How do I 'win' this battle with my tile salesman?

Okay, I'm quite perturbed tonight. I knew things were going too smoothly this past week on our build. :o) LOL!

I have a dilemma and hope you can give me some advice. This is long, so pour a large cup of coffee or tea!

I purchased tile from an out of state (neighboring state) store. I went to their showroom and found all of the tile for our house, minus DD#1's bathroom. We are building a large home, and I purchased a lot of tile!

Before I purchased my tile, the salesman assured me that any excess tile can be returned before 30 days for a full refund. Nice. We ordered 10% extra of all tiles, just to be sure we had enough. Tile man even asked if they'd take back extra, and that is why I asked the salesman. He said "yes" so tile man upped my order to be sure.

Well, after all that ordering extra, we ran short on our main living area tiles. Some arrived broken and we've had surprisingly few cuts. So we need additional tiles of our main travertine.

On the other hand, I have tile from our master bath to return. I didn't care for the 8 x 16 "brick" travertine I ordered. They did not have a sample in the store, and honestly the color was awful. I'm not loving my larger floor tile either, so did not use it on my shower walls as planned. Instead I purchased more of my 4 x 4 tiles locally and they laid our shower with those instead.

Today I left a message for my salesman at the tile store, letting him know I have an additional order I need to place, and also telling him that I have excess tiles from my master bath to return.

He called me back and dh took his call (I was gone). No problem to get me more of the main tile, that's at their warehouse, blah blah blah. What tile am I trying to return? DH told him it's our master shower tile, and he said "that's not returnable. It was special order tile, and not returnable".

WHAT??? I am now supposed to be stuck with $3,000 worth of tile because he didn't tell me that special order stuff is not returnable? Why did he not tell me that when I was there to go over my order? Or how about when I called to place my order over the phone?

I have yet to get a receipt from them for my order, because each time I call to give him my snail mail addy to send it to me, he's gone and I get his voice mail. He's called me back but missed me, so I'm sure he's not hiding from me. So, I have no receipt that tells me I can't return the tile. He never told me that my master bath tile was excluded from "returnable for 30 days".

The salesman has been shady on two other things. One, he offered to sell me the master tile from another source for less, when I balked at his store price. I was quite dumbfounded that he would have the nerve to do that to his store, and especially irritated when he laughed and said "if you ever say I offered that I'll call you a liar". Hmmm. I should have run at that point, but I needed tile and was stuck with him it seemed. In hindsight...... acccccckkkk!

He's got all kinds of award plaques on his desk, and is the head of the tile dept. The store has several "dept's" and he is the head "specialist" in the tile. I thought it was great that I had someone who knew what he was doing with my tile. Then I felt creeped out when he offered the "purchase from another source for cheaper" deal, saying "you'd have to trust me because you'd be paying me". I told him I'd prefer to just order thru the store so I could return it if I had extra, or any problems came up, etc. He did not mention not being able to return my golden travertine at that point either.

The other thing was I told him I was not going to have to find a hyster to unload my own tile when he told me that my $500.00 delivery fee didn't include them unloading it for us. Then he told me we could unload it by hand "with a few friends". The independent truck driver who called to figure out my house directions asked if we had someone to unload and I said my dh and a few other workers and he about died laughing, because my order was 13 pallets of tile, and 24,000 pounds!! They were individiual tiles except for one pallet of the smaller decorative tiles in boxes. I found a neighbor with tractor and forks and paid him to come unload our tile from the semi. "unload it by hand with a few friends". What a joke!!

So, at this point, I'm uncertain how to proceed. It won't kill me to not get my money back. But I'd surely like it back, of course. And I'm not sure this guy should get away with his crookedness. He looks so normal and nice, but he's totally slimey. I was offended by his offer to find it for me at a lesser price, but figured they wouldn't believe me if I told management, and I just wanted me tile.

I've been eyeing a lot of furniture at their "not cheap" store and at this point I want nothing to do with that place. That's not the stores fault, but his poor actions are reflecting on them. We're building a really large home and have potential to be a very good customer for them. Makes me want to take my business elsewhere.

My tile man wants to take some of his big guys tomorrow and raise a stink and make them take it back. I prefer a more civilized approach.... LOL!

Should I call the salesman? Skip the salesman and call his manager? Not call anyone and let my tile man show up with a load of tile and probably head off to jail? :o- LOL! Do something else entirely that I haven't thought of?

I need more tile from them. I don't know where else I could source that main floor tile. So I need to order my additional tile thru the store. Ick. I don't want to work with him anymore. I imagine I could ask management to place my order, but I'm sure it will still go thru him. They obviously love him. I am sure they have no idea that he is a bit of a cheat. He's making them sales, and that's probably all that matters to them.

Do I have any rights if they won't take it back? I presume they are not going to take it back. I ordered DD's marble and tumbled stone from a box store, and they told me at order time that because it was special order, no return on that order. Fine. I ordered a bit extra, but it's only for one bathroom. Not a bank breaker, by any means.

I understand a policy if it's been spelled out. But what happens when a salesman has not been truthful? Is it worth a fight, or are they going to side with their star employee and stick me with the tile anyway? AT which point it's not worth the fight.

Advice? Recommendations? (besides telling me I went about this all wrong and am totally gullible.... he, he).
