Changing from 401k to a 403B

DH's employer is switching to a 403B with a different agency. I have 2 questions.

1.In the memo, it is stated that this will save the employer some money. How is that so?

2. If we learn that we can't roll over the $ into the 403B and we have to roll it over into an IRA, what's the best way to go-a Roth IRA? DH will be retiring in about 10 years or less.

I will give your question a shot and I am sure others will also add their advice.

On question 1 - I suspect that the fees charged to manage the 403B are less that those charged for the 401k Here is info from the IRS website on 403B plans

"IRC 403(b) Plans
Certain employers are allowed to have Internal Revenue Service (IRC) 403(b) Tax-Sheltered Annuity plans. You are allowed to have a 403(b) plan if you are:

A public school, college or university,
A church,
A public hospital, or
A charitable entity tax-exempt under section 501(c)(3) of the Code.
Basically, 403(b) plans are similar to 401(k) plans maintained by for-profit entities. Just as with a 401(k) plan, a 403(b) plan lets employees defer some of their salary. In this case, their deferred money goes to a 403(b) plan sponsored by the employer. This deferred money generally does not get taxed by the federal government or by most state governments until distributed. This is just as it is with 401(k) plans."

I assume that your husband's employer meets the requirements for establishing a 403B plan.

On question 2 - You can roll the money into a traditional IRA without having any tax consequences. You need to set it up as a direct rollover - that is the company that holds the 401K transfers the money directly to the bank/investment company that will have your husband's IRA. You cannot roll the money into a Roth IRA. The money that is contributed to a ROTH IRA has already had the income taxes paid on it. The money in the 401k has not had any taxes paid on it. If the money goes into a traditional IRA, you need to establish a separate IRA for that money. If your husband ever goes to work with a company that has a 401K plan that allows rollovers into the plan and your husband chooses to roll this portion of his IRA into that new employer's plan, it must not be mingled with other retirement funds.

The only exception that I can think of is an emergency account.--- Assuming you are funding your retirement account appropriately to provide adequate retirement income, why would you put additional savings into retirement accounts? Once there, you can't use them easily and without penalty until you are retirement age. No, tax savings from tax-deferred accounts are not inconsequential, but neither is the freedom that comes with having money available to use how when for what you want. I am putting money into a combination of 401k and Roth retirement accounts at a rate which will conservatively provide me with adequate retirement income. This is less than the max--(although well over employer-match). Every thing else goes into ordinary ol' non-tax-deferred investment accounts. It's not really "emergency" money--- i also have 6-month living expense emergency funds in my bank account. But I am in my 30s. Why would I put any money above and beyond what I will need for retirement somewhere that I can't easily reach it for the next 15-20 years? Maybe I'll want to go to grad school and want to use it for tuition. Maybe I'll get married and want to put my husband through school. Or my husband's kids. Maybe I'll want to buy a bigger more expensive house and want to use it for down payment. Or a second vacation and/or investment home. I might want to take a year off work and travel. I might want to take a year off work and be a mommy to a new baby. I might not *want* to take a year off work but be forced to when I'm fired from my current job and it takes me a year to find a new one. I might want start-up money for my own business. I might have a sudden desire for one of those convertible Mercedes two-seaters (is it the SL i think).... I might I might I might. Freedom (and security) is "why not?" (which are the same reasons btw that I'm saving it in the first place rather than simply spending everything above and beyond what I've decided I need to save for retirement)

You'll probably have multiple employers over time. Set up an IRA at a good low cost broker - Vanguard, T. Rowe Price, Fidelity - and when you leave a job, roll your 401(k) monies into your IRA. Consolidation will make not only your paperwork easier to create a proper allocation mix (and annual re-allocation), it will also be a great relief to your heirs. Yes, I know you're young and healthy, but believe me, it is a LOT easier to keep the beneficiary designations updated on ONE consolidated IRA account, rather than the half-dozen assorted 401(k)s you've created after a while! Right now my nephew/niece and I are beating up on their dad (figuratively, of course!) because he has 401k funds at possibly 7 or 8 companies. I think my sister, his ex-wife, is still listed as beneficiary on most of them. Since she's got a million bucks in the bank and is semi-retired by choice, and he'd prefer the money go to his kids, it seems rather foolish to be risking letting his paperwork go - particularly since he suffered an unexpected heart attack recently! Really, you'll find life is much simpler if you consolidate your accounts. All it usually takes, once you've set up the IRA, is a phone call and a few simple pages to fill out.

