As you put it, after all you've been through the past two years, this is a tiny blip on life's radar, HOWEVER, that being said, this does not make what they did acceptable in any way. In addition to kicking someone's arse, I'd be inclined to "share" this occurrence with all the other lovely folks you've met in the industry since taking on all your kitchens - I'm sure with all the people you'd educate about this place, their business would take a bit of a hit! Not a solution but cathartic in a sense....

Rest assured, heads will roll. My KD's husband owns a granite business and I'm quite sure he'll be happy to see me fixed up if necessary. It's just such a pain because this was the ONE area I just knew KNEW was going well, no worries...easy sleezy....I guess I got the sleezy right anyhoo.

It happened to us too - they allowed someone else to take the 4 slabs we had paid for, and had our name/invoice# written on the back. They conviniently blamed the guys who load the truck claiming those guys were bought off to load our labs... PO'd were we! The mistake we made was that we waited for the weekend to pickup the slabs - 3 days!

After watching the checkout procedure involved I told them someone up the chain must have colluded... because they always check the invoice # with what's written on the back. The guys who load the truck are there just for the menial/mundane labor. We were lucky to find slabs in a new batch that showed up later.

Moral of the story - if you like something, and are ready to pay for, be prepared to pick them up right aways...

Now I've read the other posters...didn't realize this is common?! Yikes. Each slab is so different.

They have emailed me (I asked for that...they're dumb enough to write out their mistakes for future purposes) and said that they have a slab of vulcan gold in seattle waiting for me and they can get white marble any time.

I'm really ok about this...it's something I can remedy easily, but I really had designed around that stupid granite so it's frustrating. It's a good humbling moment...I've read and felt great pity for the posters who've had this problem and thought "those poor people...they didn't check out who they were dealing with obviously" well that's not quite the case is it? Now I'm in the group with the silly fools :oP and probably, just like them, I did check the company out. Honestly, I know they're a small firm and I think money got tight, and they thought they could get away with selling mine and replacing later. After all, who besides a TKO would even know? She told me "people are nervous about ordering from pictures but everyone loves it when it shows up" well sweetie...I'm not "everyone" I'm TKO and I want to touch the crap before I agree to take that exact slab.

It's just silly rocks. But it does make me want to take a trip to Florida and make sure our cord blood is still there with our name on it :op Gad knows they've probably given it to some other parent instead...and they now have the blood of my son running through their son's body...and want to shoot themselfs :oP heh heh

I gasped reading your initial post! I would be blowing a gasket about this. You mentioned cancelling the Visa payment. Don't do that just yet. The price of stone has gone up since you paid for these slabs. See what they have to offer before you decide to pack up and shop elsewhere because you would be paying more now.

This is horrible, horrible, horrible. The wineries are having thier spring tasting starting today. I am on my way up with several bottles of white and red. I am even throwing in some port as well.

I am so sorry. I know that doesn't even help how you feel. I have read about stone yards doing this on this forum. I am so sorry it happened to you.

I am so paranoid now, I am at the stone yard every week visiting my granite and checking to see that floor samples, paint, etc., go with it. I would have a team of lawyers with me with big legal sticks if they tried to pull that on me. Hope you are able to resolve this issue quickly and to your satisfaction. They should give you the slabs for free!

This is something to consider when selecting a fabricator. Ours went and picked them up asap and held them for this very reason. I thought it was a sales pitch at the time.

When my templator came (and the granite yard did the fabrication for us) he said -so which color are you going to go with. I said I picked out slabs of Santa Cecilia Gold in the yard and the also promised my husband that they would not use the larger blob of grey on our counters that one slab has on a corner. The templator said -oh you didn't change your mind? You can pick any color still just tell me the name! HUH? Obviously I didn't get specific slabs that I was promised. But I love my granite installed and am very happy with it. I did however change my entire backsplash after the slabs were installed b/c it was such a different shade of the color I had picked. My contractor refused to order my backsplash tile until the granite was in-kept saying you need to see it in your house in your lighthing before you pick your splash???? I thought he was crazy-and then was SO glad that I waited to order. Shady companies out there-everyone trying to make a buck. It's like if your husband picked out your specific diamond for your engagement ring and then when he went to pick it up in the setting they had given him a different stone-but it was the same shape and size so that's okay right? NOOOOOOO
Hopefully this will all work out for you ig-chic...for me it did...but it was sort of a huge nightmare process of repicking a backsplash and changing my picture in my mind of the finished look.

