Comments (7)It sounds frivolous, Yep, very! and rusty I hope the loosers have to pay, thats the way it should be, and if the lawyer looses he gets no pay. That would cut down 95% of lawsuits. But, who make the laws? Lawyers and they make them to make money reguardless of the outcome either by their client after they milked him dry or the taxpayer. I am conveniced that someone can come on your property shoot themselfs and suit you for their actions, or they get drunk pass out run into a tree 100 yards off the road and suit you for it. But yes, I plead before this bar, that I, MarkyMark of California, hereafter known as "markymark-ca", did, does, and do continues to function in this world as a lawyer. While many a client might wished to seen said markymark-ca dis-barred as much to the level to which such an act must rise has never been met, sadly, that prong was never met. As much as this pains me, and my poor mother who slaved over the stove in Kansas--feeding chickens in the morning, baking bread for noontime dinner, and my poor father slaving over the John Deere---plowing that 340 acres for corn and wheat--- this poor soul did finish law school. And, as noted above, even passed the bar on the first try. (And two other siblings) The one who did NOT go to college worked the oil fields. Lo and behold. They found oil on his land....and the folks now live down the road with a view of Carmel to die for. The farm remains under contract farmers. As for the beforementioned civil action, WTF???????????????? $75 clams for a rider and $35 for a pusher? Do you realize the gold mine in my back yard in Pebble? Hell, there is no limit. I ought to hit the repair shops collecting model and engine numbers. Think of this as a challenge. Hell, I have almost a $1000 worth of claims myself in the backyard. And in defense of lawyer, I do know a poor soul who collected almost $5500 from Walmart in a discrimination suit. Said person was alleged to have been discriminated in hiring against black folk and/or African Americans. This poor soul happens to be from South Africa with Dutch decent....and yes, he did apply and collected. (Footnote) Attorney's got $11,000,000 from a total of 18.5 settlement. Comments (54)Mike, it's completely different when you have a FAD which is none other than an 'independent HVAC contractor' that has agreed to sell Carrier branded equipment. The FAD merely represents that this 'independent HVAC contractor' sells enough equipment thru the year to afford this 'description' from Carrier (it's about selling and moving equipment). And the home in which the equipment is sold 'by the noted FAD', is ALSO 'maintained' thru said 'FAD' or 'independent HVAC contractor'. If the FAD didn't install and maintain said equipment --- your recourse is bupkiss. What is required to 'maintain' equipment is more or less left up to the FAD or 'independent HVAC contractor'... there is no difference between these two points --- except for the contract to sell Carrier brand equipment, and because the FAD sells all this equipment typically 100K or more per year. (The FAD isn't in business to fix equipment they DID NOT install / nor maintain.) --- guess again. Where things get messy: the home's Carrier equipment is not maintained by installing contractor. Regardless if they are 'FAD' or not... doesn't matter. $$$ is what moves people to do something. Don't kid yourself. If someone buys a home with said Carrier equipment installed --- which proves my point that 'FAD' means nothing --- why is this home owner having trouble finding this kind of support? Comments (2)I don't imagine you could take that measurement without breaking the seal. The inadequate seals are the bigger concern, though since they mean air leakage from outdoors is possible. In talking with a local window and door distributor who reps. a number of lines, including Andersen and Marvin, he said that Marvin windows are far superior. I've gotten that from lots of experienced builders as well. But he said he found Andersen doors to be superior to Marvin's. So much for one stop shopping!
