S 510, the Food Safety Modernization Act of 2010

Hi all, I've been reading and gleaning from the forum, as well as planting like crazy, just haven't posted yet this year.

My son found this item on LiveLeak on the web, (page 11) and I wondered if any of you had heard about it.

S 510, the Food Safety Modernization Act of 2010, the most dangerous bill in the history of the US.

Son said what it boils down to is that it would be illegal for us to grow our own food, in our own gardens on our own land......among other spurious things being thrust on us against our Constitutional rights, (if there are any of those still left). Apparently Monsanto is at work again, and pushing this.

Anyway's your thoughts would be appreciated. I need to calm down and have a cup of homegrown Chamomile tea and an aspirin.

Barbara, Where have you been? I was thinking about you just last week and wondering if you had left the state.

There is a discussion on that topic over on the "Market" forum, which you might want to read. I think the current bill has been modified from the original.

Thanks for the memories Carol...I was thinking about you as well and that story about the food lines where you were stationed overseas. And whoever controls the seed, controls the food, and whoever controls the food, controls us, or so they hope. We DON'T want that to happen here!

No, I have't left the state but have been having some health issues.

In spite of that, the large scale lasagna garden I started and struggled with last year trying to raise the soil level has paid off big time. Looks like this is going to be the best gardening year ever the way things are going. I contibute that mostly to you guys here on the forum and the difference it made in my gardening skills. And so yea, now that my garden is producing they're going to have to lock me up to stop me from growing in my own garden, on my own land. I hope you all feel the same way about your own gardens. To the barricades!

Actually I was thinking about the peanut incident & the ceo/owner whomever he was knowingly continued production although salmonella testing came back positive. My point no matter how many rules & regulations are on the books there are people who will continue to disregard them. You can't stop that, instead the over regulation gets applied to the poor companies who are struggling to comply. FDA also issues operating licenses which they can always revoke. What about Morningland Dairy that had 6 months of cheese confiscated - sample pulled from out of state, no lot number supplied, stocked cheese not tested, and yet ordered to be destroyed? That type of power without due process, procedures, and solid evidence against the accused is exactly what I'm talking about. And they are not the only dairy on "the list". Seems to me they have plenty of power to accomplish enforcement, without letting them be judge and jury. Can you imagine if police officers who have a bad day were given the authority to be judge & jury? They do have the power despite your claim, and they have applied that power to those both willing and unwilling to cooperate. The FDA is a good thing, however too much of a good thing is always BAD. Media spreads fear & that's what these people thrive on. You didn't respond to the other issues posted above, not that I'm going to spend any more time on this, but just wanted to point that out. The reason for the Food Safety and Modernization Act was to try and help the Food and Drug Administration and the United States Department of Agriculture food inspection recover form the devistation the Reagan adminstration wrought on them and get more food indpectors in the field to try and prevent contaminated foods from reaching the market place. It will not keep you from purchasing heritage or open pollinated seeds or growing foods organically. There are several, conflicting, articles about what S245 is so it is difficult to say what it is.

I read the bill and did some research on the current law. IMO, all this bill would do, if passed, is take a lot of things that are already contained in current law but are being enforced by a hodgepodge of agencies and instead give a new agency responsibility for enforcing the laws aimed at protecting consumers. The current legislative authority for the USDA and the FDA already contains most, if not all of this language - YOUR GOVERNMENT ALREADY HAS THIS POWER. The concern, and the backstory behind legislation like this, is those agencies aren't doing enough to protect us because they are beholden to their "industry partners" - big businesses that guarantee that the regulations are easy for them to deal with while being difficult for small farmers to deal with, so they can push their small farmer competitors out of business. As I read it, all this bill does is take the current laws regarding food safety and put them in the hands of an agency whose mandate is to protect consumers - someone we can go to if salmonella creeps into the egg supply to ask "what on earth happened?" Does this law have the potential to shut down small organic farmser? Sure. So does the current law of the land. Ask any organic farmer. The red-tape requirements are insane at this point. And if your neighbor the chicken farmer is making a living without bothering with that, that's great for him, but he's violating the current law just as much as he would violate this law, if passed. This really isn't bigger government than we already have. It's just government that isn't controlled by multinationals. Will it be corrupted by multinational corporate lobbyists? Probably. But I repeat: your government already has this authority. The only substantive change is it puts that authority into the hands of an agency with a mandate to protect consumers. That is not the mandate of the USDA or the FDA at this point. And Ricky, all the best thoughts heading your way.

