Murray mower, gears are misaligned and brake is weak

I just got this Murray lawn tractor. It's the first tractor I've ever dealt with. Here is the craigslist ad which is still up as of this posting. http://washingtondc.craigslist.org/mld/grd/770980929.html
It works pretty well but has a couple problems. This is a manual tractor with something like 6 speeds plus reverse and neutral. It has a brake pedal only, when you let off on that, it starts going, assuming it's not in neutral. Hopefully you can answer my questions with this information and the picture. I can't get to the model number right now.
Here are the problems:
It doesn't always engage the gear right, and when supposedly in neutral, it tries to go in reverse very weakly and chatters. Is there an adjustment for this? Where might I look?
Also, when I push in the brake pedal, it doesn't brake fully. It won't stay put on my tilt trailer, when it's tilted.
That's it, any help you can give me would be greatly appreciated! Thanks!
