Is it legal to pull water from a stream?

Our lot is a 3.5 Ac partially wooded lot, backed by a 20' wide creek. One of our ideas has been to construct a living stream within our property, complete with an almost 'botanical garden sized' waterfall.

My thought was, pull water directly from the creek with a large electric trash pump (3" pipe connection") that I already have, feed the 'head waters' pond with creek water, and once the water gets to the bottom of the run, drain back into the original creek. I would also use small pumps to distribute the water from the head water pond around the garden paths as a means of irrigation.

A co-worker said that it's not legal to pull water from a public waterway, even if I'm returning (most of) the water to the same creek.

Is there any merit is this claim? I can't use "wild" water?

Edit: by "we" I guess I mean...ME. LOML thinks I'm insane. My charge is landscape, and soil. She does the plantings.