Hmmm...Reading this got me thinking. Would it be apporpriate to write in a contingency into the bill of sale that if the original slab(s) were sold, the customer would be entitled to some form of compensation like an extra discount? Of course I'm assuming the vendor would sign off on this too. If they didn't, wouldn't that be a huge red flag? I'm about to embark on a remod myself and one of the best pieces of advice from this forum is to get EVERYTHING in writing. I'm taking that to mean even contingencies.

If you do lose it and off the granite guy, I'll stack the jury with TKO individuals and we'll get you off with justifiable homicide.

So I was taking it all well until last night as I was lying in bed not sleeping, trying to think of how to solve this issue. The first thought was "opportunity strikes" I love the look of antiqued granite...maybe I'll switch out to the Nordic Black antique we're doing in the entry and on the hood.

WAIT My little brain says...remember those hand made subway crackle tiles you had colored specifically for you...to exactly match your granite? Remember you can't return them? They're custom for you? Remember that they cost over $3,000?????? Remember all of this stupid? They exactly match the gold in your granite so that they won't be a feature but will instead take a back seat to the other features in your kitchen? Remember that this kitchen has been designed to the umpth degree of fantasticness and it only takes one mistake to teeter it off into just plain CRAP! REMEMBER!!!!! (ok I quit screaming at myself then cuz I didn't want to wake the baby). :oP

So here's the problem with Vulcan gold...first it's expensive and a bit rare to find (not the most rare thing out there...but it's had to find). And this is a vulcan gold from 2006...

Lots of movement, but tempered with the large amount of white and gold and black, pretty equally scattered in the granite. This was pretty much what vulcan gold looked like when I purchased my slabs. The gold is very rich amber and it's fabulous. Mine was a tad bit more gold than what you see here (though that could just be the computer translation).

Move forward to 2008...vulcan gold that is coming out now is much darker:

It's gorgeous, dramatic, etc., but too much for my kitchen. I'm doing two counters...one stainless and the other three are this vulcan gold (or were) There's a lot of drama in my kitchen design, but there isn't room for this level of drama. Ya just can't step over the top quite that far when the other pieces are also pushing the limit.

Vulcan gold is only known as vulcan gold msrose :( It's hard to find and I was really excited NOT to find it in many kitchens (the one I posted is the only shot I've ever seen online at all!)

I'm not cancelling the credit card yet...because there are dramatic differences in pricing. Today I'm calling the slab yard and asking what's up. They're a separate business and they have a fantastic reputation. I honestly think that the people who screwed the pooch here is my fabricator. They knew they had some time before I was ready...I think money got tight and they thought it was going to be an easy switch. That's the only reason I can see that they would offer to ship a slab up from Seattle when we have a yard...the one they claim sold my granite...right here in Ak.

Mystery :) You're a dear for offering to view the granite (and I know you'd actually have fun LOL) but I'm going to force them to pay for granite I can touch right here. It will be a challenge to replace this stuff...but we'll see what I can come up with.

IG, I feel your pain, really...really!

The last house we built had no problems, no hitches, nothing.

The one we just finished this November, pushed out because of other problems, has been a complete cluster..

I designed and decorated and bought $$$$ all around my granite. When the time came to have it installed, the builder said "oops" the sub only has one slab and you need two. Sorry this has NEVER happened before (one of many "nevers" to come out of his mouth). What I found out was that the sub never had more than one but wouldn't tell the builder because until all the stock was depleted, it was to be shown.

THEN, after much haggling back and forth, we were permitted to look elsewhere. We had to pick up 50% of the extra cost to go outside his sub. We then picked out two gorgeous slabs of Golden River which were the closest I could find to my original pick. They were in the "boneyard" and the sub was supposed to pick them up pronto. I start checking on the progess and find out that sub never picked them up and there is only a 48 hour hold on boneyard slabs.

Sure enough, they sold them to someone else. Mind you, all this is happening when we are living out of town and have already made numerous trips to straighten the first mess out. Luckily, they had a pretty deep inventory and we were able to pick some other ones but YEESH!

Now I have an almost $1600 Lillian August chair in the great room that was picked to compliment our first choice.

Someday I'll tell you about the master bath water closet door that hit the toilet so it couldn't close.

I think I have to go and check my blood pressure now.....

