When my mum died, my brother and I didn't inherit anything, nor did we expect to. About 2 1/2 years later, my dad sold the family home and bought one with his new wife. He put his half in trust for my brother and I. Dad died just over a year ago, leaving his savings to us (50k) with a life interest in the house for his wife. She says she can move with it all if she wants to and the will seems to support this. She is 71 and says she might live till she is 90. She would often tell me how lucky she is to have money, I think from her first husband and her own dad. Since my dad died, she's been to Barbados, Turkey and a holiday in the UK. My share of my dad's savings went into our house refurb but we need more to finish it so our kids, aged 4 and 7, can have a nice home to grow up in. An additional concern is my mum in law lives in NZ and is on her own now so we'd like visit her at some point. Stepmum doesn't want to help us. Am I being unreasonable to expect that she would?

When you say your stepmom can "move with it all", what does that mean? It sounds like you've inherited 50K from your father and now that you've spent it all, you want your stepmom to give you more money?

If that's the case, yes, you are being unreasonable. You got your share, she got her share. So what she's spent her money on trips? You decided to spend your share on fixing your house up. The fact that you want/need more money to finish it and want to visit your MIL is not her concern.

A life interest simply means she can live in the house until such time as she either dies or signs away her life interest. Assuming your Dad left his half of the house to you and your brother, she can't sell the house without your and your brother's written consent, and the proceeds from the sale would have to be divided in two, with one portion split between you and your brother.

Thanks, guys. It probably does just need repotting, but I've been converting my plants over to hydroculture, and the best way supposedly is to start from cuttings. I just wasn't familiar enough with pothos to just start hacking it up. It only gets office light; it didn't seem to mind, but lately random leaves have started dying. It also needs a bath rather desperately, and two 12' vines aren't that easy to move. As it is, I keep having to pull it off the wall so it doesn't set roots in the drywall (the boss is picky that way). Campanula: congratulations, you are gardenweb's Jebidiah Atkinson. And I mean that with the utmost respect. I suspect the Chelsea Flower Show has always seemed over-the-top to SOMEONE. These days it just has to be even more extreme to compete with everything else that could steal people's attentions. I thought I read years ago there was something like a "Chelsea Fringe" a la the alternative Edinburgh Festival? I think over-the-top spectacles like this are just part of the British national character, at least from my perspective. And someone always finds them revolting. That's fine. If Campanula wasn't disgusted, they wouldn't have done their job. At least they have been since the Great Exhibition, if not before. I quote the wiki: Six million people "equivalent to a third of the entire population of Britain at the time "visited the Great Exhibition. The average daily attendance was 42,831 with a peak attendance of 109,915 on 7 October.[5] The event made a surplus of £186,000 (£17,240,000 as of 2014),[6], which was used to found the Victoria and Albert Museum, the Science Museum and the Natural History Museum. It was extremely pretentious but I enjoyed it. Likewise, though, some high minded architectural purist might see the event as a crass corruption of what it should be. (the definition of what passes for architecture was absurdly loose. One person's project just seemed to be a room full of male & female models standing around in togas) My point is, if it isn't clear, once you actually have specialized knowledge of a subject, an appeal to a certain interest in that subject may especially not appeal to you. Sadly, he can probably get off more easily than any of us would like to think. I don't know, but the realist in me says find a way to move. You can't depend on the neighbor's being incarcerated to go forward with a normal life. It sounds like your neighbor's "crew" still assembles despite his absence. If he and his friends disappear, is there potential for a replacement problem group taking up "residence" in your immediate vicinity. Could you have friends over for an impromptu summer bbq? It seems as though you can't plan anything outdoors so long as your neighbor's son & his friends are around. I can see this getting worse first before/rather than better. Things are definitely not in your favor with regard to the current real estate market, or for that matter, the economy in general. However, when it gets to the point that your kids can't safely go outside to play on a nice day, and you are living in daily fear, is it really worth your sanity and that of everyone in your family? I am a fighter as well as a total optimist. Before reading about your situation, I would have adamantly defended my right to live in my home. I would not allow the behavior of another make me move from a home I created. However, under your circumstance, I would definitely consider all options, moving being one of them. Is there a reasonable possibility that your neighborhood will get progressively worse, or is this an isolated thing within a 10 block radius of your home? If I were to take a walk in your neighborhood, would the gang presence be obvious to me? What is the the town like overall? It may be a strategic move to get out of this neighborhood now before it becomes reputed for its higher potential for crime? Also, I can't remember if you mentioned having any pets. If you do, they need protection from this situation as well. I wish I felt more optimistic about this getting better for your family. You and your DH are the only two people who can gauge what your home life will be going forward if you do stay in your current home. Also, I don't know the ages of your children and how "at risk" they are being next door to this kid and his friends.

Interesting read! I was aware of many things mentioned.... didn't ever hear that about Jack Whitaker, but do remember Gary McCord. lol! One year he commented about the conditions being so perfect that "you couldn't lose a contact lens in this rough". LOL! Then I believe he made the mistake of referring to the "bikini-waxed greens" and "bodies buried behind the green" (indicating how difficult it was to get up-and-down from there). That was his last year there too. :p I missed him! Just heard Frank Nobilo refer to the Masters winners as champions. He's on the golf channel though, so I guess he'll be back. :)

Thankyou colleenoz. If she can't move without our approval, we would be fine with that but what is causing confusion is that the will says she can but the title deeds say she can't. She's adamant that she can and says we will just have to wait possibly 20 years till she dies! This is all so horrible. I feel positively vulgar talking about it and even though my Dad did all he could to look after all of us, including his wife, it is still causing problems. Damn money!

UGH, so are you saying you're all upset because you have to "wait" 20 years for her to die so you can get more money?

A life estate means that the beneficiary gets to enjoy all the rights & responsibilities of ownership for his/her life (pay the taxes, do repairs, etc) or until he/she sells the property with the agreement of the ultimate heirs.

She inherits the house for her lifetime.

The beneficiary can rent the house out if she wants.

The only one in which I was involved was a home in another state;
the widow lived here in Texas & rented the house out.

When the septic system needed to be replaced at a cost of several thousand dollars, she preferred not to lay out the money, so she worked out an agreement with the heirs in which she sold the house & kept 50% of the net proceeds & the heirs split the remaining 50%.

This was at the option of the beneficiary;
the kids had no power to make her sell it under any circumstances.

You really need to discuss this with a lawyer. Contact the Law Society in your state- often the first hour's consultation is free.

Wow. I read your other post and responded and I am now reading this post about your father's will. the picture is clearer after reading this post. Larajaij, your father left you $50K and you spent it and now want access to what your father left his wife. He took care of his wife but left the house to you upon her death. If your father had left that to another family member would you feel as entitled? So, the bottom line is that you don't feel she deserves the house and would prefer her to....what? Move and let you have the house? Larajaij, I am ashamed for you. My father left everything to my step-mother and she gave me a watch that she purchased for him and I was so very thankful to her for that watch. That was his wife and their relationship meant a lot to me because she loved him and he loved her. They may not have been perfect to one another but nevertheless, they loved one another and I would never have considered entertaining the type of hate you bring to her. I was raised differently than you apparently. I imagine you can find people to co-sign your feelings and actions, but I hope you save yourself time and energy and take time to reflect on how you are treating others. If your relationship with you sm is an example of your values, I suspect you are having trouble in relationships elsewhere also.
