HELP! Gel stain debacle - stair banisters

We hired a guy that specializes in stair railing to sand and stain our red oak banisters darker. He swears by a technique of brushing on the stain with a bristle brush and then brush again with a dry bristle brush. It has created a very streaky look. He refuses to apply or at least wipe with a cloth or stain pad. He is using Bartley Gel Stain - Jet Mahagony.

Part of the job is 'done' though not finished with a water based poly. We are planning to go DIY.

1) How do we remove the stain that has been applied? We are planning on sanding it and the other parts of the rail so we start with the same baseline. Advice on this (sand paper, technique, mess)?

2) Advice on applying the Bartley stain? (technique, number of coats, drying time, brand of poly)

3) Mess / clean-up as we have newly finished floors on the first floor, new carpets coming in, and whole house being painted

We have 1.5 days this week and 2 days next week to finish this. We must get any sanding done ASAP because the whole house is getting painted next week as well.

Any help would be really appreciated!