So sorry to hear about your granite. I am beginning to wonder if like helou said this is not the norm. From the horror stories here and some I have heard personally, it just makes you wonder if this is not a trade secret. You do however, seem to be handling it very well. I will be thinking about you :)

I spoke with the granite yard. They do not, and never have, stored granite or marble slabs for fabricators. They have to pay for the granite and take it...no exceptions ever. So basically my fabricator sold it to someone else, just like they did the travertine (which is so much easier to deal with).

I called them for the delivery today and asked for the Jurrassic Green piece...they refuse to give me a delivery time (I can't sit there all day with a 2 year old waiting) and they won't bring the Jurassic piece. I guess that is shot as well :(

The granite yard will help me with the problem, but it's going to cost me of course. I got a deal on that Jurassic ($1,200 verses $3,000 for the vanity) and it was really a special granite piece (it looks like dinasour eggs have landed in the countertop). Dang! And they don't have the vanilla marble...but they can try to help there. They fabricate and do a great job, they're just more expensive...so I'll have to suck it up and pay a few more thousand than originally. Kind of like my cabinets.

wow - I'm astounded. I had read some of the other posts around here about similar things happening previously, but quite the outpouring here.

I ordered a set of free standing cabinets for my new kitchen recently from a small company in Toronto - they'll be custom made for me and I really want a counter that matches them exactly right. Been wrestling with what kind of counter and backsplash to get - someone in the thread I started awhile back suggested something different then granite, but I like the practical side of it a lot too and I think I could find a style I like.

All these horror stories make me want to choose an alternative that I won't have to worry about losing my carefully chosen slabs.

Very interested to hear more about how it all pans out in the end. Always seems unbelievable that these sort of things could happen to anyone, let alone that often.

WOW!! Iggy that sucks big time.... I love that granite. Never saw ANY thing like it. I would be furious if our granite had been sold, especially if it was already paid in full.

OMG Girl, I am so darn sorry! Sorry that this had to happen when you'd actually paid them for that specific granite a long time ago and purchased other non-returnable things to coordinate with them.
If it were me, I'd threaten to sue them for fraud and theft and mental anguish and whatever else. I'd also tell them I was going to file a written complaint with the BBB, their regional supplier and . . . I know I can come up with several more if you give me a minute ;~P You have a very good case that any attorney would love to handle. I'd demand that they get you similar slabs for you to ok (not buy sight unseen) ~and fast~ and for the EXACT amount you've already paid and not a penny more. I'd get their committment in writing . . .in detail . . . on their company letterhead . . . signed and dated by them and you. If they balked, I'd come back with my attorney in tow. If they didn't cooperate then, I'd do everything I'd threatened to do . . . and send them copies of every complaint letter you file/send, too! One more thing, keep detailed notes on everything regarding this. Make copies of everything, too. Keep emails. Make copies of all phone messages from them. Everything. We ended up having to sue our builder and cabinet maker because of the terrible cabinets originally put in our house and several other major mistakes on their parts. We won, but the the case would have gone a lot quicker ~ with them settling much earlier ~ if I'd just kept all their very incriminating note and phone messages to us. It still ticks me off today just thinking about it!

Oh my GOD-the Vulcan Gold from 2006 is beautiful! I am so sorry!!

At least they admitted it. Small comfort, I know. But it would be way worse if they showed up with something hideous and insisted you picked it out!

We had picked out two slabs of Golden Moon after trips to almost a dozen slab yards. Contacted our fabricator & paid for immediately. Then when my DH went back to the slab yard during the week to get a picture (we selected them when it was raining & wanted to see them dry), he couldn't find the slabs. He was on lunch break so he didn't have time to follow through. I called our fabricator & they called the slab yard & were told the slabs had been moved to another slab yard several hours away! The slab yard was to bring our slabs back by the end of the week. I volunteered to drive to the other slab yard to verify they were bringing our selected ones back, but the slab yard said it wasn't necessary. Well they brought the wrong ones!! Had to wait another week for them to bring ours back. Meanwhile this delayed our granite installation by two weeks and our flooring vendor by three weeks! And we're the ones suffering without a kitchen and running water!! All the slab yard said was 'we're sorry about the mix up'! Thank goodness I had the fabricator negotiate an extra $600 off the slab price prior to finding out about the mix up.

Great fabricator! He picked the slabs up the next day after we verified the right slabs and brought them by the house for me to make decisions about the templating. Here I was up on his trailer parked in the street deciding where to position our kitchen counters! Originally I was scheduled to go to his shop. So it turned out o.k. in the end.

