Do landscape contractors have insurance on a bad job

I was wondering if landscape contractors have insurance if they do a bad job. Say if a contractor tried and tried to fix a job but doesn't turn out does he have insurance to refund money. I was just wondering thanks

Is this something like failed drainage or other catastrophy or the client simply not liking the installed project?

HI, I dont know what is on the rim, unfortunately. There is a modest amount of heat coming from a single vent near the ceiling. It is inadequate to heat the room. I had hoped that the wall and foundation insulation would be better at keeping the heat that does come into the room. I'll try to dig up what I can at the foundation. It goes down about 4 feet. What kind of waterproofing do you recommend? And what kind of rigid do you recommend? I see some corning drain-mat in another post. Should I add that and backfill w/ gravel? I appreciate the helpful comments. Thanks a bunch. This is not a good situation to be in.

OMG Shannon, my heart goes out to you! Why are so many contractors like this?!? We put off having our kitchen renovated for YEARS because we'd heard so many stories like yours. The custom cabinet maker for our original cabs (16 years ago) was like yours. What a nightmare! What makes me mad is that people give these guys good recommendations when they ~ obviously ~ are crummy at doing a good job. Why?!? Thank heavens there are some good contractors out there, The one we eventually got to redo our kitchen last year was excellent: on time, on budget, always showed up when he/they said they would, honest, reasonably priced and did wonderful, quality work. I feel so badly that you had to put up with this guy during the holidays, too. I hope you and your DH can finish up and enjoy your beautiful home . . . finally! And I hope that you DON'T give this guy a good recommendation! Lynn

Don't feel bad about calling too many contractors. You want to have 3 good bids. That means the bids you consider are from contractors that you would really want to work with. If you take away 2 of the 3 bids because you don't feel the contractor is right for you, make more calls until you have at least 2 solid, comparable bids. To find these good contractors, you will need to actively seek recommendations from friends, neighbors, church people, or some sort of community support network that you belong to. To call blindly, or by looking for advertisements, listings, etc., will not get you in contact with the right contractor. The best quality contractors with the most competitive prices do not spend money on advertising, or try to solicit for bids. This would raise their cost of business significantly. Instead, they have a steady supply of work lined up from referrals. For that they can offer a very competitive price. Best indication of quality is to check on some work the guy did a couple of years back. That is why referrals are the best. The person referring you can show you something the contractor did.

How do contractor liability insurance policies work?

Your contractor should have been able to get the increase almost immediately so perhaps he is stalling for some other reason. You should get your GC to name you as an additional insured on the policy and also get a copy of his Workman's Comp policy. You should also talk to your own insurance company and get an umbrella policy. These are relatively inexpensive because they kick in after you have exceeded liability claims for auto and homeowner's insurance in the event you are hit with a million dollar claim. I think I paid about $125 for my umbrella policy - but you need to have sufficient regular insurance coverage. I also state this because you say you live in a building. If any kind of plumbing issues can flood your neighbors, the liability is potentially enormous. My crazy neighbor flooded all the units below him. People have had to move out of their units while they are repaired - bathrooms needed to be gutted - all flooring had to be replaced etc. Owners of course use their own insurance to get paid immediately but the insurance companies then will subrogate the claims and go against everyone involved with the flood.

Insurance coverage is available for many, many different professions, including landscapers, though the extent of coverage depends on each individual insurance contract. However, the existence of coverage or lack thereof has no bearing, for example, on the recourse, if any, a homeowner may have against a landscaper. If you have a cognizable claim against a landscaper, then you have it regardless of whatever insurance coverage the landscaper may have.

Yes, deep pockets is a good thing, but the benefit is dependent on the insured putting the carrier on notice of the claim or the claimant getting a judgment. With small jobs, the deductible is often higher than the value of the claim so insurance never comes into play unless it goes into litigation and the carrier has to pay for the defense. Many small business owners choose not to turn small (pre-litigation) claims into the carrier unless and until they are sued.

It depends on the state in which you live. In Oregon, Landscape Contractors are licensed and bonded. We must have a 10 point contract with the customer which details what work is to be done and how much it is going to cost. If you have a problem, call the contractors board and follow the steps.
