Craftsman Lawn Tracter - Starter won't stop!

I have a Craftsman Lawn Tracter 19hp twin Cyl Engine.

My starter kept getting stuck, as in wouldn't disengage, eventually tore up all the teath. I bought a new one and installed it.

The problem actually happened with the old one at the end, but is still happening with the new one.

When i connect the power to the starter, it engages and tries to start the mower!

- Key is off!

- Brake is NOT depressed

- Seat is up! (meaning kill switch is engaged)

It won't start, because the seat is up so no spark. But it turns over... heck, i even had it in gear and it tried to move the mower, without starting, just on the power of the starter!

If I setup everything to start it (put seat down, depress the brake, etc), and touch the power, it will start it!

I can use it by then disconnecting the starter wire, but I want this fixed.

*** Thought about the starter ignition switch, but that shouldn't be it, because when everything worked fine, if the seat was up, or brake wasn't depressed, I could use the ignition all i want, it wouldn't turn it over.

*** it's a new starter, so can't be it (same as old starter).

Is there some other switch or cylinoid I am missing?

Any ideas?
