My turn to vent!!! Last year I got a new refrigerator...here is my problem

My neighbor wanted mine and she didn't have much money, I told her she could try it out and if she liked it she could pay me $100.00...I hear on our local tradio today (things for sale radio station) her voice and her phone number, that she had a side by side refrig/freezer for sale. Both my DH and I look at each other with our mouths open! I tell him, we are thinking wrong, she must be selling one that belongs to her grown kids or something...we just came from town and saw our refrigerator going down the road in a pickup truck! I'm so hoping I get a phone call that she now can pay us the money she owes us seeing how she sold it.

Am I expecting more than is likely to happen or have I been took?

I think I would give her a call and tell her you heard her on the radio and saw my fridge going down the road. And that it was really nice of her to be able to sell it for you. That you wish you had thought of it and you hope she was able to get the $100 you were asking for it.

I hope you get the call too! I would be peeved!

I think you can kiss your money and refrigerator good by. I'd call her on it though, just for general principals.

I absolutely remember going to neighbors to borrow a cup of sugar on occasion. I also have a clear memory of playing in the backyard as a child, while my mother hung clothes on the line and chatted over the chain link fence with the woman who lived behind us. Times really have changed, though. We know the neighbors on either side of us, and have a passing acquaintance with another couple of neighbors down the block - but I have no idea who lives across from us. If they were to walk in front of me right now, I wouldn't recognize them. Sometimes I wish we knew our neighbors better, but DH and I are at heart very insular at home. We do have a very active neighborhood - lots of folks out walking dogs, exercising, strolling - so there is ample opportunity to get to know folks ... I guess we just don't take the time to do so.

A large part of the problem has arien frm the 'electronic recording' of note. Instead of actually shuffling paper, an electronic database is used to 'record' ownership of the notes. This was done to speed yup sale of the notes, and avoid the recording fees jurisdictions require to actually record the ownership of the note at the court house. There have been hints of problems dating back a couple years. Dutsche Bank created a shell company to securitize notes and issue bonds backed by the notes. They then wanted to save even more money and rolled the shell company into Dutsche Bank. When they then tried to foreclose on some defaulted notes, the court required them to prove they actually owned the notes. All they had was ownership of the bonds, the notes were still in the name of the dissolved shell company. It would be like you purchasing a Fannie Bond, and then claiming the right to foreclose a note 'included' in the bond. You own a bond from Fannie, NOT the underlying notes. Fannie owns the notes, and they are the one who must foreclose. The electronic recording database is a private company, set up just to make buying and selling of the notes faster and less expensive. Some courts have allowed the company status as the 'owner' of the notes, others have taken issue. For may years the whole thing was handled on paper. Each seller added a transfer of the note ownership to the paper file, and then had the new ownership recorded at the appropriate court. This 'hampered' the secondary market, so the recording database was created. At least some of the title insurance companies have had some heartburn with the lack of public record. Only the actual owner of a note can release the note (or someone they directly designate like a settlement company for sales). With ownership of the note not clearly and publicly recorded, how is anyone to judge if the release on full payment is valid? Just as with a quit claim deed, you can only convey your actual interest in a property. A quit claim for the Empire State building I might give you conveys nothing, since I have no interest in the Empire State building. In the name of faster they have managed to cause clouds on titles that may take some time to unwind, and in the meantime owners who have defaulted will escape foreclosure until the courts are satisfied with clear ownership of the notes (and not simply a bond backed by the note).

Back when we planned our 2001 house, I haunted GW constantly. That time I learned about the value of lots of drawers and got the courage to do a white kitchen. This time, I decided on drawers and a white kitchen on my own! But I wouldn't have known about Never MT, Silgranit sinks or plugmolds, all of which I used -- the plugmold at the end of the island where a conventional plug would have been unsightly. Just recently, Bob_cville showed his Lee Valley clips for drawer dividers -- I'd seen them in the catalog but he showed how well they work, so they're on order. I saw many examples of pulled-forward sinks, and incorporated that in both sink run and the server on the opposite wall. I have a trash pullout and will eventually install a foot pedal. The cabinet folks dropped the ball on that. I used GWer's experiences, both good and bad, to guide my applaince selection. I "borrowed" the courage to confront when things weren't quite right. Without your example, I would probably have let some things go by. More importantly, maybe, has been the raised awareness level about so many things. I learned to be there if possible during four critical days: Cabinet install, countertop templating, countertop install, and appliance install. I'm retired, but if I were working, I'd take vacation days to cover those times! I can't believe how many little questions I answered! And, to be frank, there are a lot of things that I could see "in person" and say, "Very nice -- but I don't think that's for me!!" What a big help that's been in decision-making!! I've enjoyed each and every kitchen that's been shared, and really appreciated the time y'all have spent posting. We're moving in before May 1, so one of these days I'll have pics to share!!

