Just planted mesquite is bending over... is it bad?

I posted this a few hours ago and don't see it in the list, and I've done all the suggestions like clearing the cache and refreshing, so here it is again.

Hello fellow green thumbs,

I just planted a Mesquite yesterday that has a bend in the trunk, and I want to know if I need to do something to compensate for the bend or will it straighten out on it's own as it grows larger?

The tree is about 3 ft right now and the bend start about a 1/3 of the way up the tree and ends up being about a 45 degree bend like the tree is top heavy.

The tree was staked when I got it so it didn't look bent over. I don't want to keep it staked unless it's necessary, because I don't want to prevent the trunk from strengthening.

Did I get a lemon instead of a mesquite? ;)
