Neighbor Pine Trees Reaking havoc

Hello to all:

I have a issue with my neighbor. Currently, my neighbor has two large pine tree that encroach my property and reak havoc on my pool and my yard. The dropping are pine cones and needles into my pool every summer here in Phoenix AZ. Each year there tress are causing major damage to my pool costing several hundred dollars of repair to my pool each year.

I have asked politely for my neighbor to trim the trees to the property line but they have refused. Then ensued with harassing threats to myself and my family. My neighbor even stated that if I trim the tree on my side of the property line that they will sue me. They are claiming they are entitled to the space on my property "easement by adverse possession". What they don't realize is the damage there trees are causing on my pool, and we can't even enjoy our own backyard.

This is taking the life out of me to try to get this resolved. I love trees and in no way would I want to kill them, I would just like to cut the branches that come over onto my property. I have spoken with an attorney and he said cut the branches up to the property line and let her sue, which I'm sure they will.

I have tried several times to contact them nicely and asked them to help me out and there response was nothing but profanity and vulgarities. The police have told me I have the right to cut up to my property line and should do so. Currently, I had to obtain a restraining order against them from the harassment they have been causing over this ordeal.

I vote for having the limbs cut at the property line. I had a very similar situation with my neighbor and his pine trees. I ended up cutting every limb that was on my side of the property line. It is a uncomfortable situation; but you have the right to protect your property. And should do so.
My neighbor & I do not speak anymore. Great bonus! Good luck!

You can also file in small claims court. Though that may make the situation worse.

You can also file a complaint with the city about a 'blighted' property. We've had to do that a few times with neighbors with overgrown weeds, etc. It's anonymous also, which is a plus.

I'm pretty sure you do have the right to cut the limbs off your property line though.

If anyone wants to know how their advice turned out: A website says we have "Merrimac Fine Sandy Loam". Observation reveals sandy gravel on one side of the property, a thin strip of compacted clay near the road. I did take ken_adrian's advice and contact my county soil conservation office. More helpfully, I found the New Hampshire State Nursery and the New York State Nursery. Great places. I planted three potted Beach Plum which all took. I planted a large number of bare root ones from the county, and a couple seem to be still alive (though it is too early to say). I planted a potted American Persimmon which is doing great, and two bare root ones that promptly died. I planted four paw paw, two of which survived, two of which fell prey to someone's weed wacker. One of the bare root Pitch Pine survived, none of the bare root Blue Spruce. This Spring I planted a number of bare root Black Walnut. One died, the rest seem to be doing great. (Best success rate in "plant and forget) so far. Also planted the NH State Nursery "Christmas Tree Package" of White Fire and White Spruce, which so far seem to be doing well (though it is too early to say...those were tiny.) I've gotten a number of potted English Holly, Blue Princess Holy and Blue Prince Holly, which survived. My transplanted rescue and mail-order potted American Holly have all died. Another of the original, developer planted maples died of wind damage. Many others have lost limbs. No salt issues, just wind.

These are cedars taking over an area of grassland where they are anything but welcome and the photos show how quickly it happens. The deciduous trees will follow and the soil will be forever changed and lost and cannot be brought back to its original grassland state. Habitat and wildlife is destroyed as open spaces fill in. Fires become a daily danger in summertime because the cedars explode like matches on sticks throwing flames across a dry hot landscape that is supposed to be a natural grassland that had existed for centuries. Fire is a natural phenomena of the grasslands. Its a serious and very costly problem in the midwest. The loss of acreage is calculated on a daily basis now and is overwhelming resources to deal with the problem. The same thing is happening in Australia. Its bad land management because there are places where trees do not belong. The cities and towns out here are not close together like in the east. Trees in a city is an entirely different situation but they escape into the surrounding land compounding the problem along with fence lines, roads and settlements. The grasslands took millions of years to develop but can be lost forever in just a few decades. There used to be a literal ocean of grassland, it was a natural wonder that was lost and it continues to disappear. I'm not so sure about the 9 times out of 10 remark. Invasive species are another problem. Its much more complex than the simple much advertised "Plant a tree" solution. I think we have all heard that very public message many times over by now. Other problems get much less attention so that now when someone says something like we need to thin trees in certain areas, people react in a knee jerk way. My heart goes out to you as I read your saga. Here are a few items that may be of assistance, they are not garden related but may help you enjoy your yard and not have to worry about your children. There is DIRT, an internet discussion group that is a service of American Bar Association and University of Missouri Law School that has a real estate focus. Post your story there and see what ideads that have. Ask if there is existing case law that would support your claim http://dirt.umkc.edu/ There is a legal concept of "unreasonable decision making" when a HOA does this, in some states the court will not allow them to restrict your actions. To be reasonable the decisions have to be documented and consistent. Some HOA have buried in them a clause that gives you the right to call for Arbitration to resolve an issue. I will pray that justice prevails.

Oh NewHomeBuilder, Do I EVER know what you mean! Six years ago I announced "No Gifts" for adults. I decorate a large box in Christmas wrap and put it by the front door. Anyone who comes to the house during the season, can't bring a gift but must bring the item I've selected for that year for the L.A. Mission and homeless. First year it was mittens. Second year it was socks. One year, Blankets. Last year I went out on a limb and asked for coats, never thinking I'd get a big response. WHOA....it was the biggest haul ever! Before the New Year we make the drive and distribute. Then go have lunch and talk about and count our blessings. Do our kids (yours and mine) have a little of the same DNA? They notice if I've skimped but I sure don't see them knocking down our front door to come help put it all up or take it down! LOL OK, confesssion time: Beaded Icicles.....Bought those about 7 years ago when Big Lots was closing it's doors in our neighborhood. A huge bag of continuous beaded garland, white or gold for $3. Don't know what I was thinking....I bought 10 bags. I could wrap my whole neighborhood in those continuous strings of beads. Did I mention each bag was a continuous string of beads? :) After a few years of fighting them, trying to get them untangled no matter how neatly I wrapped them after the holidays, I gave up. I cut them into long strands, 3 to 8 inches each, and now use them as Icicles all over the house and tree.

There is no such thing as adverse possession of air space for a tree,you have the right to trim the tree back to your property line as long as you do not kill the tree, if it is damaging your property you may be able to claim for damages from their homeowners insurance as long as you can prove it is their trees causing the damage, their insurance people may then insist on the trees removal.

Well, I live in the California desert (same climate as you), and I don't have suggestions. Just sympathy! I am forever complaining about our HOA, but maybe it's a good thing! A law suit is not fun, but I think having THEIR insurance pay for your damages is a great idea!!

I had an evil neighbor at one time. I got lucky. He got allergic to the golf course and had to move!! He sold to wonderful neighbors! Nothing better than a good neighbor!!

We all have our neighbor horror stories. At one house the neighbor had a large beautiful tree. I planted shade loving plants on my side, and it was just beautiful! Until he sold his house to an icky poo poo who cut down MY tree!! Ruined my whole shady ecosystem!!

I vote for cutting the branches on YOUR side! And good luck with this awful problem!

I am in NY and have the ssme problem but no pool! they are white pines l, roots are above thd ground. our grass us z mess. pine needles and avorns by the hundreds. dpoke to neighbors snd ghey di not care. need to talk to my attorney. what is wrong with people??
