My Beautiful Redbud might be dead due to drowning

I have a four year old Redbud tree that was absolutely gorgeous before our (Was it 20 or 21 days of rain here in OKC?. Each year the ground has settled and sank around the Redbud, since it was planted. So regrettably during our rainy period it looked like a small goldfish pond around the trunk. It stands about 12 feet high and currently the leaves are yellow, orange, with a minascule amount of green running along the veins of some of the leaves. Most of them are curling. My husband thinks it's dead and wants to replace it. My heart still has hope for it. I know it's just a tree but I've given it TLC and in return it has blessed me with it's beauty. Is there anything I can do? How can I tell if it's dead?
