Looks to be a black swallowtail, anyone agree?

Do the males and females look the same? I wasn't sure because all the photos I see of the black swallowtail they have blue spots. I guess it could be poor lighting.

I am no expert but the female is more colorful than the male having more blue.

It's a spicebush swallowtail. You can tell by the blue 'rocket' in the upper line of orange spots. I also can't see the tell tale 'eye' (red area with black center) that's at the bottom of the forewings of black swallowtails that you can usually see on the underside. I can't tell if it's a male or female, because the top's not visible.
