that they do NOT own. Side Note: As landlords, did you know that you are REQUIRED to add your state's interest percentage to the deposit total times the number of years/months the tenant has rented the unit(s)? In Minnesota it is now 1%. That may not sound like much, but if you add up all that for say 100 units, at an average security of $750 X .01 = $7.50/year times every unit. That may not seem like much, but it does add up over time, and that interest money does not belong to the landlord, it belongs to the tenants. Also, in that time, the landlord should have been earning around 5% on that same money, sitting in a bank account. ~~@ robine66~~ So to answer your question...is it unreasonable for your landlord to request the condition be as close to the condition as it was when you moved in? Not really. Are you legally obligated to leave the unit property in the exact same condition that you received it in? No...to the extent discussed above. Now comes the real question...SHOULD YOU leave it in the best condition possible for her? That is an ethical question that only you can answer. Was she a good landlady? Did she treat you with respect and take care of any issues diligently, upon your request? Does she have limited resources to do this herself? Most important of all...Are you going to be able to have a clean conscience, knowing you did what was right? Remember...Doing what you are legally obligated to do is not always doing what is RIGHT. Doing what is RIGHT always trumps doing what you have the right to do.

In many (most?) cases, one depends on the GC: To know the building code and ensure the build is correct and in accordance at all stages; To look at the plans and determine how realistic they are (sorry, but not all architects have as good knowledge about building as they may have about designing); and imo, it's reasonable for the GC to warn you about the extra expense of unusual designs *before* the build begins. To be sure all building permits are applied for and received on time; To be sure there is sufficient and appropriate insurance (which can vary quite a bit as to who provides what coverage); To know which subs do the best job, are reliable, and are available; To schedule the subs so there is little if any downtime; To schedule the deliveries so there is little if any downtime; And to make all the many choices that the new owner doesn't, from the color of the bath tiles to the type of HVAC (and I bet lots of GCs think they aren't paid enough for that portion of their job). ~~ There are as many types of GCs as there are types of buyers; never hesitate to keep searching for the one that is best for you ~~ even if his job title differs. Do, do, do check references carefully and in person -- never trust that JoeBanker [or anyone else] has your best interests at heart, because when you get down to it, it's your wallet on the line, not theirs. Also, be careful to have the most detailed contract possible; remember that *anything* which is not written down and signed in agreement by all parties is not covered in the contract (translation: you pay). A really good contract is as protective of the builder as it is of the buyer; but builders mostly seem come in two categories -- those who are willing to sign only their own version of the contract (which is often only to their own advantage) and those who are appalled that the buyer wants a detailed contract [and I actually don't understand them but they do exist]. Make as many decisions as possible well in advance of the contract. This helps you, the banker, and the GC -- the *fewer* details determined prior to the contract, the *more* likely your expenses will noticeably exceed expectations. Don't expect to save money by being your own GC. Your time has a value, and it's likely to take you much much longer to do every phase of the job than it would take someone with experience. OTOH, the more hands-on effort you put into the build, the more the house will be yours and not the GC's.

I'm glad you were able to do it and I do hope it lasts. I don't see, anywhere, how the absolute front of the cabinet structure is supported from weight focused at the front (most likely location), especially if that weight were to be left and right or twist-like challenging the joints (kid dancing or otherwise moving left and right) or up and down (kid jumping up and down). I see no triangles. But if that setup truly works long-term in real life, then you're a better man that me for conjuring it up. You may be able to stand on it when freshly installed, but can you after a couple years? I become concerned then and that's why, with this type of box construction anyway, I wouldn't put my name on that, ever... I mean no offense. Cheap particle board degrades over time with humidity, movement, weight. If we're talking furniture-grade MDF or plywood... okay, I'm more comfortable.

The point is the property belongs to the owners, and if you want to make changes, you have to check it out first with them. It's THEIR place, you are just renting, and have no right to make those kind of changes with no permission.

What are the laws like where you live? What does the lease say?

Mine restricts anyone over 18 from living in a unit unless they're on the lease. If your sister lived here, allowing you (or anyone else) to move in would be a clear violation of the lease agreement. I'd be glad the landlord was letting me stay. What's the aversion to paying with checks? I'd rather pay with a check or money order if I couldn't set up an electronic payment. Paper trails are a good thing when dealing with landlords.

He is trying to establish a paper trail. What happened to the apartment that you were renting? You had a lease on it I assume. Now it is empty. The LL now has one empty apartment that is not generating any income, due to the fact that your sister moved out while she was on a lease.

I cannot read the LL's mind, or predict what his next move will be, but you should have a back up plan in place. I don't believe your sister will get her SD back since she broke her lease by moving out. (I am assuming there is a 'no sublet' clause in the lease like most.)

You should sit down with the LL and get your new place in writing. Get something in writing that cancels the lease you had on your former unit in order to protect you, and sign a new lease for the unit you are currently occupying. This protects you and give you the right to occupy the new unit. You want to cancel your old lease. Think about it...... what if another tenant decided to move into your old apartment and instead of improving it they trashed it? You name is still on the lease.

So yes, he might be trying to set something up to kick you out. If you talk to him like the way you write in your post I would find it understandable.

I have been the super of a six family building for more than ten years. when i first took the job i was giving an apartment with less rent. when the owner sold his part to the new owner that owner made an agreement for me to move in the basement so that he could make more money and i would get an income of one hundred and fifty monthly with no rent to pay. During these years the owners had played back in forth with the banks and new friends owners. I continue to work doing my duty as a super chasing people out of hallways, painting, keeping the curb clean. so that the building do not get any tickets and much more. I did not get paid for a few months while they went on moving names off the deed of the building avoiding whatever they were avoiding. Now its a new owner with the old owner under new inc. and they just came and told me to move. I do not think that is right, i do not even have papers stating that i was working with them and any place that i have put an application in is looking like you need something some proof. what do i do wait to the marshalls or court or what? remind you every tenant that was in the building was paid five thousand each to get out so that they do not have to have the same rent regulations as the building were in before and that was not a court issue. Here i have been a body guard to the building spending and cleaning and they did not offer me a cent or a place to go. Loyalty was never in them. Its about that green.oh I am in NYC.
