Just wondered about sales tax, do you collect it for CA?

Hi! I'm looking for the same info; I'll let you know if I find it. But what I can tell you is that in 1996 the U.S. Supreme Court said a business (retail included) to have some physical presence in a US State to charge sales tax. These were the halcyon days where you could buy L.L. Bean boots tax-free, unless you lived in Maine. But in 2018 the U.S. Supreme Court overruled this case ("Quill") and made a new rule: no physical presence or sales people or stores were needed. An online purchase is now required to have sales tax based on the number of sales mailed to a state and the annual dollar amount of sales to that state. What shocks me now is that pretty well-known online fashion shops/websites are not complying with that rule. I owe sales tax - it's unthinkable - just on my favorite store, Yoox.com. There is, in every US state, an exemption, but that has to do with having, like, less than 200 customers in a year or fewer than $100,000 in sales of things shipped to a state - this is the new rule that applies to South Dakota, in Wayfair v. South Dakota. The best thing to do is look at your own state's official website, the part about collecting sales tax, to see what the minimum exemption is. Ok, now I'm going to see what Houzz does. In CT if they don't charge sales tax you still have to figure out what the tax would be, and pay it, under threat of audit. It sucks:(

Ok - what I did was make a fake order, a blue area rug. My delivery address is here in Connecticut. The online order form automatically added CT sales tax. So if you do the same, and make the delivery address in California, you can see if they automatically add tax:)

I have had just the opposite experience. I have had people just throw hissy fits when I priced my stuff and then calculate the sales tax. Some of them argued me, and when I didn't back down, just walked away and went to a different vendor who didn't do it legally and paid more than they would have with tax. Some of the "regular" market crowd here are there for a bargain and are used to shopping with backyard vendors who don't even claim their plants as income, let alone pay tax. I've also had them wink at me and tell me nobody needs to know. I wink back adn tell them I like to sleep nights and tack it on anyway. LOL. Sales tax isn't something to mess around with. If you sell a taxable item, you tax it. I list my prices on a white board now with the "final" price and put at the bottom in small print, sales tax is included. And it is. And they seldom notice and haven't asked since. LOL. Yes......when you have a line waiting service, and are trying to do it in the field with a calculator instead of a register, it helps to know the after tax figure.

Truth be told, there is no such thing as not paying sales tax (legally) unless you live in one of the few states that do not have a state sales tax (NH, DE, AK, OR, MT). Where a merchant has a presence in a state, they are required by law to collect the sales tax as the agent for the state. When a merchant does not have a presence in a state, they are not required to collect the sales tax however that does not let the purchaser off free and clear. In all states except the five above, there is a USE tax where individuals are required by law to report their out-of-state purchases and pay that use tax which is equal to the state sales tax. You can find this use tax as a line item on virtually every state income tax form. Now, most people don't pay the use tax and its largely unenforceable. However, people who are career politicians, work for the Justice Department, or are in certain aspects of law enforcement usually will pay it to stay squeaky clean. It can come out in an audit and depending on job sensitivity can mean a difference in whether one is breaking the law or not. Businesses are more likely to be audited, so when they buy so-called 'tax-free' out-of-state they need to be more attuned to deciding whether or not to declare and pay use taxes. At the end of the day, its not really 'tax-free', its that most people ignore the use tax and don't pay it. Duane Collie

I hear you WC, our city council spent $300,000 (unauthorized by voters)to study the "aquatic park" when $300,000 would have majorily improved one of our ageing summer only pools that had to be closed last year. The new proposal is that the ageing pool be rebuilt and covered for year-round use(with many up-grades), and up-dating the other outdoor summer only pool. I personally think that the residents will approve that plan as I do. And, added to our real estate taxes. It also occurs to me that there is a huge cultural and historic difference between those communities in the Eastern states and those here in the West. DH went to Syracuse University in the late 50's and we were so shocked at the school systems back then. We also lived in the greater DC area and North Carolina over the years and found them so 'different' from what we knew as Californians. We never paid for a book and other supplies, so were surprised that families in New York had to. Many things have changed here in the west especially since California's prop 13 (another story) so changed the more scocialist leanings. OUR expectation of having government supplied services is just different...I believe, so maybe that allows us to be more willing to pay the piper. Just thinking.