You can borrow up to 50% of your vested 401k account up to $50,000. I believe the major drawback of borrowing from your 401k is that you miss out on the compounding of interest. There's no actual penalty other than that provided you pay it all back. You pay yourself back with automatic monthly payments over 5 years with interest (the interest is to yourself as well). Now, I believe that if you're not earning much in that 401k, its not so bad. If the choice is between borrowing from your 401k or a credit card with 20% interest, then I'd go the 401k. But, ideally you should start saving an emergency fund for these kind of things. I didn't check the link to Suze's page, but I know she's dead set against this. I think sometimes she's a bit harsh. And here's an article (excerpted) that just showed up today in the WSJ. Many people hold stock in their 401ks, so this does seem a potential issue. There is simply no telling what the income tax and capital gains rates are going to be at the date of your death, so keeping at least these minimal records (cost basis) certainly wouldn't hurt. The article goes on to point out that Congress can make retroactive changes in the estate tax laws; it's been proven legal as the IRS won the two cases filed against them. Will the Estate Tax Disappear? Changes in the Way Inherited Assets Are Valued Could Cost Heirs and Cause Hassles WSJournal October 22, 2009 Many people hope the federal estate tax will disappear next year, as scheduled. They could be sorry if it does. Back in 2000, Congress enacted a gradual loosening of the estate exemption. It has since risen to its current level of $3.5 million per individual, or up to $7 million per couple. The tax is scheduled to lapse just for next year and return in 2011. Washington insiders are betting lawmakers won't let that happen. Instead they believe Congress is likely to act before the end of this year to extend the current system through next year. And perhaps they should, because getting rid of the estate tax actually would cause problems for most taxpayers. At issue is the "step-up in cost basis" that all assets receive when an owner dies. The way the law is currently written, if the estate tax goes away, so does the step-up in cost basis. That's where the problem lies. Step-up means that the property heirs receive is valued as of the date of death. So if Grandma leaves a grandchild stock selling for $75 a share that was bought in 1970 for $2 per share, the heir's "cost basis" in the stock is $75. If the grandchild then sells the stock for $80, the taxable gain is $5 per share. The same holds true for both real estate and personal property, like an heirloom ring or art. If Congress fails to extend the current system for 2010, then at the owner's death all assets would retain their original cost, called "carry-over basis." Under this system the heir's stock would have a cost basis of the original $2 per share rather than $75. If he then sells the stock at $80, the taxable gain would be $73 instead of $5Âa huge difference. For most heirs the switch to carry-over basis would mean paying far more in extra income taxes than is due under the current estate tax system. Currently only about 5,500 estates are federally taxable each year, because is exemption is fairly high. Carry-over basis would also pose a massive record-keeping burden, forcing multiple generations of taxpayers to keep documents over many decades.

The followup to the previous email is that once you roll it into a traditional IRA, you can then convert it into a Roth IRA by paying the taxes on it.

Generally, the closer you are to retirement, the less attractive this idea is, and 10 years from retirement is pretty close. Making the decision to convert can depend on if this is the bulk of your retirement savings, meaning you will be drawing on this in retirement, or if you might want to live on other funds in retirement, and save this for your heirs.

There are Roth IRA conversion calculators on the Web. As I was looking, there were other articles that made the point that the conversion calculators are only as good as the underlying assumptions. True.

I'm pretty sure he can roll his funds into the 403B. However, there are usually less investment options with this type of plan. This may not be an issue as long as there are some good conservative funds.

I listen to Bob Brinkers Money Talk on the radio and have subscribed to his newsletter in past. Coincidentally, he had a caller last weekend discussing the 403B's. I really like Brinker especially since I followed his advice in Jan of 2000 and cashed out stocks before it crashed in March....anyway...I trust him. He is not a fan of 403B's because of their high fees. I'd rollover the 401K money into an IRA with a no load mutual fund family. If your employer only allows 403B's now, I guess there's not a lot you can do about the new investments. The key is to look at the fees.

also be aware some states, such as NJ, do not recognize 403b's as tax deffered.you must add back in the $$$ you contribute to your state income..found this out the hard way after being audited , and paid back taxes for 5 years

I hate my 403B accounts. I've tried three different investment fund companies and changed investment strategies several times. I'm looking right now to see how much I can roll to an IRA. I will probably even go with a Roth, since it doesn't appear that our tax rate will be going down after retirment age. Might as well bite the bullet now.

My wife has a 403B as well. However, I requested a list of investment company options available that her district does business with. Vanguard was on the list. I opened her accounts at Vanguard directly and have her payroll deductions pointed that way.

I think most arrangements for 403 plans are horrible at best. Most push annuities - which is sad.

My husband's 403 B account is through TIAA-CREF and we have been very satisfied with all the choices we have been offered - and I can change our allocations any time I want to using the internet which gives us a lot of control. This has been a good thing for us.
