qld real estate follow up

when you sign an agreement with a real estate agent in qld you will be required to fill out the following form before they will list your property, and they won't bring buyers until you are listed officially.......................
the form is a "PAMD Form 22a".........................
attached to the form will be a page referring to the "terms and conditions of the agreement as approved by The Real Estate Institute of Queensland"........................
the clause that is of greatest concern to vendors/property owners is clause "2.. Entitlement to Commission"...in particular paragraphs "2.3 (3) & 2.1 (4)"..............
On page 3 of the (PAMD Form 22a) section 6 COMMISSION..... the vendor needs to insert the following suggested text and it should be initialed by both vendor(s) & real estate agent(s), on both the vendor copy and the agent copy.......
the suggested text is - 'however the terms & conditions are amended by deleting paragraph 2.1(3 & paragraph 2.1(4))'. it is suggested you should not cross these conditions from the terms and conditions page (usually page 8 0f 9).
needless to say it is wisest not to sign any form with an agent until you have discussed such issues in front of your solicitor/conveyancing officer.
also refer back to the post regarding the real estate BLOG link, when an agent brings an offer to buy contract to you there is a clause relating to the vendor giving the agent some seemingly exclusive right over commissions, this will also need to be amended before signing the contract........
i would suggest should an agent not wish to accept the amendments it may be wise to seek another agent. and at all times it is your right as a vendor to negotiate the amount of commission paid before signing, and from our experiences if a contract is subject to finance by the buyer then ask for a substantial deposit to be paid, advice given to us suggests a figure equivalent to 5% of the selling price of the property...............................................
and as for who should hold the deposit in trust that is another story that won't change until homeowners who will likley be vendors at some time get together and lobby for changes to the law to protect the vendor and the vendors rights.......................................