Grainlady, I like your posts; but this one strikes me as more than a little self-righteous & struck an accusatory tone, IMO... "If you want "FUN" work, volunteer, or strive for something that helps develop some character qualities like: gratefulness contentment faith patience security discernment" I can't speak to the Hummer because we don't have a Hummer. But, I can speak to the boat that Mary mentions her ex-BIL enjoying as we have been boaters for many years. Every single one of your "character qualities" are taught continuously at the helm. From the moment you lose sight of land & all of the trappings that most people associate with "security" are gone..."faith" takes on a whole new meaning & importance. Without a huge dose of "patience" the liklihood of safely returning to port diminishes rapidly. Boats do NOT have brakes. As any mariner knows, The Rules Of Boating 1) Leaving the dock is optional. Every return is mandatory. 2) Boating isn't dangerous. Sinking is what's dangerous. 3) It is always better to be on shore wishing you were out there than being out there and wishing you were on shore. 4) The ONLY time you have too much fuel is when the boat is on fire. 5) The sail is just a big awning used by sailors to keep the Captain cool. When it rips to shreds, you can actually see the Captain sweat. 6) When in doubt, stay out to sea. No one has ever gone aground on a wave. 7) A "good" return to your slip is one you can walk away from. A "great" return is one after which you can use the boat again. 8) Learn from the mistakes of others. You won't live long enough to make them all by yourself. 9) You know you have hit the dock too hard if it takes all of your bilge pumps running at full power for you to step on the dock. 10) The probability of a boat's survival during docking is inversely proportional to the speed of arrival. High speed arrivals, small probability of survival and vice versa. 11) Never let the boat take you somewhere your brain didn't get to five minutes earlier. 12) Stay away from clouds. The silver lining everyone talks about might be a hailstorm. Reliable sources also report that lightning has been known to hide out in clouds. 13) Always try to keep the number of departures you make from your slip equal to the number of returns you've made. 14) There are three simple rules for making a smooth return to your slip. It does NOT matter if you're at the helm of a 15' run-a-bout or the helm of a 65', 3-deck cruiser...you ARE the law when you leave port. That requires good character skills in spades. I would suggest that all of this can be accomplished while having one heck of a great time! Keeping the alcoholic beverages back at the dock & not in the galley frig goes a long ways towards a successful voyage. Besides, the 'boat drinks' are a great way to celebrate another docking that you've walked away from! As mariners who've made many trips between the Bahamas & Canada I assure you people can learn to be responsible & frugal on a boat. And talk about FAITH! Just find yourself on a boat, sixty miles from shore in a thunderstorm...need I say more about faith?! What about being frugal? Sure, it's fun to pull back on the throttle & watch the water fly from your wake. But, EVERY SINGLE MARINER knows the rules...1/3 of your fuel going out, 1/3 of your fuel returning to port, & 1/3 of your fuel in reserve for emergencies (that's the frugal part & boy is it important!). Being reckless just once can cost lives. Boaters are not only frugal...they are downright stingy with not only fuel but water, food, emergency equipment, & lots of other stuff. It's not necessary to deprive oneself of fun recreational activities to develop good character skills, unless of course, your purpose is to critize & feel superior to those that make different choices. I should also mention that it's quite possible to enjoy boating & still have sufficient funds available for a comfortable retirement, donate to charity, & all the other good stuff of responsible people. /tricia

I wouldn't wait for a call I would march myself to her house and say that you heard her on the radio selling your fridge and saw it going down the street on a truck. Gee it's mighty nice of you to sell it for us and hope that you got the $100 that you owed me for it.

It truly does take all kinds. I think that unless you say something, you will not hear a word from her....she now has money to buy Christmas presents.

She didn't say how much she was asking for my refrig. on the radio, so I have no idea how much she got for it.
Every 2 weeks I order avon from her, (just trying to help her out and be a good neighbor) I think that habit will be broken! I can't believe the nerve of some people!
DH is about ready to call her and thank her for selling it for us and see if he can pick up the money. Myself, I'm at a loss for thoughts and words

I think you should kiss the money goodbye and chalk it up to a lesson learned.

You said that last year you got a new fridge and then let your neighbor use your old one to "try it out" to see "if she liked it."

LAST YEAR???

Last year ended 10 and a half months ago. That's way more than enough time to try something out to see if you like it. By not asking for the money or the fridge to be returned by, say, February, you have essentially given her the fridge.

Let your husband go over to talk to her. As so much time has passed and nothing said about her needing to pay you, she probably thought it was hers.
I would wait to see what she has to say before I really blew. If it was total disregard that it was yours, I'd ask for the money and no more Avon.

I would tell her that you want your fridge back so you can give it to a needy relative, after all she hasn't paid for it so you are assuming she didn't like it. As my daughter would say "you can't fix stupid".

Oh, how many times have I learned the lesson... try to be a nice guy... they kick ya in the teeth!

Depending how this person is, they could be waiting until a check clears, or to cash it to pay you. Sounds like you're acting kind of quickly since it sounds like this just happened hours ago. Frankly I wouldn't expect to get the money, but then again you did wait an awful long time and actually, still haven't requested payment. So in fairness, the blame is not all hers. You could then go after her more for it. You could certainly take her to conciliation court. Guess it depends, you want to have fun with it or is she a friend? If she's a friend, waiting a day or two wouldn't hurt. Or you could invite her for a cup of coffee, go to the frig and say, BTW, how's my refrigerator working? Did you decide to buy it?

When I read the title I thought it was going to be someone saying can I borrow your mower? and then hocking it!

I wouldn't be confrontational but mention to her that you haven't been paid and see what the reaction is. If she sold it at a profit, you have no right to the selling price. You offered to sell it for $100 which is the maximum you should expect to get.

As I read your post, I thought of a line from one of the "Are You Being Served?" episodes. It sums up what I would say to your neightbor...

Mr. Harmon was saying to Mrs. Slocombe, "I'm glad I dont' have your nerve in my tooth!"

I hope you can phase something similar to her, or that she shows up on your doorstep with the cash in hand.

I reread your post. You said to your Neighbor "If you like it, you can pay me $100." You didn't say if you don't like it return it. Sooooo, she didn't like it, didn't pay the $100. Now she's getting rid of it and actually getting paid to get rid of it. Who knows, maybe she only got $25.00. Used refrigerators don't go for much. I think it was a little tacky but after a year she probably forgot about the $100 comment and maybe even felt she was doing you a favor taking it off you hands. If you really wanted money for it you should have confronted her a month after you "loaned" it to her and told her if she wasn't interested in buying it you had another interested party. I would just chalk it up as a lesson learned. If I really didn't like the Avon products I wouldn't be buying them anymore. If you plan on living in the neighborhood for many more years I don't think it's worth the confrontation. It seems to just be a misunderstanding.

You could order $100 worth of Avon from her (a total of $100 including tax) and tell her that you'll have to pay her when the merchandise is received. Then, when she delivers it to you, make sure you have it in hand, then tell her that she can keep the $100 for the fridge as payment for the Avon.

And then, forget about it. You waited too long to attempt to collect from her.

That's pretty cheeky, to not offer it back to you if she no longer needed it. I would be tempted to mess a little with her, too, in good fun. Wait a few days then call her up and ask if she's done using it, that with the holidays coming you could use a good back-up fridge again. And then see how she starts to blither. lolol

I don't think I'd be buying Avon from her anymore, not unless you really want it. Have you tried Mary Kay? lol I know a great MK lady, one of our own!

Oh gosh, this is almost comical. Reminds me of the landlord here who drove into his yard to see his tenants selling his furniture that furnished their apartment. They thought that he no longer needed it.

I wouldn't pursue compensation after such a long time, but I'd let on that I know the fridge was sold, in a friendly way. Just make sure that it was in fact your fridge though.

Thanks for all your comments. I have decided to wait a few days before I act on my emotions, by that time my avon order should be delivered. She is not a friend, her MIL is also my neighbor and a friend of ours, so I don't want problems there. We have only been here 5 years and they have been here their lifetime!

As far as me not asking for the money long ago...I felt she just didn't have it to give to me or she would have done so. The point here is if she no longer needed it and could afford a new or different one...why not just pick up the phone and tell me she no longer needed it and would I like it back? I more than likely would have said I didn't and we could have discussed the money at that time.
The money is not the issue here...the issue is she sold something she didn't have the right to sell because rightfully it did not belong to her.

I guess I would mess with her. Call her and tell her your "new" frig went out on you and you don't have the extra $ to buy a new one right now and would like to get your old frig back until you can get another new one, I guess you don't have to pay me the $100 now that if I am getting the old frig back. Then sit back and she what she says...um um um ..I don't have it anymore. Really, What happened to it? Then say maybe you can buy a used one somewhere, asked her if she knows of a good place to get one, also slip in you could use the $100 on the frig she got from you. I wouldn't expect to get the $ from her, just make her real uncomfortable...And don't order anymore Avon.

Man - a lot of time wasting, energy sapping passive aggression here. Best to be direct and up front, but I wouldn't expect too much - "last year" was the time to approach your neighbor about her "owing" money for the fridge.

