Patented plants?

I was surfing around some plant sites and came across this:

http://velvetmandevilla.com/red_velvet.htm

I know it's not about bromes but it seems like an interesting topic for discussion and a lot of people here seem to be knowledgeable about this kind of thing.

Is it even possible to do this? I guess it's the same as it being illegal to copy a cd but it just doesn't translate the same way in my head for some reason. A plants a living thing. How can you put a patent on a living thing thats always growing and changing?

What about seeds? If my plant starts producing seeds do i have to mail them back to the guy with the patent? It just seems ludicrous to say that you can't propagate something thats sole purpose, design, and function (just like all living things) in this world is to propagate itself.

Any Thoughts, opinions, am i just crazy, is it even legal or is this guy just full of it?
