This is my first post- need advice. I have been with a man who has two daughters ages 9 and 13. Their mother left them at ages 2 and 6. They have called me mom since we astablished a relationship a year after meeting their dad. We took our time to introduce the kids into it. They are good girls, love them much and would do anything for them. After disapearing for 3 years,bm kidnapped the girls from an aunts house and took them over state lines filing false papers with DSS stating she had custody and he owed child support. They were gone from school for a week(no call from school), and we had no idea where they were being that she fell off the face of the earth with no contact.Eventually we went to get them after getting information from her sister, but was served with papers for court regarding her lie. It was resolved and proven that he had the girls all that time. Two more years go by no word from her, support, or even a phone call. He saved money to get a lawyer and the case went to mediation where all the plans he and I made went down the drain. He agreed to joint custody with her( i couldn't tell you why)and to this day there is still no phone calls, support, and she doen't even exercise her visits but twice a year. What kind of woman is this. Put us through all of this to still not want a relationship with the girls. I realize hes an idiot for agreeing when she clearly doesn't want to spend time or help take care of them, but weve been together for about 8 years now and I can't imagine what the kids would be doing if i wasn't here. I love them so much. I can't imagine leaving my kids for a moment let alone 5 years. I just wish she would crawl back under the rock she was under so these kids can have a real, stable life. They have never asked about her, even now. They have their own little lives, friends, a great school and home. I am so angry still at him and we just seem to keep going back to his decision he made that was suppose be totally different. I find it kinda hard to give 100% when I know how she operates. She comes and does what she pleases, when its convenient. Not sure where his manly hood is since he can't seem to handle his business on an adult level. Anything can happen at anytime. He is so laxed on the subject.

Is Dad one of those guys who dislikes confrontation? That might have made him cave in during mediation. I'm of mixed feelings about mediation - I understand the need to not tie up the courts with every silly little disagreement, but I really think it's a very bad idea when one or both of the parents will not behave rationally. The mediators' job is to get the two parties to come to some agreement; their job is not to decide what's best for the kids (at least in our state), so to me it often seems like the less reasonable person gets their way, as they tend to hold fast to their demands.

At any rate. It sounds like BM wants to reserve the right to visit her kids if and when she chooses to do so. Dad may be thinking that she's not around now, so there is no problem with the current status quo and why make waves? You might have some success if you point out to him that if something were to happen to him, you (and he, if he were incapacitated) would have a very difficult time preventing BM from just swooping in and taking away the kids. If you've suggested that to him and he is still inactive, the only suggestion that I have for you is to create your own emergency attorney fund and research to find a very good one - hopefully it will never be necessary but if something were to happen you'd be as prepared as you could be. That is assuming that you have been acting as a parent to them in BM's absence; if not, unfortunately, I don't think you have any chance of getting guardianship if necessary no matter how much you love them.

I think you hit the nail on the head when you said he doesn't like confrontation. I have been actively inb those girls lives doing exactly what mothers are suppose to do so yes If something happened to him I would love to have guardianship. I just think It's sad that a father who claims to care about the wellbeing and stability of his babies makes decisions based on the moment. It kills me everytime they have to go with her.He's so afraid to not send them, now that he realizes his mistake, because he doesn't want to go to jail.What's amazing is she doesn't abide by the court so I'd take that risk if it was my babies Thanks.

If she hasn't completed the court-ordered parenting classes & education about autism, is that not something like contempt of court? I'm sure some of the wise women here who've experienced legal entanglements will know more, but I can at least recommend that you document, document, document; keep a diary, & record every communication, every time she's supposed to be there & isn't (or cancels), etc. Also, print out those facebook posts. Meanwhile, it doesn't sound like she's been around enough for him to wonder why he isn't with her. He might just as easily ask why he isn't with the postman or the Sunday school teacher. If he were to say something, I think I'd practice the age-old parental strategy of distraction. "Oh, I dunno, honey...Hey, look, there's a squirrel in the back yard!"

My ex pays for flights because he would never SEE his children if he had to pay. She chose to quit a job and go to school part-time and work very little. I understand that it is HARD for a family of 3 on 28K, but my point was that is was her choice to be poor. That is why I labelled her a "deadbeat". My BF's lawyer put in the agreement that the EX would pay for flights PROPORTIONAL to their incomes once she obtains a FULL-TIME job (and beleive me I think they haggled for a year to even get that included in the divorce). Unfortunately that was many years ago and she still hasn't gotten one. As for the amount paid - all I can say is that if the 2 children were living with him, and not only did he not have to PAY out 800/month, but RECEIVED 800/month (a spread of 1600 which is another thing most people don't think about) and she paid 1/2 the extra 356 in expenses and paid for 1/2 their flights, I am sure it would feel like he won the lottery (both emotionally and finacially). If she made even 40,000/year (which is less than she made in the job she quit), she would have at least 52,000 after tax dollars. The point I was trying to make was by choosing to make herself and her children poor, she is also contributing to making my BF poor. If she worked harder and shared in expenses or paid for flights, that would make a big difference in all 4 of their lives.

Yes, Emma, we discussed it with SS. He was very happy about it because he knows how tense things have been between us over the years. However, he loves his mother and although it's not very frequent, he does enjoy the time he spends with her. As I said, recently she has been showing more interest in him. The good that will come of it, we hope, is that it will open up the lines of communication again. SS is going to be living with her for possibly the next three years and we need to know how he's doing both in his studies and his life. SS tends to paint a rosey picture for his Mother becuase she's not around to see the truth. If she ever asked us, we would gladly tell her the truth, but perhaps she likes being oblivious. We are not like that - we want to know that he's okay, and if he's not we want to know that too. And we know that SS will not be forthcoming with the truth if there's a problem in his life. Perhaps his Mother will be if we ask direct questions. We just want to move on and act like adults...

I completely understand your jealousy with bm now being involved and the kids acting like bm was never gone. My skids bm has been in and out of their lives for years and each time she called or saw them they acted like she was so wonderful and was mom of the year. Nevermind that it would be months till the next call....or that her boyfriend would be drunk the whole time the kids were there...or that bm would just sit them in front of the tv all day and the kids heard "noises" coming from bm's room during the day when the door was closed (afternoon quickie perhaps??). Anyways it would upset me so much down deep to hear them say anything good about her because all I could think about was the bad!! And how much time and energy I was putting forth to do the motherly things she did not do. It just about killed me for her to get any credit! There is no easy was to deal with those feelings. You just have to let them go somehow. Realize that the kids love you both. And she gets it easier because she is the bm....she has their unconditional love. And they will put the absent parent on a pedestal and hang on every good thing that parent does. But when they are grown they will have so many more memories with you and remember all the things you did for them. When they have their own kids they will remember talks you had with them and things you did. As for her babying them, well you can't change it. Just keep on with your normal routines at home and they will soon see that they can do XYZ at their moms house and they have to do XYZ when they are at home. But look at the bright side. They are getting to see their sober mom and have a relationship with her, which is better for them in the long run that having her absent and them blaming themselves for it. And if she spends the whole day playing with them be greatful....she could be spending the whole day sleeping and letting them do god knows what! OR she could be having boyfriends over all day.