Are there any granite yards in your area that are smaller, don't get as much activity & might possibly have old slabs lying around? Because I had the same color problem with Labrador Antique. By the time I was ready for counters the "perfect" sample that I was carrying around with me was 2 years old & the LA that was actually in the yards was much lighter & chunkier. I don't know how many places I looked before I stumbled across some old, neglected, moss covered LA slabs in a dusty corner that matched my beloved sample perfectly.

2 YO vulcan gold could be a possibility.

We only have one yard here in Anchorage (or in the municipality) but they're very good. The sales person I talked to this moring was pretty horrified at the situation and told me she's going to walk the yard and see what she can find. She knew right off about the differences in the old vulcan verses the new vulcan and since I only need one slab, she might be able to find me one...or find me the pieces to make one (which I'd have to approve). Since it's really three smaller counters, this is possible, but she reminded me about a display that I loved every time I visited (I umm like to visit LOL) that also has the three colors, with more gold. She's got only one slab of that left (an old piece she didn't have the name handy because they never could get more after the display was built) so she's getting that out of the warehouse as well for me to see.

The fabricator finally called and told me they would deliver between 4 and 4:30. My tile guy will be there with me so it isn't ugly while I'm alone, and we'll see if I can at least get all of my tile out of them. There are another seven boxes due next week on top of this delivery. I have a splitting migrane, so hopefully it will go ok, cuz I just don't have the energy to do much more than drop some scaffolding on the guys if they get ugly :oP (I'm kidding, should any scaffolding have been errected on site while I was away this week...and chooses to fall at exactly the moment that the tile guys walk in the door)! Really! Kidding! (unfortunately there's no scaffolding handy and I'm too little to push it over) :oP

LOL Mystery I flew down to LA for fabric before DS was born. My days of flying down for anything have been slightly cut back (although I did fly down for the stove heh heh)

I'll actually be in Seattle to take DS to the U at the end of the month, but frankly...shipping stone to Alaska, even with the shipping connections we have, is a serious cost issue. We're better off paying the high prices here and letting the best guys in town make the money (which we'll do...we'll let the two best fight for the business). They buy in bulk...it's packaged right, and they typically have their own containers so it does cut costs significantly.

My tile guy was so horrified he said he should be working for free after all that's happened in our remodel. I tried to get him to sign the wall (no paper handy) or a piece of travertine...but he wouldn't agree to it :oP

Good news is he's doing the shower floor today and it's gorgeous. While the balance of the tile delivery was of course short about 120 sq ft of tile, they did deliver my croc tiles that had been sent to be laser cut for the undermount tub. That stuff is months out if you want any now a days, so I was sweating big time about it not showing up.

Sue I'm on glass two :P If DH isn't home soon I'll have to finish the bottle without him...and he'll be on baby duty tonight :) Hummm maybe that's a good idea LOL

I saw some granite very similar to yours the other day at the stone yard. They just had a new shipment in and I had to take some pictures as it was so gorgeous. I don't know the name on it as it wasn't labled. They had at least three slabs if I recall (probably more). These pictures are not the best because the sun was very bright and I had little space between slabs to get the picture. I told the stone yard person that if that stone was there when I purchased mine, it would have been a close contender. It is stunning in person. If you wish, I can call them or go there tomorrow and take more pictures or find out the name for you.

I'm so sorry about your son IglooChic...I hope he makes a U-turn and heads back where he belongs...gaining weight!

I can so understand how it puts the granite in the "it's just rock" category!

But, as to that rock, it makes me see red that stoneyards or fabricators can get away with this kind of behavior!!!! Maybe it's time someone did take them to court...maybe establish a legal precedent for future TKOs!

After reading this thread I started googling around to see the color difference, and found this place in Seattle that looks like they have the old color. I also checked out your Alaska small claims limit, and it's $10,000.

Because he breached your contract, and you relied on that contract by buying everything that matches the color of the granite he was holding for you, I absolutely think you should find and buy a piece in the old color to match your kitchen, and sue him for the cost of re-buying it and having it shipped from whereever you find it. Or even better, see if the Seattle place (or whereever) will HOLD it for you, maybe with a deposit, and THEN sue him in small claims with a copy of their estimate for what it costs plus shipping. You'll find out if you win or lose within a month or two, and if you win, then you can go ahead and pay for it knowing he'll have to pay you back or just have him pay them directly.

