I pulled them off the website. I was contacted by a lawyer for the E@rthbox Company with a cease and desist letter. They objected to me referring to there trademark name in the documents. Can you blame them? Your designs are not an EarthBox, they are a self watering container loosely patterned after the Earthbox. What company would want random people recommending plans to others using a trade name when the result of those designs had no reflection on the commerical product's suitability? Also, any lawyers out there that would like to review them so that we do not attract any more legal attention it would be appreciated. No need for a lawyer. Simply stop using a trademarked name to refer to your own designs. You can freely use the Earthbox name when you say "This is how the design is like an Earthbox and this is how it differs". This is covered under fair use. To say your designs are a "homemade earthbox" crosses a legal line. Your designs are a homemade self watering container, not an Earthbox. Once your instructions are edited to no longer refer to your designs as earth boxes you have no reason to fear hosting them as you have previously. There is nothing stopping you from referring to your designs as self watering containers because that is what they are. Earthboxes they are not though.

What can I say--I feel you pain. My MIL has been with us for a little over a year now. I have recently quit my job of 9 years to stay home with her. She is 85 and her mobility is not good, confused on a daily basis, short term memory is bad and right now trying to keep her dressed seems to be the new thing with her. All in all she is a joy--pleasant and loveable but a real handfull sometimes. She stayed alone while my DH and I worked for nearly a year. I lived in fear that she would fall or get hurt while we were gone. We came home and found the house full of smoke and we knew we were really pushing our luck with this. She (for some reason) filled a skillet full of oil, placed it on the stove, turned it on and walked into the other room and forgot it. She didn't even see the smoke. She apparently fell asleep cause she said a loud noise woke her up--smoke alarms. And she still didn't notice the smoke. We came in just in the nick of time. I didn't go back to work. The first week I was home with her I was amazed at how good she was at "hiding" her confusion. Somedays she shines like a little star but others not so good and we are having a lot more not so good right now. I'm really suprised she didn't get hurt--we were so lucky. I REALLY miss going to dinner and running to the store or just going somewhere. It seems like my life revolves around how she is today. I miss doing things with just my husband or daughter. We sort of do shifts--one of us stays with her so the other can get out for a while. Like you we couldn't get any straight answers about the legalitys of leaving her home alone--and still can't . I guess we just have to go with our judgment with this. I keep telling myself how wonderful she's been to me through the years and how I"ll be in that shape one day. It's not easy.

Been there. Done that. My family sold to my husband's family. Would never (ever, not in a million years, no way, no how) do it again. We thought were mature and professional enough to make a family transaction successful. We assured one another that we would follow the process as though we were strangers. Nope. We did use an independent appraiser to help with pricing and price was never an issue. The whole thing turned into a fiasco over all the other contingencies that go into a written purchase agreement. However, if I had to do it all over again, I would: 1.Employ a realtor to help negotiate the contract. Our family realtor was willing to help us through this process for a flat fee of $1000 and I think it would have helped to have a third-party act as the middleman and to smooth the various ruffled family feathers. Other family members dismissed the idea as too costly and, boy, do I wish IÂd held my ground. 2. Families can be a bit casual with one another. They donÂt always respect contractual deadlines or live up to handshake agreementsÂafter all, itÂs just family! I think hiring a realtor would have formalized the process and encouraged each party to meet the deadlines set by the contract. 3. If using anything other than a standardized contract, each party should hire an attorney to protect their interests. You may want to let your husband know some of the legal pitfalls of selling to family members. Such transactions need to be handled with care. Please be careful of selling to a family member at anything less than Fair Market Value. The Internal Revenue Code does not allow family members to sell to one another at a discount. Any difference between FMV and the sales price will be treated as a gift by the IRS with various tax implications (which are the donor/sellerÂs responsibility) and you should know exactly what those implications are before proceeding. If youÂre tempted, find a good attorney to advise you about the ramifications. You have rights to the property and they should be protected.
