Need Help with House Wren

Hi folks -

I have a problem with a house wren that has nested in one of our nestboxes. Initially I was hoping it was the Carolina Wren who nested in that box last year, but on closer inspection I know it is a house wren. I saw it bringing grass, twigs, etc. into the box and it has stood on it, claiming it.

We have chickadees nesting in two other nestboxes on our property, so of course I am concerned now about their nests and offspring. I am aware of the house wrens' reputation for raiding other cavity nesters' nests.

I know that house wrens and their eggs and offspring are protected under law. What I am wondering is this: can I check the nest and, if there are no eggs, dispose of it to discourage the house wren from settling in our yard? I of course would not touch the nest if eggs were in it.

Has anyone had to do this, or do you have advice to share?
