Comments (20)Oh, sorry, the Tomato Race is merely my description for the general tomato tenor around these parts right about now. We like our tomatoes big, amusingly named and EARLY. Early earlybirds planted their seeds indoors in February. Earlybirds start them in March. Nurseries are already fully stocked with tomato plants, even though you can hear customers muttering, "It's too early for tomatoes" as they walk by the displays. It IS too early... if it weren't for Wall O'Waters and greenhouses and sunny kitchen windowsills. ;-) Hey, John, what varieties did you grow around here?!!! I'd be curious to compare your favorites to the current favorites. As for tomato hornworms, I could NEVER cut one in half! Oh, the horror. First of all, it'd probably make me throw up and faint (in that order) and secondly, don't you think they're kind of adorable with their tiny dog-like tails and big round eyes? Did it ever occured to u that the majority of people who have criminal backgrounds are accused unjustly? did it ever occurr to u that the majority of these people were young at the time of the crime....and made bad mistakes without using their intelligence. we all make mistakes....the important thing is change.Everyone has the right of another chance...especially when u really want to change ur life around...i've never comitted no crime....but i'm married to a man who has a horrible past....criminal back ground...bad childhood...but if u meet him you'll notice that its impossible to believe that this man has done anything.My husband is a good father...a good friend....a good husband....and a good adopted son....he's not perfect...but he ain't the devil either...hes just made bad choices....i don't blame him because of his childhood...but i don't see what hes done....cute. i understand him...this man has changed his life around....he has lost so much....but he has gained as well...i believe god gave him an opportunity because hes sees what inside of this mans heart...who are we to judge so blindly...the most sad thing about this is that because of what hes done in his past....we are having trouble finding a house to rent....i've been through so much with this man to know what this man is really about...and i don't understand how naive people can be to just sit there and judge...instead of sitting down and try to find out what exactly is going on.we are good tenants alwayz have been, just trying to give a better life for our two children.....so before u decline someone, take the time to think how would you feel if someone rejected you without hearing your side first...because when i look at the eyes of this man it hurts me to know that its killing him and hes feeling unworthy...and he is worth much more than what people think.....See MoreBreak lease, apt rented but landlord still charges 2 months penal

Hopefully this additional information will prove more useful. I run a program that helps people break their leases, albeit we operate in Arizona. Often we encounter these situations. The issue here is whether or not a there is a 'liquidated damage' clause in the lease that is assessed in lieu of actual potential damages that could be hard to calculate. It is contrary to public policy to assess both liquidated and actual damages. So if your old landlord is attempting to get you both ways, you can argue that the liquidated damage is void. Also, it should be understood that it is contrary to public policy for contracts to contain penalties. Thus, if the break lease fee was characterized as a penalty, you could argue it was void on that basis. Finally, a liquidated damages must be a reasonable approximation of what the damage could be. If it is beyond what could be reasonably expected to suffer, then it could be construed as void as a penalty. I think two months is the outer limit of what is reasonable. You may want to check out the tenant library area of our website, http://aztenants.org/library.htm for other factors that often arise whe people break their leases. For example, issues relating to security deposits often come into play. Because Arizona's state landlord-tenant act is based on the uniform landlord-tenant language adopted by many other states, a lot of the topics we cover may apply to people outside Arizona.
