Pool builder Completely Ruined my Front yard! Advise?

It rained the first week they started on my pool. The backhoe and trucks have to go through my front lawn to miss the trees on the side, and the machinery completely tore up my all of grass and created deep trenches of tire marks. Our contract does state Anthony Sylvan (pool builder) is not responsible for this damage. However, our salesman made it sound like it would be a very minimal damage to the front yard.

Since that is not the case, do I have any grounds for asking them to fix it upon completing the pool? Maybe stating that I would be a very vocal customer no matter if they do a good job, or a bad job? Has this happened to anyone, any advice?

unfortunately, like you said, the contract states it clearly.

On the other hand, especially if there was rain, there was precautions that could have been taken to lessen, if not prevent, noticeable damage.
And salesmen, for the most part, will say what you want to hear...especially low end budget salesmen desperate for a commission in hard times.

It will be up to them on a customer service standpoint as to what they want to do. I wouldn't threaten them with being "vocal", but that's your call.

I hope you can come to an agreement...best of luck.

We finally got started planting behind the raised bond beam! Talk about a lot of work! We had to build a retaining wall behind the curved portion of the wall with Castlerock, and those things are heavy! I haven't planted anything along the new sundeck, but hope to start that today. We also still have four Pygmy Date Palms for behind the raised bond beam, that we have to plant. Two will flank either side of the CI Date Palm for some added privacy. Here is a close up of the area we planted: I'm super pleased with the look of the ferns. We're lucky in that we only get about 1 hour of direct sun there a day, and it's from about 5:30PM - 6:30PM. Hopefully these Kimberly Queens will thrive there. I looked forever, before finding these bowls for the lower portions of the bond beam. There is a really good nursery, showcased in Southern Living, in a nearby town. They're my go-to place for hard-to-find Texas plants, and they have awesome decorative items. The bowls look amazingly like Oklahoma Wister flagstone! I've planted this combo before. It'll be white in the back (Angelonia), Liriopi in the middle as a perennial, and eventually the purple Scaevola and New Gold Lantana should spill over the front. With the Blue Plumbago in the back, the color combo should look nice. In about a month, it should be totally full. All I'll have to do is change out the annuals each season for color. The fence is in. Now all we have left is the flagstone inlay and the flagstone on the steps and we're done!

"a little kindness towards others can go a long way". Yes it can! In all those backyards, for all those years, I can count on one hand the number of homeowners that even said hello, let alone get us a drink, or make us lunch. We usually finished their pools on time, or early. A freind of mine at the time installed alarm systems. He did one for Roger Staubach. He never saw Roger, but Mrs Staubach, made them sandwitches and lemonaid. He still tells the story and that was 30 years ago. Since we are totally off topic, I got this one second hand, but the guy that told me seems pretty straight up. A pool cleaner did Nolan Ryan's pool. He saw Mrs Ryan sometimes and Nolan maybe once in a year. He was a huge fan, but too shy to ask for a autograph. Someone told him to leave a baseball on the table by the pool and maybe he will sign it. He did just that. Next time he cleaned the pool, the ball was gone, nobody was home. The week after, still no ball. Then one afternoon he went to cleaning the pool and noticed a ball on the table. Signed by not only Nolan Ryan, but half the Texas Rangers baseball club! With a note, that read. Sorry it took so long, good job on the pool. I bet that was the cleanest pool in North Texas......lol

I have read where people are really unhappy with their poolbuilders, but mine was great. Ocean Blue Pools built my pool in 2002 and it is still beautiful. When we decided to build, Ocean Blue Pools was definately not the cheapest but you definately get what you pay for. Our HOA was being difficult about our easement and OBP was great about working with them and coming up with a compromise. They were prompt about completion. Even with rain delays and neighbor issues they finished quickly with very little mess. When they finished they relandscaped the backyard and replanted trees we didn't want to loose in the front. Our neighbor was a little testy about the backhoe tracks between our houses and Baron found out he was about to buy a pallet of grass and gave him two pallets of grass as compensation for the inconvenience. We have had very few problems with our pool since it was built, but when we have called OBP with questions and concerns, they responded quickly and even came out to show me how to maintain the pool when our pool maintenance company walked off unexpectantly after 3 years. The key to having few issues with your pool is hiring a great company to maintain the pool. We started with a polaris pool cleaner, which was great, and lasted for 6 years. In the last year, we have been alternating between two Hayward pool cleaners. I will definately work on affording another polaris.

If you can come up with an old piece of chain link fence and a couple logs you can make a drag to pull behind the mower. Basically the chain link will scrape a little dirt off of the high spots and drop it in the low spots. It may take a little while but as long as it's not too bad this will work wonders for smoothing out the bumps. If it were me, I would hold off doing anything that will leave you with bare dirt for now. Otherwise you will end up with more weeds to deal with and there's a good chance you could have some soil erosion from storms or heavy rains during the summer. Leaving the weeds alone will allow them to hold the soil in place. From there, get started with the "destruction" process in mid to late July. About 1 week prior spray everything with RoundUp to kill off all of the weeds. Once the destruction is complete and the lawn area has been smoothed and ready for seed begin watering lightly 3 times per day for a couple of weeks to germinate any weed seeds that were left behind. By lightly I mean just enough to keep the very top layer of soil damp. Spray anything green again with RoundUp. By this time all this is done you will be into your ideal time for seeding which should be mid to late August for you. In the meantime, use the search feature here to learn proper seeding, watering, fertilizing, and all the other stuff involved in maintaining the new lawn as all this is important if you want the lawn to be successful. It's really not too hard but you don't want to spend all this money to have it go wrong. You've got a good group of folks here on the forums to help you through it and answer any questions that come up along the way.

The clean up crew should come out twice (once after tile and then again before plaster) and clean up debris and re-level your yard. They won't leave it looking all torn up with ruts. At least I hope not.
They most likely will not replace the grass as that is something you have to get done afterwards...we contracted our PB to do this for us so we wouldn't have to worry about it.
Where are you located?
I would just ask your PB what will be fixed and
cleaned up by them and what
you need to plan to take care of as far as grass and landscape goes.

I'll always knock down the rut edges and fill in the tire track divots with grading sand. This is a simple grade and comes as part of the deal. Fixing any broken sprinklers or replacing sod comes at extra expense unless the buyer has it in the allowances of the contract.
Most of my buyers don't pay for the allowance in their contract and do it theirselves or have a landscaper do it for them.

Yep, my PB was upfront saying that there would be 200,000lb equipment in and out of my yard. I am not all that sharp but fiqured out, if it rained during this (which it did)the yard damage would be much worse. I did underestimate the damage that would occur to my neighbors yard but I promised him I would have it looking new again after the pool was complete.

They will do a rough grade when they do the clean up and it will just take a yard of topsoil (4 bucks), 100 ft of PVC for the sprinkler (40 bucks) and 3 pallets of sod (300 bucks) to get my neighbors and my yard back to looking awesome.

Most if not all PBs will include full dirt and sod service but will jack the price way up as they should because the are pool builders not yard guys. You can hire this service out for a decent price or do it yourself for next to nothing.
