HUGE remodel started, problems with plans..advice pleas

We started a large remodel (1300 sq/ft addition plus remodeling current 800sq/ft including existing bath and kitchen) a month ago. We used a draftsperson as opposed to an architect to save money. We had a clear idea of what we wanted in finishes and layout. When she designed our single level addition we repeatedly asked "what about the grade" as we have a sloped lot. She stated it would easily be made up in excavation. We interviewed three contracters who all stated we infact would need some stairs from the added garage down to the addition or raise the existing house 3 ft ($$$$). The contracter (who we love so far) states that she did not fulfill her fudiciary (sp) responsiblity as a draftsperson. We have encurred additional cost in concrete for the foundation as a result. He did not charge us the extra labor and excavation cost because he bid the job aware of the issue. Do we have recourse? Do we just chalk this up lesson learned for first (and last time) remodelers?