catmom and hellonasty, thanks so much for your kind words! As a matter of fact, so far I do love it. I've been working w/an interior designer this time around, because we need all new furniture and I HATE shopping for furniture. And since all color choices work together, they've chimed in on wall colors, cab paint choices, etc. I wouldn't budge on my granite, though. The designer, not familiar w/River White, was pushing for something more "common," like Santa Cecilia or something. I knew River White would be amazing w/the deep brown of my cabinetry ... but then she pushed for a different color in the Marazzi Catwalk style glass mosaic. The Pecan Pump is gorgeous, no doubt, but she just wasn't getting the point that my granite was not going to have ANY yellow/gold in it at all. And that's the direction the Pecan Pump leans. I was already using Sable Slipper for that focal wall in master bath, so I had it in hand and when I held it up to my granite, there was no question - the colors were wonderful, pulling out the best shades in each other. Happily, once she saw the granite IRL she couldn't help but agree. catmom, the candy cane red cabinets happened on a whim: closet that would go unused, my cabinetmaker and I started spitballing ideas about wall-mounted gift-wrap holders, and pretty soon I had perimeter cabs in a decently-sized closet. Well, in that situation you HAVE to go a little outside your comfort zone, right? ... and w/absolute black granite Somehow, this kitchen is coming so much closer to the "ideal" picture I've been carrying in my mind for years, even though the last one was beautiful and very much representative of my taste at that moment. But I'll always believe the one factor that threw off that whole kitchen for me was the backsplash. It was very current, but just not "me" at ALL. This time, the backsplash is all me.

Hi Barbara,

It's good to know you're still here. I was wondering if you'd left us to head for greener pastures.

This Food Safety Modernization Act has grown into an urban legend of massive proportions since last year.

Much of what is out there about this bill is nonsense. There is no provision in the bill that affects home gardens if you're raising food for yourself and your own family's consumption.

Snopes.com debunks a lot of the misinformation. I've linked it below.

On a scale of 1-10 of things I am concerned about, this isn't even a 0, and you know that if I thought there was a chance this bill would adversely affect us, I'd say so.

Dawn, That's good to know. It did seem strange, since half the country seems to be putting in urban gardens since last year, and I for one am excited about folk's renewed interest in gardening. To have those rights stripped away would be the ultimate betrayal of our country. I do not however trust Monsanto, and am always wondering what they're going to pull next.

Anyway, at least for the time being I can calm down now that shock is over.

Even if there were any truth to the outrageous claims about this bill, I still wouldn't be concerned about it. The White House has its own highly-publicized veggie garden....started and promoted by Michele Obama and the White House staff last year. There's no way this bill would pass and be signed into law if it had the provisions in it that are being talked about in the misinformation and propaganda campaign. Pres. Obama surely knows better than to mess with the First Lady's garden!

Good PR has always trumped rules or common sense.

Out of curiosity, what's in the first family's garden? Is it organic? Do they grow any heirlooms? A Three sisters garden would be fitting for the American White House. What color gardening gloves does Mrs.Obama use? :)

Dale, It is organic and I believe they do grow heirlooms. They use low tunnels to keep greens and other cold-hardy crops going through the winter. I suspect much of what we see from the garden is staged for the media, but still think that Michelle Obama is doing the nation a great service by focusing on the idea of planting a 'home garden' with your kids so the family can have healthy, fresh produce. Some elementary school kids from a school near the White House help plant and maintain the garden so they get lots of fun photo ops and stuff.

Last year, they made a big 'to do' of harvesting fresh produce from the White House for some cooking show, but later the truth came out that they didn't really use the White House produce you saw them pick for the cooking segment of the show....instead they used purchased, local produce because they were filming at a NY studio. The scandal of it all! Gardengate!

I'll find and link a story about the White House garden. It seemed heavy on greens to me last year, and I don't know how they kept them producing so deeply into the summer, but am sure there's probably a whole staff of White House gardeners who did most of the actual work!

If you watch the entire Youtube video in the link, near the end there is a cool time-lapse video showing the garden's growth over time.

I understand they expanded the veggie garden in Spring 2010 because they wanted space to grow more.

Not at all to take away from the serious subject - I, too, distrust Monsanto :(
They should've stuck with CARPET and left the agricultural stuff alone!
