What do you mean by " now" ? Has been since Barr's appointment. I suspect this particular judge will have some tough questions for the prosecutor. Not that it will matter much Trump will pardon Stone as part of his " reward my loyalists and punish my critics" policy.

The DOJ is also deciding whether to charge Eric Prince for lying to Congress and violating export laws. I doubt the DOJ cares if he lied to Congress. There’s one court for them and another one for us.

Remember those separate but equal branches of government that we use to learn about in school. You can kiss them goodbye. However, now that all bets are off, I will immensely enjoy watching the same things happen when a democrat gets into office. What is it they say about the toothpaste and the tube? Or is it about Karma and her beyatchiness?

It is clear to me that there is a huge flaw in the Constitution which happens when the president and the senate are of the same party. If the president acts in bad faith and he gets the Senate to go along with it, there does not appear to be a check on his power as long as the AG is willing to go along with it too.

Trump is becoming the precedent President. Which is what many who voted for him wanted - an outsider who would come in and shake things up.

Funny how the time that for many the government had really gotten out of control came during the tenure of a partly Black President.

We the people are at fault here. We are supposed to do better than elect a Trump into office and we sure had an opportunity to put a restraint on Trump by unelecting the GOP Senators who were up for reelection. We the People actually increased their numbers so we get what we deserve. Everyone who thought someone else was going to make sure of the election for them? Guilty. That is the operational check and balance. It is our responsibility and we failed.

patriciae: Problem with that is that many tiny little states get two senators and most of those states are republican. This means that the senate will be republican unless some of those smaller red states can be turned to blue states.

Shuffling of personnel in DOJ to obtain what Trump/Barr want.

From the WaPo article:

"Front-line prosecutors, some previously from Mueller’s team, argued for a prison sentence on the higher end, while their bosses wanted to calculate the guidelines differently to get to a lower sentence. The debate centered around whether they should seek more prison time for obstruction that impedes the administration of justice, these people said.

In the end, the office filed a recommendation keeping with the line prosecutors’ goals, and rejecting the lighter recommendation sought by their superiors, the people said.

Hours before the filing was due Monday, the new head of the D.C. office, interim U.S. attorney Timothy Shea — a former close adviser to Barr — had not made a final decision on Stone’s sentencing recommendation, they said.

It was not clear what was told to Barr or other Justice Department leaders about the final recommendation. The senior official said they were led to believe the recommendation would be lighter than what was ultimately filed.

Shea took over as the interim U.S. attorney in D.C. only last week. He succeeded Jessie K. Liu, who stepped down pending a White House nomination to serve as Treasury Department undersecretary for terrorism and financial crimes.

While Liu’s nomination was announced Jan. 6, it was somewhat unusual that she departed before a Senate confirmation hearing was scheduled. Moreover, the selection of Shea to replace her was outside the norm, as it bypassed the office’s veteran principal assistant U.S. attorney, Alessio Evangelista. In the past, the principal assistant has often been elevated to serve as interim U.S. attorney.

It can be common for prosecutors to disagree about sentencing recommendations, especially when it comes to politically sensitive cases. It would have been unusual, however, for the U.S. attorney’s office to endorse a sentence below the guideline range after winning conviction at trial, according to former federal prosecutors."

Re Flynn,

The new submissions are signed by an assistant U.S. attorney in Washington, Jocelyn Ballantine, who has helped handle Flynn’s case since Mueller’s office shut down last May. The filings are the first in the case submitted under the authority of Tim Shea, the new, interim U.S. attorney for the District of Columbia appointed last month by Attorney General William Barr.

I think this comment is very interesting:

"Keep in mind: the longer Stone's sentence is, the more likely he is to try to offer *additional info about Trump* to reduce his sentence and the more likely Trump is to feel compelled to shamefully pardon a co-conspirator. Barr is throwing Trump a lifeline . . . "

I just read this on Palmer Report. Hopefully it's correct.

The media may try to scare you into thinking Trump and Barr have magically reduced Roger Stone's prison sentence. But nothing works that way. Judge Jackson won't play along with it. She'll give Stone the exact same sentence she was going to give him.

Roger Stone prosecutor quits after DOJ says it will cut Trump ally’s recommended prison sentence

  • A federal prosecutor who played a key role in the case against President Donald Trump’s ally Roger Stone dramatically resigned Tuesday shortly after the Department of Justice said it will force prosecutors to cut their recommended prison sentence for Republican political operative Stone.
  • Aaron Zelinsky’s resignation as a special assistant U.S. Attorney in Washington, D.C., was announced in a footnote of a legal filing notifying the judge in Stone’s criminal case that Zelinsky was withdrawing from that case.

You are mistaken. There was no coup. It failed. Participants have been identified. Some might even be held accountable. President Trump was not going to let a few corrupt insiders chase him away. We can all be grateful for that.

By the way, it was Nancy Pelosi who demonstrated how to show respect for historical documents. When you're given the honor of serving as Speaker of the House, and have a copy of the SOTU speech handed to you by the President of the United States, show your strength!

Grit your teeth and mumble to yourself while tearing it up in front of the American people. That'll really appeal to the "deplorables."

Nonsense. You do realize that there are other copies of the speech, right? And things called copy machines and even printers. She could use it as toilet paper if she wanted to, there are more "historical" copies than the intact copy she was holding.

Actually, if someone had the presence of mind to pick the pieces out of the trash, then the ripped up version would probably would be "historical" from a history curator's point of view. Way more historical than the intact version.

ETA: There might never be any "historical" Trump documents since he and his staff won't share them or actually destroy them. I don't think he's that much into Archives.

The AG is the United States’s attorney. It is the job of the AG to represent the United States, and when necessary the Office of the President.

The person of the President hires his/her own attorneys for personal or official matters, as we saw in impeachments and as demonstrated by Rudy Guilliani’s work in the Ukraine. The various AGs represented none of the impeached presidents at their impeachment trials. And Rudy represented Donald Trump rather than the President of the United States when in Ukraine.

Bill Barr represents the entity which is the United States, not the person who is Donald Trump.

If the President was charged in international court or the office of the president was sued I would expect Bill Barr to represent those entities. If Donald Trump personally is charged or sued, I would expect him to hire his own lawyers.

Neither the President of the United States nor Donald Trump should have any say in sentencing a convicted felon. It is well beyond his purview.

I don’t know how anyone could seriously make the argument that Donald’s opinion on the matter wasn’t taken into consideration by the DoJ in this case.