A lot of jumping to conclusions here. Maybe she forgot that she was suppose to pay you $100 if she liked the fridge. Maybe, if she is really broke, she sold it to buy food, or maybe she did sell it to buy Christmas for her kids. The point is, you don't know why she sold it until you ask. Sounds like everyone wants you to go in with guns blazing demanding to know what the heck is going on. I would just ask her nicely. Just call or go over and say the funniest thing-I thought I saw the fridge I loaned you being hauled off. Geez Louise, don't hang somebody over $100. I know it is the principle of the thing, and trust me, I have been taken my fair share of times because I am a very trusting soul. Just remember, regardless of why she did this, you loaned her the fridge in good faith and for all the right reasons, so if there is some wrong doing, she will be the one to answer for it, not you.

Yeah, it would be fun to mess with her, but I think complete honestly may really be your best bet. Tell her you really expected her to pay you $100 but when she didn't you assumed she was down on her luck so didn't want to push the money issue with her. Also tell her you know she sold it so you really think you are entitled to your $100 or at least the money she sold it for. Maybe she misunderstood and thought she was doing you a favor so you wouldn't have to pay a hauling charge or something.

I'd have nice little talk with her to clear the air and get everything out in the open and unless you find out some major thing that totally changes the story, I seriously wouldn't be buying any avon from her anymore. Even you if have to go online and pay a little more, I wouldn't be giving her any of your business. Don't allow yourself to become dependant on anyone you can't depend on! No, $100 is not worth ruining a friendship over, but she's no friend in my book.

If you like her as a friend, let it slide. . . I'm sure you will laugh about this in ten years. I remember once, we were living in the downstairs of aily house. It was a hot summer. DH gave (lent) the people upstairs a window fan. They never returned it, not even when they moved away. I would have liked it back. . .

I did see her on the road today and she just waved as usual, I was expecting my cell phone to ring after she went by, but nothing! I also saw some new but used cabinets and cupboards on a trailer at her house. Looks like she hit the jack pot! DH says they obviously need the $100.00 more than we do, so maybe now is the time to end all ties and just leave our thoughts just that and not turn them into words.

I'm hoping but not expecting to hear from her. I do know she is not much liked here and those comments have come from her own kin.

I would be point blank with her.Call her,or confront her in person.Tell her that you heard her advertisement on the radio and that you saw the refrigerator in the back of someones truck,so you assume she sold it.Ask if she remembered the deal she made with you.If she does tell her you would like to have the $100. and ask why she thought she had the right to sell your refrigerator in the first place! Tell her that she should have had the courtesy to call you and ask if it was OK to sell it and give you the money.After she has been made to feel guilty,let it go.If she offers the money fine,if not chalk it up to a lesson learned.If you haven't gotten the money in a years time you probably weren't going to get it anyway.You should have at least been asking for it a few times in a period of a year so in a way that's kinda your fault! You have already said the money isn't the problem so I would call her on it and let it go at that.I can guarantee if she did this thinking it was OK,it will come back on her twofold!

I'd have been at her door, not angry or blowing my stack, but finding out what was up, about 3-1/2 min. after arriving home on the day that you saw the truck departing.

As far as I'm concerned, there was deal ... and she hasn't fulfilled her side of it.

OK, if that is really what happened, you should know that used refrigerators generally go for $50 or less, no matter how new. If you really wanted the $100, you should have been in contact within 2-4 weeks! You should have had some sort of written agreement to start with.

Maybe she didn't like it? You left a huge "OUT" by not getting a contract to start with, and by not contacting her after just a few weeks.

I think it's your loss. Yes, they were wrong. But so were you, and you left the matter way too long. Make a contract next time.

This just blows my mind! I've been thinking about this because it's so hard to believe that someone could use someone else's side by side and "forget" where she got it. I mean, when the thing was moved from your house to hers, it couldn't have been easy. Did she say a lot of "thank yous" that day and "I'll make payments", etc? Was her DH involved in moving it and say anything?

If this is going to fester in you and there's a chance that you'll blow up at her someday, I think I'd try to figure out a way to bring up the subject now, while you're still in control of your emotions. If she's redoing her kitchen and starts telling you about it, you might lose your cool and lash out.

I guess they just got used to "the elephant in their kitchen".

You are dealing with someone who has lived in the area along time and her relatives. You are "the outsider" and probably always will be. Personally, I would drop it,be polite, but not a neighbor. Avon? Just tell her you choose not to buy at this time. Relative? Blood is thicker than water--and people will say so much and mean so little--Small towns--mid west--just a thought.
Say HI- and go on with your business. After awhile, she may say something, and just quietly tell her that she really hurt your feelings by selling something that was not hers--but again, she may have done this to HER relatives and again they can complain==you as a outsider cannot. Try to forgive and forget and consider it a lesson to learn. If she ask to borrow etc, just tell her you do not loan.
Now have a good cup of tea and am sending hugs to you.
