A smart insurance company has finally put together an insurance program for all types of farmers markets vendors! The program provides the vendors with group rates for $1,000,000 in general and product liability per occurrence with a $2,000,000 annual aggregate limit and a zero deductible. This will cover the vendors while at all markets that they participate in. Note that there is no limit on the number of markets in which you can participate. The only requirement is that all such markets must be listed on your application for coverage to be provided. The cost of the policy is $350 per year for vendors that generate less than $100,000 total annual sales at the markets listed. For those vendors that generate in excess of $100,000 in annual sales, the cost of the policy will increase at a rate of approximately $5 per thousand of sales. Premiums are paid annually and once coverage is extended, the premium is fully earned and non-refundable. Coverage is provided by an A rated insurance company. "So you think we should close all the storage spaces in the basements, too? They are all common element as well." That is silly. Are not the storage lockers assigned? Are they not written into the contract saying that all owners have use of the basement? If not, that would be weird. I've never rented a place that did not have assigned storage. Otherwise one tenant could hog the whole basement with their stuff leaving no room for anyone else. Neighbor fights start over things like this. You have described a situation in the original post where some owners are using attics that are common for personal living use, and others do not have this same access to use the attics. This is not the same as EVERYBODY using a basement. These attics are not written into the contract agreement. Right? The seller gave you verbal permission to use the common attic when you bought the condo. The President of the association gave you verbal permission to use the attic for your own purposes. Do you realize that he could "forget" that he ever said that? Attic use should be in writing. Say for instance the guy with the workout room in the attic has his friends over to work out or the guy with the train set has parties to show them off, and one of them falls through the weakened floor. Who do they sue? As I mentioned before............are all the owners even aware of the situation? I can't see any of the first floor owners even thinking to ask if the owners on the second floor are running train sets up in the attic, or housing jungle gyms when they are viewing their condo for potential purchase. I would run this by at one of the condo association meetings. The first floor tenants have the right to know what is actually going on in the common areas since they will be liable for its use even though they themselves do not get to use it. And yes, I agree it is a buyer beware and they must exercise due diligence when purchasing one of these condos. That does not mean that there won't be a court battle over a misunderstanding. The other condo owners do not need the hassle of litigation. Everything should be in writing. How hard would it be to draw up paperwork that puts everything regarding attic usage in black and white. This would be more helpful should any problems arise, than someone trying to remember a verbal agreement from years ago that a former condo association president said off the cuff. If something happens up in the attic and there is nothing to go on except a verbal agreement that someones says they remember, or claims they don't remember it, will probably end up in court. When ever something goes to court there are no winners. Lawyers take all from both sides.

This is an old thread but I wanted to add a few comments for future readers who may have similar problems. Tanks are quite often state regulated, rather than EPA. In my state, a home heating oil tank is unregulated, meaning there are no specific closure or abandonment requirements. However, the owner is responsible for any leaks or contamination, so if it seeps into your neighbor's basement...much better to properly abandon it. Typically if an underground tank is to be abandoned in place it is sampled around the outside using a soil probing machine to find out whether it leaked. If the samples come back below whatever the state's limits are (and these are rarely zero), you're done. Heating oil is not as highly mobile as gasoline and does not dissolve into water at the levels gasoline does, and its constituents are not as toxic. If the soil is sandy it can move farther, if clay it will probably not move much at all. It would be rare for a home heating oil tank to cause a cleanup costing 'hundreds of thousands.' Most city wells are quite deep with lots of outer casing to prevent shallow contaminants from going down into the deeper aquifer or being pulled up in the water. Not that a city well has never been contaminated by a tank, but keep in mind, the most common toxic groundwater pollution source is all those gas stations, which have big tanks and a lot more of them. So don't stress about a household tank causing a city-wide environmental disaster. When the OP's neighbors go to sell that house, a smart buyer would ask for soil test results from the abandonment, and if there aren't any, they'll be paying for it then instead of now.

In my area, "Corporate owned" in the Multi-list info can mean either bank owned or relocation company managed. You will need to find out which. Buyer to pay both transfer taxes almost always goes with bank-owned/foreclosure property. Expect nothing in the way of repairs done from the foreclosure companies. They want clean, quick contracts from unrisky buyers. They do like the property to have a certain amount of exposure in the marketplace, so they will often kind of look to see what's coming in for a few weeks before moving on something. Having a thorough market analysis done by your Realtor is key here, as in any prospective purchase. Several of the agencies that specialize in marketing this type of property in our area strategically list at low prices, leave at least several weeks of time before responding to anything--and these properties can go well above asking price. In other cases, it seems like the lender (often out of the area and dependent on local advisory--maybe on target or not--will try to get a sense of buyer sentiment before taking a hard and fast position--but will cut losses reasonably quickly if nothing wonderful comes down the pike. Be very careful evaluating older foreclosure properties. They have often been abused and neglected for a while . . . the higher-priced non-forclosure property you've been resisting may actually be the better buy. As always, do your homework! Relo companies, on the other hand (and I speak as an agent of 24 years) can be very particular and conservative to work with. They are very liability conscious. Before they "purchase" the home, it gets inspected by the inspector of their choice, with certain things having to be corrected or addressed by the transferee before any monies pass to the transferee. They require highly-detailed two page reports every 14 days from the listing agent. They try to be market sensitive, and hence, usually neither "dump" their properties or hold out unrealistically-long for a particular price. Losses usually get eaten by the transferee's company in some way. They are motivated but realistic and not desparate sellers. There's a lot of extra paperwork involved with these guys, but something to just put up with.
