I actually looked into adding this plant to my sale inventory at the nursery because it seemed it would be very profitable if it was legal. I decided I wanted nothing to do with it. Here is why: On the legality of Salvia divinorum. It is not against any "federal" law to possess & grow or even consume this plant at this point, though the DEA would like to see it included on the Federal List of Schedule 1 controlled substances and has issued a memorandum suggesting it might be prosecutable under the Federal Analogue Act as being a hallucinogen similar to others. That has not been tried, but would probably be overturned on appeal if it were as there has to be proof it is pharmacologically (sp?) similar and there is no such proof at this point. It is, however, technically illegal to sell this plant, its extracts or its seeds for the purpose of consumption as a drug because all such items (food or drugs) are regulated by the FDA and must be approved before selling them is legal. At this point they list this plant as "not recommended for human consumption". Those that sell this and other herbals can sidestep that neatly though by offering it as a dietary supplement, which the FDA will not touch. Same reason you can by herbs over the internet that will supposedly "melt off the pounds" or make parts of your larger. So many companies do sell it as a dietary or herbal supplement and until it is declared a "drug" the FDA won't do anything but issue a general warning. I don't think it will be all that long before the FEDS decide it needs to be added to the list of controlled substances considered illegal to possess without a prescription or permit for research. Keep in mind that even though the FEDS aren't currently considering it illegal, there are several states that either do have, or are considering legislation that would make either the possession or use (or both) of this plant a crime. At this point, the plant or its extracts are illegal to even possess in Illinois, Missouri and Tennessee. In Missouri possession is a felony. In North Dakota and Louisiana it is illegal to possess this plant or its parts with the intention to consume it, but it is legal if you grow it in the garden for decorative purposes. (One wonders how they think they could tell the difference?) This list may not be all inclusive as there is legislation pending in several states, including mine (Georgia). I would highly recommend you check your state statutes before deciding to put it in the garden even for its beauty. Who needs the headache of hassling with the authorities over it. Hello, I'm new to this so im not sure how this trading site works very well... I'm wondering if you happen to still have some Salvia Divinorum plants... There one of my favorite plants it would mean alot 2 me if you could help me out im from Massachusetts were it's legal. I had some way back in 2006 but spider mites killed em. The only place I can find em is on sketchy sites I don't trust. I'm new like I said so im not sure how good I am at mailing plants but I just planted a offset of a Blue Crown Passion Flower vine 2day in a cup aka a baby one. Im just a noob, but I heard that seeds are WAY rare. People trade cuttings. BtW Im looking for a a cutting aswell!

I think that Horizon Herbs (now called "Strictly Medicinals", sells Iboga, but not totally sure about that one.
