No, he can't use that name. The orig is much prettier, BTW. He prob named his and never checked on registering, just DIY kinda thing to make money? Not really caring. That's not right. Have you emailed him to let him know this? Maybe he isn't aware there is one out there already, maybe he isnt knowledgable enuf to know he has to register it? ANd thinks he can call his plants anything he wants because its his cross? I would def email him. Maybe send ABADS an email regarding it?

Daniella, I'm glad you don't think this is prettier than the original because I have a bid for it, regardless of it's name! I am working right now but had to check in while I am loading this huge document for an email, sigh!

Has anyone contacted the seller about the name? I wonder what they will have to say about it?

Mike, it's funny you mention that. I was surfing eBay wishing my weather was warm enough to purchase some of these Brugs he has. I want that Herrenhouser Garten, Painted Lady and Pink Beauty.

I would bet they have no clue that name is taken.

They have been selling brugs on ebay for quite a while. I remember seeing the name on there when I first started coming to the forum. I wonder if they put up the right pic? That looks like a double peach. I would ask them what the parents are if its a cross of their own and ask if there is a mistake since there is already a registered Rhapsody.

That's Mike & Mary, they're good people. I'm sure it was an oversight. I sent them a nice note and I bet they'll want to make it right. I'll keep you posted.

Hey Mike, one more small note: Rhapsody is not registered at ABADS. That list you linked to contains all brug names, both valid & invalid. The ones that have been validly "established" are in bold red and have an "E" for established under the status column. :^)

I agree Mike. We're working on converting the whole thing to a big searchable database, and it will be easier to do more explaining then.
The confirmed or provisional applies to the Breeding set, so Ada's 'Rhapsody' has been confirmed as a Cubensis (versicolor + suaveolens + aurea). To our knowledge though, it has not been formally published or registered anywhere. If anyone knows different, I always love to get more info. :^)

Sorry Mike I missed your other question. No we can't have two different brugs with the same name, and it's my job to help however I can to sort these out the best way possible. If one of these comes down to a serious dispute (which I'm sure this one never would), the International Code of Nomenclature for Cultivated Plants (ICNCP) has rules that are followed around the world in almost all genera of plants. The main premise is that if it can't be worked out amicably, then the one which was published publicly first, in print, in a permanent publication, becomes the established name.
To help avoid these kind of problems in the future, as ICRA Registrar I will do that publication for free for anyone (in The Trumpeter magazine, distributed worldwide), so that their brug name is permanently cemented as theirs.

casacolacreek is the same as tctopcat. My dh and I have bought brugs from them under both Ids and so far every one of the has been healthy and correct when it bloomed. They are awesome.

They are indeed very nice people and very reputable dealers..just FYI their cuttings are Beautiful.. no wimpy green tips just nice semi-hardwood~hardwood cuttings..I have always been very happy with what they send...

I bought a brug on ebay named Texas Pink. But can not find it on any list. And can not find the info on who I got it from ( I have it somewhere ) Has anyone heard of it, I think it is dark pink, I can't remember. Or could it be another one just named themselves?

I talked with Mike Usina (ebay seller tctopcat and Casacolacreek) and he says he is very sorry about the mix up with the name Rhapsody. He said he just named it without looking at the names already in use. He also said he wanted me to tell everyone he is sorry for the confusion. Mike is a wonderful man, he meant no harm. It was an honest mistake. ~Edna~
