Deck or patio? (Yard slopes towards house)

My back yard slopes towards my house. Before I moved in, the grade was actually high enough that dirt was piled against the siding (above the top of the foundation); I have since excavated about 4 feet away (horizontally) such that grade is 4" below the bottom of the siding and the water drains (sideways, parallel to the house) at least somewhat properly. I plan to build a retaining wall (right now there's a small cliff but the clay soil is sort of holding itself up).

My dilemma is that I want to build some sort of hardscape surface at the same elevation as the finished floor inside, but I'm not sure if it should be a deck or a patio. If I build a deck, as it extends out from the house it would end up hitting ground level (so the ground would rot the deck). If I build a patio, I'd have to fill under it enough to cover up two rows of siding (so the ground would rot the house).

I've attached a diagram so that you can see what I'm talking about; note that it is not to scale.

How do I fix this, and build my deck or patio properly?
