Fed ex would be fine...have someone else send it with their info on the outside of the envelope.
Make sure you check "signature required" and they won't leave it.
Fed Ex and UPS both sometimes leaves things at my door.

Don't count on the person signing for anything. I'm not sure that he's too bright if he does. If you're trying to serve the person a notice, best to hire a service to do it personally, as in handling the paper directly to the person. It's the only thing that actually works for legal purposes.

I believe that just a signature on a receipt does not hold up in court.

The post office used to do it. I watched a court case where some property was under dispute. One party had attempted to to get the other party to sign for papers through the mail. On the advice of the lawyer, the second party refused to sign. The judge allowed the attempt to notify the second party as a notification since the second party had refused to sign. This was in small town Arkansas so that might not fly elsewhere.

What sushipup said. Pay the 50 bucks and have him personally served and file the Affidavit of Service with the Court.

Check with your local law enforcement. In Los Angeles County, the sheriff will serve them, but they might have to have a court order. Not sure if just signing will be accepted in court. Check with a lawyer first.

An afterthought. I will not sign for a letter or package unless I know who is is from. Went thru that once many years ago.

We had a County Sheriff serve a tenant who didn't pay his rent for over 6 months. When our tenant "John Doe" opened the door, the Sheriff asked for John Doe, John told the officer that John Doe does not live there any more. So, he never got served, went another two months before fleeing in the middle of the night, leaving us with an incredible mess.

Moral of the story, have whoever does the serving check an ID if the person claims to not be the person being served. Not sure if that is really legal but if you're working with the Sheriff department, they would know.

Sheriff here just pulls up the license on the computer in their vehicle, so he knows exactly who he's looking for before he goes to the door.

Even if he signed for the envelope it doesn't prove that he received whatever was inside. He can always claim that the envelope was empty and that you obviously forgot to include the letter.

I know that may sound far fetched but it happened to me when I notified the landlord who rented out the house next door to ours that the people who closed his pool emptied the water into our yard causing serious erosion. I Fed Ex it to him and then when I called him he claimed the envelope was empty. I watched my DH insert the letter.

No advice, but waving to Michelle - it has been a long time! Good to read you, but sorry to hear you have an unpleasant situation going on.

Here in AZ the signed green receipt is proof of service and can be filed in court. I have done it many times.

Does he know your address? I would not put my name on the return address or use a friends address or PO box.

If that doesn't work, have him served. If you win, he will have to pay all your costs anyway so you will be reimbursed.

Just make sure you get the letter back with the papers. I think it still counts as trying to solve the issue. I have had to send letters like that to 3 business men and all signed it, but I sent it through the post office, signature required. Got what I wanted right away.

Angela, this was BC ... before computers. :-) After Mr. John Doe, we had a woman who was the perfect tenant until she passed away at age 80 after renting from us for nearly 20 years.
