Building an addition in NJ, what % should the final payment be?

Hopefully there are others here familiar with the NJ law. I have a proposed contract from the contractor with the payment schedule that goes something like this:

- Work begins - 10%

- Foundation ready - 2%

- Framing begins - 6%

- Framing complete - 6%

etc. ending with:

- Spackle and Trim complete - 6%

- Touch up work 1%

- Final payment - 1%

I've always heard that the final payment should be a bigger amount, we were thinking 10% would be fair. However, I was informed that NJ law allowes to withhold only the value of the work left to be done. So if you have 10 items worth $100 each, you can only withhold $1000 from the final payment.

The contractor is local and got great recommendations so we are very comfortable with him in general but one of his customers did tell me that the remaining items took forever to be done after the last 10K were paid.

Any words of wisdom?
