Definitely not the raspberry. Looks like wineberry to me too.

The labels might have been mixed up. It's hard to see the label on the one beyond but it looks different.

Hmm just not sure why any grower would sell a potentially invasive plant and lie about it? I love wineberries because of their tasty fruit but people not knowing the nature of this plant who plant this will run into trouble.. I am not sure about the labels being mixed up because those plants were clearly grown in those pots and I'm pretty sure anyone in the industry in NJ would be able to identify a wineberry. But they didn't want to sell it as such because then no one would buy it.

There are a number of vendors selling this plant, including several east coast locations, so it must still be being grown for retail sales. Nursery plants get mistagged....a LOT!! It is not intentional but the speed of production required by a successful growing/selling operation at this time of year means accidents happen and mistakes are made.

If it bugs you that much, just bring it to the nursery manager's attention.

Then that makes sense that they were mistagged. I had no idea some nurseries sell this plant as I thought this plant may have been banned since I've never seen them for sale anywhere. Its not that it bugs me, I was just very curious because I didn't know wineberries were actually grown for retail. In fact if homeowners can learn about this plant and be responsible for it then I would say this is a great plant to grow for its fruits. They are very tasty(better than common raspberries imo) and indestructible unlike many rubus idaeus cultivars that are susceptible to fungal diseases.

I would surmise cock-up rather than conspiracy.

Here's wineberry taken today from a weedy roadside thicket. Am happy to say none are growing on my property. We do find them in unkept trash heaps and abandoned lots.

OP please provide a citation showing this plant is "banned" in your state. You have posted here many times, you are aware that nursery stock changes hands many times before it reaches the retailer right? Ask your questions to the vendor and get back with us with your answers.

I said 'I thought this plant may have been banned'. I wasn't even entirely sure, just thought it may be because I have never seen this plant sold at any nursery but most other raspberries are being sold. Seeing some of the plants in the invasive species list being very commonly planted here I guess means most(if any) plants aren't banned in NJ. I see search results for invasive species but not banned species.

You're correct: there's no official "banned for sale" list of plants in NJ. It was proposed in recent legislation but vetoed by the governor:
