Please give me advice on SSD benefits re: child under 18

I have a question to ask and if anyone out there knows anything about this subject could they please reply.

A man is collecting SSD. Therefore his child under the age of 18 is collecting benefits as the child of a disabled wage earner. If the man, out of spite, decides to go off SSD just so his child cannot collect anything, can anything be done about this so the young child can still collect.

If this happens, and benefits stop, does the child's guardian have any recourse on the childs behalf?

Is there any order in place for child support? If the child and/or guardian must go on any public assistance because of the loss of income, then the city/state/county would go after the man for child support.

The child's guardian may want to talk this over with the local county social services department.

Fairegold, there is an order in place for child support. The father has not been working so no monies were collected. Now the father is on disability and rather than have any money taken out of his disability to be given to his child, he would rather go off disability and have no money given to both himself and child rather than have a diminished benefit for himself. If this happens, can the child still be eligible to collect any benefits? Public assistance is not necessary.

I have wonderful memories of my Grandmother. Unfortunately, I came along fairly late in life and didn't know the others. You know what I remember? The time she spent with me. I use to spend the night with her and we'd play cards for hours. she didn't have much money and lived with her friend in the upstairs of her home. It was a small upstairs and just right for the two of us. I'm getting warm all over just remembering :-) I have a son that hasn't had the benefits of good Grandparenting and I feel bad for him. His step Grandma is so busy volunteering and doing good stuff for others that all the Grandkids seem unimportant. Her and my Dad have never even had him spend the night and he's 18 now. Too old to care. My husbands side was even worse. From the day he was born they made it clear they were never going to babysit and they didn't. They never built a relationship either. I don't know if your retired or still working, but how special it would be to make time for them during summer vacation or other holidays and spend special time with you. I know when our son was little the pool at the hotel was the greatest entertainment, and it didn't have to be fancy. A walk, an ice cream, etc all willl make memories for that child to hold for the rest of their lives, and it will make them both feel real special. Perhaps you could even be a catalist for the relationship between the grandkids if they don't get to see each other much. I don't have years of wisdom to pass on, just some stuff I appreciated and treasure and regret in the life of my son and his cousins. How wonderful that you cared enough to ask on this forum. I bet your going to be wonderful Grandparents!

She had a nice stable biological system internally and externally. Year after year, she'd get older and grow bigger and there's usually not too much fuss or muss about it. It's nice and predictable and stable. Then puberty begins, bit by bit. 'Hormones raging' doesn't even begin to address the magnitude of the kinds of changes. At 12, she now has this biological capacity to face pregnancy (she probably feels acutely just how young she is). Brain-wise the changing hormonal system will also affect the way she perceives things, and give her some new depths possible for her feelings and motivations. And all that is new and developing. Privacy usually becomes way more important. Issues of autonomy/independence are going to be way more important. The thing is she can 'feel' like an adult, with sensitivities and about 'respect' even though she has no practical experience with how to have those kinds of reciprocal relationships. You can use the exact same language you did when she was 10, and she can feel horribly slighted and insulted beyond all belief now (and act that way). You're an adult and have been for a while probably so you can have the kind of internal and external stability that will enable you to view this as 'she's changed' like she should just change back (or like she could change back). ... Puberty is individual, and people endure and experience it in all kinds of ways personal to them. It is also a time where some disorders will begin to show symptoms which can mimic normal adolescence. If you want consultation about the extent of behaviors you find troubling, or if you worry about what could be abnormal ask her doctor to recommend someone you can talk to (someone who has clinical experience with adolescents). Otherwise, the basic changes described sound normal enough and should not interfere with her or your functioning. the upside is you can probably make more headway now, by applying adult empathy (if you were acting how she acts, were feeling how it seems she must feel, what kinds of things could a mother do for you to help?)

Ours is from Multi Pure. We like it a lot. I found it on a website listing water filters that have NSF 53 certification. Most water filters, if they're certified at all, only have NSF 42 certification, which is called "aesthetic effects"--that means it removes contaminants that make the water look or taste funny, but not all the invisible ones that are actually the worst for your health. NSF 53 is for health effects, so it removes not only the things that affect look and taste, but also the other stuff. You can look on this site to find NSF 53 filters of whatever type you want (undercounter, on counter...) and it shows you what contaminants they remove: http://www.nsf.org/certified/dwtu/ The reason we went with this rather than with a bigger-name brand is because I just couldn't find actual information about the big-name brands. I wanted a list of specifically what they removed, and how much of it they removed. That doesn't seem like a lot to ask, but surprisingly, the big-name brands don't list that info anywhere! That made me kind of not trust them, actually, so we went with one that both (a) provided that information and (b) had been third-party certified (by the NSF) so we could be sure that info was accurate. It was a very easy install for the plumber and my husband could probably have done it himself, but we just wanted it done professionally. The water is great--we did a blind taste test on each other after it was installed, and we could tell tap water from this water, no problem. Our model is the 1200EL, and we chose a brushed nickel faucet--you can get any of about six different finishes. We have a 23" sink at the moment and the unit fits fine in the space underneath. Sounds to me like your boyfriend is feeling guilty because he is unable to spend as much time with his own girls as he does with you and your girls, and his way of coping is to put the pressure on you to spend more time with him and his girls. Your first priority is your girls just as his first priority should be his girls. My husband feels guilty when we go and do something and his son is not able to come and I have to remind him that it's not possible to include his son on everything we do or everywhere we go because he is not with us 100% of the time. There have been times that we've gone on weekend get aways and trips to waterparks and we were unable to take his son, but that his son does those same types of things with his Mom and stepdad... The best thing we can do is try our best to include him on everything we can. That's the necessary evil when it comes to divorce.. Maybe you and Josh could benefit from a counselor who can hopefully help get you both on the right path. Make a point to include his daughters in as many family outings as possible and if it doesn't interfere with your daughters' game go and cheer his daughters on at a couple of their games. Try to plan something with your girls and his girls and you.. Like a girls outing. Let him know that his girls are an important part of your family unit too. Good luck, I know it's not easy.

You probably want to talk to someone expert in dealing with SS--probably a lawyer who specializes in this kind of case. But it would seem only logical, that if the parent weren't collecting SS, and were alive--there would be no possibility of the child collecing SS. Otherwise, every child of every deadbeat dad would be getting SS and that's just not the way the system works.

But do consult a good lawyer who knows the legalities. Maybe there is some loophole, or some other avenue that will help support the child's needs.

Definately start with your local county Family support services first, before you talk to an attorney. Jsut because that will be free, and the attorney will not be.

What you will probably have is a deadbeat dad, and if he's not meeting the child support payments required by court order, then the amount is accruing, and with interest, according to the law. Any income he gets can be garnished, and perhaps assets will come into play... check out the free services available to you first, then a good attorney.

It usually works like this, in my state anyway, the person with the disability will collect and then children also collect under the family account. There is so much money for family (excluding disabled person) that gets divided evenly, whether their are 2 or 10 children.

If he no longer qualifies for SSD, then no they are not entitled to it. Their money can get sent to wherever their custodian parent wants it to go.
