I get the impression that the photo is taken from your front (or back) door and the flooding is limited to the sidewalk. is that correct? Sump pumps and french drains are usually added when a basement floods. You have not mentioned any flooding inside your house and it appears from the photo that the majority of the water is going away from your house. Is that correct? (If not, you have more 'splainin' to do, as Ricky Ricardo would say.) It is not clear why the water isn't draining off the sidewalk and into your little garden. As a first step, I would suggest simply aerating the garden. If you have red clay, you would need to add sand, peat, and compost. This should give the water a more porous surface to drain into. BTW, if you basement is leaking, the water is not coming from the sidewalk in the photo you posted. Please provide more information. Thanks.

You need to get this fixed by the builder. Has the inspector seen this, you need to contact them possibly and point that out. My nephew had a new home built. It passed all inspections. Of course turns out inspector was good buddies with builder. After they moved in before sod placed he called builder (home finished in February in Minnesota so snow on ground) because he was concerned about how close the sod would be to siding, maybe basement brick foundation had dirt to high. Build said it's fine said he came out band looked and shouldn't be problem, ground will settle. Builder just didn't want to move dirt and regrade. Nephew didn't like that so friend has a bob cat and regraded himself and has sod placed. We'll come rainy season sump pump never shut off. Called builder, ignored. Had to get lawyer. Builder said well you regraded so warranty void...more lawyers, settlement. Basement tore up drain tile was totally messed up, regraded, rebuilt part of house with settlement..... Be proactive, make builder fix, get inspections. Would insurance cover damages if problems with this down the road?

@worthy the tube runs about three feet away from the home into a pit lined with drainage cloth and filled with stone. That pit has clay soil all around it. Based on experience with the most severe rain, I think the pit will handle the load. If this were a new construction home, I would probably want a french drain system on either side of the house running downslope all the way to the street, and I would want to tie all of the downspouts into that drainage. This is an old home and it is not cost-effective to do that. I just do not want a lake up against the base of the home during heavy rain, and this new system should prevent that.

I agree 100 to 200% with krnuttle on regrading instead of resorting to the band aid of a French drain. At least, at least, at least get estimates from several landscapers in your area. They will come out and wave their arms around and explain the problem to you. They will tell you how much soil needs to be removed (or, sometimes, brought in) to fix the cause of the problem. Assuming they have access to the area, a talented guy on a tractor with a box blade can fix a yard that size in 30 minutes. Whereas even the most talented guy on a skid steer or bobcat might take 3 days to get it right, so ask about the equipment they plan to use. When I was in college I picked up extra cash working for a guy who drove a tractor and did finish grading, so I've seen your problem before. He was not a landscaper per se, but when he left the land was ready for seed or sod. My guy worked commercial projects like entire neighborhoods where the water had to flow from each unit to the street and not onto adjacent units. Look for someone experienced, and see what they tell you.
