Contractor Ordered Wrong Sliding Glass Doors That Cannot Be Returned

J. K.

We are currently remodeling our condo, and the contractor is being paid to replace 3 sets of sliding glass doors. The language in our contract reads as follows:

“Replace 3 sliding glass doors, screens, and frames: 1) living room, 2) master bedroom, & 3) second bedroom”

It also states at the end, before all signatures that:

“All finishing materials must be pre-approved by the customers before any installation”

He ordered, without any consultation with us, doors that cannot be installed due to HOA rules. They are also custom 84”s and cannot be returned. They are bright white vinyl (in the desert...which seems like a poor choice with all of the sand corrosion), with a larger exterior lip of 3”s. As the condo sits on a golf course it must remain harmonious with our neighbors (inset within the adobe frame, no lip, dark bronze color, metal). We have paid for most of the remodel, but the final check is due upon completion, and is worth more than the doors (which total roughly $5,000).

He seems to think we should eat the cost, but we simply cannot afford to do this.

I saw other posts that were similar, but our case has some slightly different wording...

Any advice is welcome...