So sorry for your slab troubles and more so, I hope your little one is in improving health!

Do you know which yard in Seattle that the fabricator located a slab? As you know, there are varying levels of yards and customer service! I think the best ones here are Meta, Pental, Michaelangelo and OTM.

My fabricator actually had my slabs ready to install last Friday, but - guess what? He had to fly to Anchorage for another install. And, he flys there regularly, ships from here, says they can be competitive. This guy is a class act and very, very picky about his installations. A perfectionist as much as a person can be when working with imperfect materials. If you want his contact info, let me know. I'll be posting the pics of my install later today.

Also, they may be able to look at the slab on hold and give you their opinion on old vs. new Vulcan. Your slab yard or whoever sold your slabs should be on the hook for the cost of shipping whatever it takes!

The damages will probably be over the small claims court amount...but on top of that I don't have time to do it myself. We're happily turning it over to our attorney. He's like a dog with a yummy bone when he gets stuff like this.

I'm going to head out to a yard in the valley here that originally had my slabs. They have two good replacements (I've seen that one Vulcan Gold slab in seattle and called...the veins are all like that and won't work for our design). But you did possibly save my life. I couldn't remember the name of the place they got the travertine and nordic black antique. You gave it to me...Michaelangelo! YOU ROCK!!! Because they aren't delivering my tiles and I need them to match precut tiles they did deliver. It's holding up the kitchen big time!

This yard I'm visiting does install and they're one of the two best in Alaska. They're much more expensive...but I've learned that saving a buck isn't so good for me LOL Hopefully by the end of the day I'll be in granite heaven again!

You absolutely do not want to handle this through Visa. You want to handle this through an attorney.

NO ONE has the right to sell YOUR property. You don't want a discount. You don't want a refund. You want the property that was taken from you.

If the stone yard or fabricator had charged you a storage fee every month, that would have been reasonable. If they had asked you to take delivery of the stone and store it yourself, that would have been reasonable.

Making them communicate via email is smart.

Now make them communicate with you via an attorney.

This company has committed fraud. "Money got tight;" I could tel you what gets tight but I'd be banned here forever. My money gets tight but I don't steal from other people to compensate. It doesn't matter that they can give you something comparable. If you took your car in to get it serviced, would you accept a different car when you came to pick it up even if it was the same color, make, model and year?

They're counting on you to be in a hurry to get the project done; that's why they sold YOUR stone. It was convenient to sell YOUR stone. It was profitable to sell YOUR stone. Between the stone and the travertine, and the custom back splash tile, you're talking about a lot of money. It shouldn't cost YOU one penny more. This isn't a mistake; it's fraud. I can't believe how angry I feel about this and it's not happening to me! I'm glad you've turned it over to your attorney. I'd make them pay for the custom back splash tile just on matter of principal.

Thanks ya'll :) I am kind of out for blood on the original guy because of the changes to design we had to make due to his fraud. We will deal with that with our attorney though, but he told me to start the process by cancelling the credit card charges and then we'll "settle" in court for what I will owe them or they'll owe me (I am keeping a great deal of the stone they provided, but made big design changes to work with the missing items).

In the end, today DH and I went to the good yard out in the valley and found three lovely slabs for our home. It took two forklifts and the owner to get to the right pieces LOL but we did finally get there (only moved half a dozen slabs...wait maybe a couple more than that). The sales gal kept saying "we normally do this on templating day" but I said "we're picking and looking at rough layouts today and marking the slabs OURS!". As it turned out, the amber tones in the new vulcan gold didn't work at all with my handmade tile, but we finally found a couple slabs of a granite called Thunder Wave which worked perfectly. But even then only two slabs of TW worked...the others were more amber. We do love the stone though. It's not what I had designed the kitchen around, but only I'll know that I guess.

We're happy today, Granite, Marble and whatever my son's stone is are bought and paid for and we watched them treat them with white gloves as they wrote our names all over the pieces :)

abejadulce...never fear...I'm a bit of a b...umm a b word when people try to take advantage of me. They'll probably go out of business over this mistake. Mistakes happen...I forgive...but dishonesty peeves me off!!! (And I see it does to you too LOL)

Igloochic -- I just spotted this unbelievable thread tonight and you're right, they've messed with the wrong woman on this one. You're way smarter than the person who sold what you'd paid for.
