California State Assembly

SoFLUSA

The California State Assembly on Thursday passed legislation mandating that all presidential and state gubernatorial candidates release their tax information in order to appear on that state’s ballot.
The bill, SB 27, passed overwhelmingly with a 57-17 vote, ABC 7 News reported. The legislation will require candidates to share income tax returns for the previous five taxable years with the California state government. That information will then be available to voters on the state’s Secretary of State website.

Republicans are the ones who claim that only the states can set election standards.

I wonder if this could affect down-ballot voting. If they can't vote for Trump, they may not bother to vote at all.

Good question, Margaux

I wonder how the SC 5 will try to twist that they can rule on this state issue.

I'm still pondering this. If and when other states start following suit, that is where the real strength of this lies. In the meantime, how will this work for 2020? trump is not on the ticket, so Californians can vote for the Democrat or an Independent if there is one. It won't cause any would-be trump voters to change their vote unless they vote for the Independent out of spite, so that is a backdoor vote for trump. ? Longterm, yes, absolutely. If it bites us in the short term, trump will have us all marching like Kim's little toy soldiers.

Write-ins, leona. All it will do in a blue state is piss off Trump because he'll get a smaller popular vote total.

My ignorance may be showing here but I really don't know this and can't seem to find the answer - Has California ever been needed for a presidential candidate to win the presidency? Or has it already been won by then?

Usually by the time BC ballots are counted the Prime Minister has already been chosen.

Yes, it's important. It has 55 electoral votes.

I have a feeling that this will be found to be unconstitutional since the constitution lays out specifically the requirements for running for president. But we must find ways to waste our time when our streets are filled with the homeless. At least they aren't using plastic straws. Maybe they can all just impale themselves on metal ones.

The Constitution gives the States exclusive powers to ADMINISTER their elections including rules covering who and how one applies and is approved to go on the ballot.

I think there are likely powerful arguments for and against this. Hard to say which way it goes, depends on the basis of the arguments. We'll have to wait ans see but one thing is for certain...it's headed to the Supreme Court.

It's sad that we have to force what should be done willingly by any President with even a shred of integrity. It's important for the American people to know that their President isn't financially compromised.

(Holding public officials financially accountable to prove they are not tax cheats or crooks is a waste of time?)

Since most of Trump's schedule seems to be "arrive" and "depart" every hour of the day, I've concluded that this is a plot by his WH people to keep him continuously "busy" and feeling important-- when he is actually being kept "out of their hair" back at the WH!

That way his WH people can do what they gotta do without worrying about Trump contradicting their decisions all the time.

Governor Jerry Brown vetoed the same nonsense back in 2017.
“Today we require tax returns, but what would be next?” Brown wrote in his veto message. “Five years of health records? A certified birth certificate? High school report cards? And will these requirements vary depending on which political party is in power?”

I say go for it. Let's try it for 2020. It only applies to the primary so it's a win win for President Trump who doesn't count in this silly state anyway. I want to see the tax returns for the past five years of the endless list of Democratic hopefuls. LOL

A good idea

Lawmakers in 18 states across the country, including New York, Illinois and Washington, have introduced bills that would require all presidential candidates and their running mates to release their individual tax returns in order to qualify for the presidential primary ballot, according to the National Conference of State Legislatures.

Even if Trump is unopposed in 2020, he will still have to appear on the Republican primary ballots. Primary elections select delegates to the national conventions.

Primary elections select delegates to the national conventions.

Partially true but that is only one method. Ever hear of a caucus? Also in some states delegates are pledged to vote for primary winners in others they are not. National Conventions are held by the Party to choose their candidate. Unopposed means unopposed. He is the choice. The Republican National Convention for 2020, as things stand now, will just be one big celebration.

People really need to take a Civics course if it wasn't offered in high school.

The Constitution gives the States exclusive powers to ADMINISTER their
elections including rules covering who and how one applies and is
approved to go on the ballot
.

Let's read the Constitution

Article 1 Section 4, 1

Section 4

1: The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.

There's nothing in that clause that allows States to make rules when it comes to elections for the Executive Branch.

Also, the Constitution says that Congress, not States, can alter the regulations.

Sometimes you actually have to read the Constitution to know what's in it and not rely on opinion pieces.

Governor Brown vetoed the legislation last time because he knew this would backfire on Democrats. It's unlikely a Republican President is going to gain electors out of California anytime soon, so likely they won't even bother trying.

The irony is that Democrat politicians want people to think they have less money than they actually do, while Trump wants people to think he has more money than he actually does.

And the "popular vote" statistics for the country will no longer become a valid gauge, since 12% of the country's voters will not have even been able to vote for one side.

Its actually worse for Republicans if it is a primary. Although they stand zero chance of winning California in a national election, a primary opponent to Trump , like Wells , could pickup primary delegates. Same wth the other blue States adopting this law.

Interestingly I heard Wells say yesterday that several Democratic organizations in late running States are saying they will switch to Republican and vote for Wells, against Trump in the primaries if it is clear the Democratic front runner is well established. Similar to what Ann has talked about.

Stands a snow balls chance but it is interesting.

Switching parties to vote for an opposing party candidate would only work in states where delegates are pledged to vote for the winning candidate.

And there is this:

Not sure I agree. While Wells would wipe up in States like California he could also erode delegates in States that allocate proportionately.

I'm not saying this would be a successful strategy, don't think it would be , but it could be very successful in blue States.
